一、說明 A Explanation
1.資金來源Source of Funds
1.1 本招標文件第二冊第6章投標資料表中所述的招標人已擁有一筆資金/貸款。招標人計劃將一部分資金/貸款用于支付本次招標后所簽訂合同項下的款項。
The Tenderer named in the Bid Data Sheet of Section 6 (Volume 2) has received a loan/fund as identified in the Bid Data Sheet. The Tenderer intends to apply a portion of the proceeds of this loan/fund to the payments under the contract for which this Invitation for Bids is issued.
2.招標機構及合格的投標人
Tendering Agent for ICB Procurement of Mechanic and Electronic Products and Eligible Bidders
2.1招標機構 Tender Agent
機電產品國際招標機構是指依照中華人民共和國商務部令2005年第6號《機電產品國際招標機構資格審定辦法》取得招標資格并從事機電產品國際招標代理業(yè)務的企業(yè)法人。本次招標的招標機構名稱、地址、電話和傳真見投標資料表。
The Tendering Agent for ICB Procurement of Mechanic and Electronic Products (hereinafter referred to as “Tendering Agent”)means the Legal Person approved and authorized by the Ministry of Commerce to handle the procurement of mechanic and electronic products by way of International Competitive Bidding (ICB) in accordance with the Measures for Examining and Approving the Qualification of International Tendering Institutions for Electromechanical Products, Decree No.6, 2005 of the Ministry of Commerce of the People’s Republic of China Details such as name, address, telephone and facsimile of the Tendering Agent for this bidding are listed in the Bid Data Sheet.
2.2 合格的投標人Eligible Bidders
1）投標人是響應招標、參加投標競爭的法人或其他組織。除非另有規(guī)定，凡是來自中華人民共和國或是與中華人民共和國有正常貿易往來的國家或地區(qū)（以下簡稱“合格來源國/地區(qū)”）的供貨人均可投標。
Bidders are legal persons or other organizations who participate in bidding. This Invitation for Bids is open to all suppliers from within the People’s Republic of China (hereinafter abb. as “PRC”) and all countries/areas which have regular trade relations with PRC (hereinafter called “the eligible source countries/areas”), except as provided hereinafter.
2）投標人不得直接或間接地與招標人為采購本次招標的貨物進行設計、編制規(guī)范和其他文件所委托的咨詢公司或其附屬機構有任何關聯(lián)。
Bidders should not be associated, directly or indirectly, with a firm or any of its affi1iates which have ken engaged by the Tenderer to provide consulting services for the preparation of the design, specifications, and other documents to be used for the procurement of the goods to be purchased under this Invitation for Bids.
3）只有在法律上和財務上獨立、合法運作并獨立于招標人和招標機構的供貨人才能參加投標。
The Suppliers may participate in the bids only if they are legally and financially autonomous, if they operate under relevant law, and if they are not a dependent agency of the Tendering Agent and the Tenderer.
3.合格的貨物和服務Eligible Goods and Services
3.1 合同中提供的所有貨物及其有關服務的原產地，均應來自上述2.2條款規(guī)定的合格來源國/地區(qū)。本合同的支付也僅限于這些貨物和服務。
All goods and related services to be supplied under the contract shall have their origin in eligible source counties, as defined in clause 2.2 above, and all expenditures made under the contract will Instructions to Bidders be limited to such goods and services.
3.2 本款所述的“原產地”是指貨物開采、生長或生產或提供有關服務的來源地。所述的“貨物”是指通過制造、加工或用重要的和主要的元部件裝配而成的，其基本特征、功能或效用應是商業(yè)上公認的與元部件有著實質性區(qū)別的產品。
For purposes of this clause,“origin” means the place where the goods are mined, grown or produced, or the place from which the related services are supplied. Goods are produced when, through manufacturing, processing, or substantial and major assembly of components, a commercially recognized product results that is substantially different in basic characteristics or in purpose or utility from its components.
3.3 貨物和服務的原產地有別于投標人的國籍。
The origin of goods and services is distinct from the nationality of the bidder.
4.投標費用 Cost of Bid
4.1投標人應承擔所有與準備和參加投標有關的費用。不論投標的結果如何，投標資料表中所述的招標機構和招標人均無義務和責任承擔這些費用。
The Bidder shall bear all costs associated with the preparation and submission of its bid, and the Tendering Agent and the Tenderer, named in the Bid Data Sheet, will in no case be responsible or liable for those costs, regardless of the conduct or outcome of the bid process.
二、招標文件 B The Bidding Documents
5.招標文件的構成Content of Bidding Documents
5.1 本招標文件的編制依據是《中華人民共和國招標投標法》和中華人民共和國商務部2004年第13號《機電產品國際招標投標實施辦法》。
5.1 Basis of the Bidding Documents is : 《The People’s Republic of China Bidding & Tendering Law》, 《Working Method for International Bidding of Electric and Machinery Product》NO.13, 2004. issued by Ministry of Commerce.
5.2要求提供的貨物、招標過程和合同條件在招標文件中均有說明。招標文件以中文或中、英文兩種文字編寫。以中、英文兩種文字編寫時，兩種文字具有同等效力；中文本與英文本如有差異，以中文本為準。
The goods required, bidding procedures and contract terms are prescribed in the bidding documents, which is compiled in both English and Chinese. The two languages have the same effectiveness. In the event of any discrepancy between them, the Chinese shall prevail.
招標文件共8章，分裝兩冊。各冊的內容如下：

5.3 投標人應認真閱讀招標文件中所有的事項、格式、條款和技術規(guī)格等。招標人沒有按照招標文件要求提交全部資料，或者投標沒有對招標文件在各方面都作出實質性響應是投標人的風險，并可能導致其投標被拒絕。
The Bidder is expected to examine all instructions, forms, terms and specifications in the bidding documents. Failure to furnish a11 information required by the bidding documents or to submit a bid not substantially responsive to the bidding documents in every respect will be at the Bidder’s risk and may result in the rejection of its bid.
6.招標文件的澄清Clarification of Bidding Documents
6.1任何要求對招標文件進行澄清的潛在投標人，均應以書面形式通知招標機構和招標人。招標機構對其在投標資料表中所述投標截止期5日以前收到的對招標文件的澄清要求均以書面形式予以答復，同時將書面答復發(fā)給每個購買招標文件的潛在投標人（答復中不包括問題的來源）。
A prospective Bidder requiring any clarification of the bidding documents may notify the Tendering Agent and the Tenderer in writing. The Tendering Agent will respond in writing to any request for clarification of the bidding documents which it receives no later than fifteen (5) days prior to the deadline for the submission of bids prescribed in the Bid Data Sheet. Written copies of the Tendering Agent’s response (without identifying the source of inquiry) will be sent to all prospective bidders who have purchased the bidding documents.
6.2投標人認為招標文件存在歧視性條款或不合理要求，應在規(guī)定時間內一次性全部提出。
6.2 If there exist any discriminative terms or unreasonable requirements in the bidding documents, the bidder shall present those items one time within the specified period.
7. 招標文件的修改Amendment of Bidding Documents
7.1 在投標截止期前，無任出于何種原因，招標機構和招標人可主動地或在解答潛在投標人提出的澄清問題時對招標文件進行修改。
At any time prior to the deadline for submission of bids, the Tendering Agent, for any reason,
whether at its own initiative or in response to a clarification requested by a prospective Bidder,
may modify the bidding documents by amendment.
7.2 招標文件的修改是招標文件的組成部分，將以書面形式通知所有購買招標文件的潛在投標人，并對潛在投標人具有約束力。潛在投標人在收到上述通知后，應立即以書面形式向招標機構和招標人確認。
The amendment constitutes a part of Bidding documents. All prospective bidders who have purchased the bidding documents will be notified of the amendment in writing, and will be binding on them. Prospective Bidders shall promptly acknow1edge the receipt thereof by in writing to the Tendering Agent and the Tenderer.
7.3 為使投標人準備投標時有充分時間對招標文件的修改部分進行研究，招標機構和招標人將適當推遲投標截止期。
In order to afford prospective bidden reasonable time in which to take the amendment into account in preparing their bids, the Tendering Agent, at its discretion, will extend the deadline for the submission of bids.
三、投標文件的編制 C Preparation of bidding documents
8.投標的語言Language of Bid
8.1 投標人提交的投標文件以及投標人與招標機構和招標人就有關投標的所有來往函電均應使用投標資料表中規(guī)定的語言書寫。投標人提交的支持資料和已印刷的文獻可以用另一種語言，但相應內容應附有投標資料表中規(guī)定語言的翻譯本，在解釋投標文件時以翻譯本為準。
The bid prepared by the Bidder, as well as all correspondence and documents relating to the bid exchanged by the Bidder and the Tender1ng Agent/the Tenderer, shall be written in the language specified in the Bid Data Sheet. Supporting documents and printed literature furnished by the Bidder may be in another language provided they are accompanied by an accurate translation of the relevant passages in the language specified in the Bid Data Sheet, in which case, for purposes of interpretation of the Bid, the translation shall govern
9. 投標文件的組成 Content comprising the Bid
9.1 投標人編寫的投標文件應包括下列部分：
The bid prepared by the Bidder shall comprise the following components:
1） 按照本須知第10、11和12條要求填寫的投標書、投標分項報價表以及供唱標時使用的、單獨密封的投標一覽表；
A Bid Form, Bid Schedule of Prices and a Summary Sheet for Bid Opening which shall be submitted in a separate envelope completed in accordance with ITB Clauses 10,1l and 12;
2）按照本須知第13條要求出具的資格證明文件，證明投標人是合格的，而且中標后有能力履行合同；
Documentary evidence established in accordance with ITB Clause 13 that the Bidder is eligible to bid and is qualified to perform the contract if its bid is accepted;
3）按照本須知第14條要求出具的證明文件，證明投標人提供的貨物及服務是合格的，且符合招標文件規(guī)定；
Documentary evidence established in accordance with ITB Clause 14 that the goods and ancillary services to be supplied by the Bidder are eligib1e goods and services and conform to the bidding documents;
4）按照本須知第15條規(guī)定提交的投標保證金。
Bid security furnished in accordance with ITB Clause 15.
10. 投標文件的編寫B(tài)id Form
10.1 投標人應按照第四章招標文件格式完整地填寫投標書、開標一覽表、投標分項報價表以及招標文件中規(guī)定的其他內容。
The Bidder shall complete the Bid Form, Summary Sheet for Bid Opening and Price Schedule and other stipulated contents furnished in Section IV ”Formats of Bids” of the bidding documents.
11.投標報價Bid Prices
11.1 投標人應在投標分項報價表上標明本合同擬提供貨物的單價（如適用）和總價。
The Bidder shall indicate on the appropriate Bid Schedule of Prices the unit prices (where applicable) and total bid price of the goods it proposes to supply under the contract.
投標總價中不得包含招標文件要求以外的內容，否則，在評標時不予核減。投標總價中也不得缺漏招標文件所要求的內容，否則，評標時將有效投標中該項內容的最高價計入其投標總價。
The amounts cannot contain the contents that beyond the bidding document. Otherwise, it can not be accounted and subtracted during evaluation. And it also cannot lack the contents that requested in the bidding document. Otherwise, the maximum price of this item among the valid bids will be counted into it.
11.2 投標分項報價表上的價格應按下列方式分別填寫：
Prices indicated on the Bid Schedule of Prices shall be entered separately in the following manner:
11.2.1 從中華人民共和國境內提供的貨物：For goods offered from within PRC:
1） 報所供貨物的EXW（出廠）價，倉庫交貨價、展室交貨價或貨架交貨價的，除應包括要向中華人民共和國政府繳納的增值稅和其他稅，還應包括對以下①、②兩項已交納或應交納的全部關稅、增值稅和其他稅：
The price of the goods quoted EXW (ex-works, ex-factory, ex-warehouse, x-showroom, or off-the-shelf, as applicable), including Value Added Taxes (VAT) and other taxes already paid or payable to the government of PRC, as well as all customs duties, VAT and other taxes paid or payable:
① 報EXW價的貨物在制造或組裝時使用的部件和原材料是從境外進口的；或
on the components and raw material used in the manufacture or assembly or goods of foreign origin quoted ex-works or ex-factory; or
② 報倉庫交貨價、展室交貨價或貨架交貨價的貨物是從境外進口的。
on the previously imported goods of foreign origin quoted ex-warehouse, ex-showroom, or off-the-shelf.
2）如果投標資料表中有規(guī)定，報貨物運至最終目的地的內陸運輸、保險和伴隨貨物交運的有關費用。
The price for inland transportation, insurance, and other local costs incidental to delivery of the goods to their final destination, if specified in the Bid Data Sheet.
3）報投標資料表中列出的其他伴隨服務的費用（如果有的話）。
The price of other (incidental) services, if any, listed in the Bid Data Sheet.
11.2.2 從中華人民共和國境外提供的貨物
For goods offered from abroad:
1）按照投標資料表中的規(guī)定，報CIF（指定目的港）價，或CIP （指定目的地）價。
The price of the goods shall be quoted CIF named port of destination, or CIP named place of destination in PRC, as specified in the Bid Data Sheet.
2）如果投標資料表中有規(guī)定，報FOB（指定裝運港）價，或FCA（指定承運地點）價，或其他方式的報價。
The price of goods quoted FOB port of shipment (or FCA, as the case may be), if specified in the Bid Data Sheet.
3）如果投標資料表中有規(guī)定，報貨物從進口口岸運至最終目的地的內陸運輸、保險和其他當地發(fā)生的伴隨費用。
The price for inland transportation, insurance, and other local costs incidental to delivery of the goods from the port of entry to their final destination, if specified in the Bid Data Sheet.
4）報投標資料表中列出的其他伴隨服務費用（如果有的話）。
The price of (incidental) services, If any, listed in the Bid Data Sheet.
11.3 EXW、CIF和CIP等價格術語，應根據巴黎國際商會現(xiàn)行最新版本的《國際貿易術語解釋通則》（Incoterms）的規(guī)定來解釋。
The terms EXW, CIF, CIP, etc., shall be governed by the rules prescribed in the current edition of Incoterms published by the International Chamber of Commerce, Paris.
11.4 投標人根據本須知第11.2條的規(guī)定將投標價分成幾部分，只是為了方便招標機構和招標人對投標文件進行比較，并不限制招標人以上述任何條件訂立合同的權力。
The Bidder’s separation of price components in accordance with ITB Clause 11.2 above will be solely for the purpose of facilitating the comparison of bids by the Tendering Agent and the
Tenderer and will not in any way limit the Tenderer’s right to contract on any of the terms
offered.
11.5 除非投標資料表中另有規(guī)定，投標人所報的投標價在合同執(zhí)行過程中是固定不變的，不得以任何理由予以變更。任何包含價格調整要求的投標被認為是非實質性響應投標而予以拒絕。
Except as otherwise specified in Bid Data sheet, Prices quoted by the Bidder shall be fixed during the Bidder’s performance of the contract and not subject to variation on any account. A bid submitted with an adjustable price quotation will be treated as substantially non-responsive and will be rejected.
11.6除投標資料表中允許有備選方案外，本次招標不接受選擇性報價。除本須知有規(guī)定外，本次招標不接受具有附加條件的報價。
12.投標貨幣Bid Currency
12.1 除非另有規(guī)定或許可，投標人從中華人民共和國境內提供的貨物和服務用人民幣報價。
The prices shall be quoted in RMB for goods and services that the Bidder will supply from
within PRC, unless specified or permitted otherwise;
12.2 投標人從中華人民共和國境外提供的貨物和服務用投標資料表中規(guī)定的貨幣報價。
The prices shall be quoted in any of the currencies defined in the Bid Data Sheet for goods and services that the Bidder will supply from outside PRC.
13.證明投標人合格和資格的文件Documents Establishing Bidder’s Eligibility and Qualifications
13.1 投標人應提交證明其有資格參加投標和中標后有能力履行合同的文件，并作為其投標文件的一部分。如果投標人為聯(lián)合體，應提交聯(lián)合體各方的資格證明文件、共同投標協(xié)議并注明主辦人及各方擬承擔的工作和責任。否則，將導致其投標被拒絕。
The Bidder shall furnish, as part of its bid, documents establishing the Bidder’s eligibility to
bid and its qualifications to perform contract if its bid is accepted. If the Bidder is a Joint Venture, each member of the Joint Venture shall submit respectively the Qualification Documents, together with the Joint Venture Agreement in which the leading member of the Joint Venture and respective work scope and responsibility shall be Clearly indicated. Otherwise, its bid will be rejected.
13.2 投標人提交的資格證明文件應證明其來自本須知第2.2條款定義的合格來源國/地區(qū)。
The documentary evidence of the Bidder’s eligibility to bid shall establish to the Tendering Agent and the Tenderer’s satisfaction that the Bidder, at the time of submission of its bid, is from an eligible country as defined under ITB Clause 2.
13.3 投標人提交的證明其中標后能履行合同的資格證明文件應包括下列文件：
The documentary evidence of the Bidder’s qualifications to perform the contract if its bid is
accepted shall establish to the Tendering Agent and the Tendeer’s satisfaction:
1）如果投標人按照合同提供的貨物不是投標人自己制造的，投標人應得到貨物制造商同意其在本次投標中提供該貨物的正式授權書（見格式IV-9-4）；
that, in the case of a Bidder offering to supply goods under the contract which the Bidder
does not manufacture or otherwise produce, the Bidder has been duly authorised by the goods’ Manufacturer or Producer to supply the goods in this bidding project, format as per Section 4 Form IV-9-4.
2）證明投標人已具備履行合同所需的財務、技術和生產能力的文件；
that, the Bidder has the financial, technical and production capability necessary to perform the contract;
3）證明投標人滿足投標資料表中列出的業(yè)績要求的文件。
that, the Bidder meets the qualification criteria listed in the Bid Data Sheet.
4）投標人開戶銀行在開標日前三個月內開具資信證明原件或該原件的復印件；
that, the Bidder shall provide the bank reference letter issued within three months prior to the time of bid opening in original or its copy;
5）招標文件中要求的其他資格證明文件。

14證明貨物的合格性和符合招標文件規(guī)定的文件
Documents Establishing Goods, Eligibility and Conformity to Bidding Documents
14.3 投標人應提交證明文件，證明其擬供的合同項下的貨物和服務的合格性符合招標文件規(guī)定。該證明文件作為投標文件的一部分。
The Bidder shall furnish, as part of its bid, documents establishing the e1igibility and conformity to the bidding documents of all goods and services which the Bidder proposes to supply under the contract.
14.4 貨物和服務合格性的證明文件應包括投標分項報價表中對貨物和服務原產地的說明，并由裝運貨物時出具的原產地證書證實。
The documentary evidence of the eligibility of the goods and services shall consist of a statement in the Bid Schedule of Prices of the country of origin of the goods and services offered which shall be confirmed by a certificate of origin issued at the time of shipment.
14.3 證明貨物和服務與招標文件的要求相一致的文件，可以是文字資料、圖紙和數據，它包括：
The documentary evidence of conformity of the goods and services to the bidding documents
may be in the form of literature, drawings and data, and shall consist of:
1）貨物主要技術指標和性能的詳細說明。
a detailed description of the essential technical and performance characteristics of the goods; and
2）貨物從招標人驗收后開始使用至投標資料表中規(guī)定的周期內正常、連續(xù)地使用所必須的備件和專用工具清單，包括備件和專用工具的貨源及現(xiàn)行價格；
a list, giving full particulars, including available sources and current prices of spare parts,
special tools, etc., necessary for the proper and continuing functioning of the goods for a
period to be specified in the Bid Data Sheet, following commencement of the use of the
goods by the Tenderer; and
3）對照招標文件技術規(guī)格，逐條說明所提供貨物和服務已對招標文件的技術規(guī)格做出了實質性的響應，并申明與技術規(guī)格條文的偏差和例外。特別對有具體參數要求的指標，投標人必須提供所投設備的具體參數值。
an item-by-item commentary on the Tenderer’s Technical Specifications demonstrating substantial responsiveness of the goods and services to those specifications, or a statement of deviations and exceptions to the provisions of the Technical Specifications. Particularly, to those specifications with specific parameters, the bidder shall furnish specif1c parameter value of offered goods.
14.4 投標人在闡述上述第14.3 3）時應注意招標文件的技術規(guī)格中指出的工藝、材料和設備的標準以及參照的品牌或型號僅起說明作用，并沒有任何限制性。投標人在投標中可以選用替代標準、品牌或型號，但這些替代要實質上滿足或超過技術文件的要求。
For purposes of the commentary to be furnished pursuant to ITB Clause l4.3 3）above, the Bidder shall note that standards for workmanship, material and equipment, as we11 as references to brand names or catalogue numbers designated by the Tenderer in its Technical Specifications. are intended to be descriptive only and not restrictive. The Bidder may substitute alternative standards, brand names, and/or catalogue numbers in its bid, provided that it demonstrates to the Tenderer’s satisfaction that the substitutions ensure substantial equivalence to or higher than those designated in the Technical Specifications.
15投標保證金B(yǎng)id Security
15.1投標人應提交投標資料表規(guī)定數額的投標保證金，并作為其投標的一部分。
The Bidder shall furnish, as part of its bid, a bid security in the amount specified in the Bid Data Sheet.
15.2投標保證金是為了保護招標機構和招標人免遭因投標人的行為而蒙受損失。招標機構和招標人在因投標人的行為受到損害時可根據本須知第15.7條的規(guī)定沒收投標人的投標保證金。
The bid security is required to protect the Tendering Agent and the Tenderer against the risk of
Bidder’s conduct which would warrant the security’s forfeiture, pursuant to ITB Clause 15.7.
15.3投標保證金應用投標貨幣或招標機構可接受的貨幣，并采用下列任何一種形式：
The bid security shall be denominated in the currency of the bid or in another currency acceptable to the Tendering Agent, and shall be in one of the following forms:
1）由一家在中華人民共和國境內或境外信譽好的銀行用招標文件提供的格式或招標機構接受的其他格式出具的銀行保函或不可撤銷的信用證，其有效期應超過投標有效期30日；
A bank guarantee or an irrevocable letter of credit issued by a reputable bank located in PRC or abroad, in the form provided in the bidding documents or another form acceptable to the Tenderer and valid for thirty (30) days beyond the validity of the bid; or
2）銀行本票、保兌支票或現(xiàn)金，或投標資料表中規(guī)定的其他形式。
A cashier’s check, certified check, or cash. or other forms prescribed in the Bid Data Sheet.
15.4 凡沒有根本須知第15.1和15.3條的規(guī)定隨附投標保證金的投標，應按本須知第24條的規(guī)定視為非響應性響應，并予以拒絕。
Any bid not secured in accordance with ITB Clauses 15.l and 15.3m will be rejected as non-responsive, pursuant to ITB Clause 24.
15.5 未中標的投標人的投標保證金，將盡速并不晚于按照本須知第16條規(guī)定的投標有效期期滿30日原額退還投標人。
Unsuccessful bidders’ bid security will be discharged or returned in its origenal amount as promptly as possible but not later than thirty (30) days after the expiration of the period of bid
validity pursuant to ITB Clause 16.
15.6 中標人的投標保證金， 在中標人按本須知第34條規(guī)定簽訂合同，按本須知第35條規(guī)定交納了履約保證金，并按本須知第36條規(guī)定交納了招標服務費后予以退還。
The successful Bidder’s bid security wi11 be discharged upon the Bidder signing the contract,
pursuant to ITB Clause 34, and furnishing the performance security, pursuant to ITB Clause 35,and payment of Tendering service fee pursuant to ITB Clause 36.
15.7 下列任一情況發(fā)生時，投標保證金將被沒收：The bid security may be forfeited:
1）投標人在招標文件中規(guī)定的投標有效期內撤回投標；
if a Bidder withdraws its bid during the period of bid validity specified in the bidding documents; or
2）中標人在規(guī)定期限內未能根據本須知第34條規(guī)定簽訂合同；
if the successful Bidder fails to sign the contract in accordance with ITB Clause 34;or
3）中標人在規(guī)定期限內未能根據按本須知第35條規(guī)定提交履約保證金；
if the successful Bidder fails to furnish performance security in accordance with ITB Clause 35.or
4）中標人未按本須知第36條規(guī)定交納招標服務費。
if the successful bidder failures to pay the tendering service fee with ITB Clause 36.
16投標有效期Period of Validity of bids
16.1投標應自投標資料表中規(guī)定的開標日起，并在投標資料表中所述時期內保持有效。投標有效期不足的投標將被視為非實質性響應，并予以拒絕。
Bids shall remain valid for the period specified in the Bid Data Sheet from the date of bid opening.A bid valid for a shorter period shall be rejected as non-responsive.
16.2特殊情況下，在原投標有效期截止之前，招標機構可要求投標人同意延長投標有效期。這種要求與答復均應以書面形式提交。投標人可拒絕招標機構的這種要求，其投標保證金將不會被沒收。但其投標在原投標有效期期滿后將不再有效。同意延長投標有效期的投標人將不會被要求和允許修正其投標，而只會被要求相應地延長其投標保證金的有效期。在這種情況下，本須知第15條有關投標保證金的退還和沒收的規(guī)定將在延長了的有效期內繼續(xù)有效。
In exceptional circumstances, prior to the expiry of the original bid validity period, the Tendering Agent may request the Bidder’s consent to an extension of the period of validity. The request and the responses thereto shall be made in writing. A Bidder may refuse the request without forfeiting its bid security. A Bidder agreeing to the request will not be required nor permitted to modify its bid, but will be required to extend the validity of its Bid security correspondingly. The provisions of Clause 15 regarding discharge and forfeiture of Bid Security shall continue to apply during the extended period of bid validity.
17投標文件的樣式和簽署Format and Signing of Bids
17.1投標人應準備一份投標文件正本和投標資料表中規(guī)定數目的副本，每套投標文件須清楚地標明“正本”或“副本”。若副本與正本不符，以正本為準。
The Bidder shall prepare an original and the number of copies of the bid indicated in the Bid Data Sheet, clearly marking each “ORIGINAL”, or “COPY” of bid, as appropriate. In the event of any discrepancy between them, the original shall govern.
17.2投標文件的正本須打印或用不褪色墨水書寫，并由法定代表人或經正式授權的代表簽字。授權代表須將以書面形式出具的《法定代表人授權書》附在投標文件中。除沒有修改過的印刷文獻外，投標文件的每一頁都應由法定代表人或其授權代表用姓或首字母簽字。投標文件的副本應為正本的復印件。
The original bid shall be typed or written in indelible ink and shall be signed by the legal representative of the Bidder or a person or persons duly authorized to bind the Bidder to the contract. The latter authorization shall be indicated by written power of attorney accompanying the bid. All pages of the bid, except for unamended printed literature, shall be initialed by the person or persons signing the bid. The copies of bid shall be the duplicated copies of the original bid.
17.3任何行間插字、涂改和增刪，必須由投標文件簽字人在旁邊簽字才有效。
Any interlineation, erasures or overwriting shall be valid only if they are initialed by the person or persons signing the bid.
四、投標文件的遞交D Submission of bids
18 投標文件的密封和標記Sealing and Marking of Bids
18.1投標文件應包括開標一覽表。為方便開標時唱標，投標人還應將開標一覽表和投標保證金單獨密封提交，并在信封上標明“開標一覽表”字樣。投標人應將投標文件正本和所有的副本分開密封裝在單獨的信封中，且在信封上標明“正本”“副本”字樣。然后再將所有信封封裝在一個外層信封中。
Summary Sheet for bid Opening shall be included in the bid. For the convenience of Bid Opening, the Bidder is required to submit the Summary Sheet for Bid Opening, together with the Bid Security, in a separate envelope and duly marking the envelope as “Summary Sheet for Bid Opening”. The Bidder shall seal the original and each copy of the bid in separate envelopes, duly marking the envelopes as“ORIGINAL” and “COPY”. All these envelopes shall then be sealed in an outer envelope.
18.2內外層信封均應：The inner and outer envelope shall be:
1）清楚標明遞交至投標資料表中指明的地址。
addressed to the address given in the Bid Data Sheet; and
2）注明投標資料表中指明的項目名稱、投標邀請的標題、編號和“在（開標日期和時間）之前不得啟封”的字樣，并填入投標資料表中規(guī)定的開標日期和時間。
bear the Project name indicated in the Bid Data Sheet, the Invitation for Bids(IFB)title and number indicated in the Bid Data Sheet, and the word“DO NOT OPEN BEFORE”, followed by the time and date for bid opening specified in the Bid Data Sheet.
18.3內層信封應寫明投標人名稱和地址，以便將遲交的投標文件能原封退回。
The inner envelopes shall also indicate the name and address of the Bidder to enable the bid to
be returned unopened in case it is declared “late”.
18.4 如果外層信封未按本須知第18.2條要求加寫標記和密封， 招標機構對誤投或提前啟封概不負責。
If the outer envelope is not sealed and marked as required by ITB Clause 18.2, the Tendering
Agent will assume no responsib11ity for the bid’s misplacement or premature opening.
19投標截止期Deadline for Submission of Bids
19.1投標人應在不遲于投標資料表中規(guī)定的截止日期和時間將投標文件遞交至招標機構，遞交地點應是投標資料表中指明的地址。
Bids must be received by the Tendering Agent at the address and a time no later than the time and date specified in the Bid Data Sheet.
19.2招標機構可以按本須知第7條規(guī)定，通過修改招標文件自行決定酌情退遲投標截止期。在此情況下，招標機構、招標人和投標人受投標截止期制約的所有權利和義務均應延長至新的截止期。
The Tendering Agent may, at its discretion, extend this deadline for the submission of bids by
amending the bidding documents in accordance with ITB C1ause7, in which case all rights and obligations of the Tendering Agent/the Tenderer and Bidders previously subject to the deadline will thereafter be subject to the deadline as extended.
20遲交的投標文件 Late Bids
招標機構將拒絕并原封退回在本須知第19條規(guī)定的截止期后收到的任何投標文件。
Any bid received by the Tendering Agent after the deadline for submission of bids, pursuant to ITB Clause 19, will be rejected and returned unopened to the Bidder.
21投標文件的修改與撤回 Modification and Withdrawal of Bids
21.1投標人在遞交投標文件后，可以修改或撤回其投標， 但投標人必須在規(guī)定的投標截止期之前將修改或撤回的書面通知遞交到招標機構。
The Bidder may modify or withdraw its bid after the bid’s submission, provided that written notice of the modification, including substitution or withdrawal of the bids, is received by the Tendering Agent prior to the deadline for submission of bids.
21.2投標人的修改或撤回通知應按本須知第18條規(guī)定編制、密封、標記和遞交。
The Bidder’s rnodif1cation or withdrawal notice shall be prepared, sealed, marked and dispatched in accordance with the provisions of ITB Clause l8.
在投標截止期之后，投標人不得對其投標做任何修改。
No bid may be modified after the deadline for submission of bids.
21.4 從投標截止期至投標人在投標書中確定的投標有效期期滿的這段時間內，投標人不得撤回其投標，否則其投標保證金將按照本須知第15.7條的規(guī)定被沒收。
No bid may be withdrawn in the interval between the deadline for submission of bids and the
expiration of the period of bid validity specified by the Bidder on the Bid Form. Withdrawal of a bid during this interval may result in the Bidder’s forfeiture of its bid security, pursuant to ITB Clause 15.7.
五、開標與評標E Opening and Evaluation of Bids
22 開標Opening of Bid
22.1招標機構在投標資料表中規(guī)定的日期、時間和地點組織公開開標。 開標時邀請所有投標人代表自愿參加。參加開標的代表應簽名報到以證明其出席。
The Tendering Agent will open all bids in the presence of bidders’ representatives who choose
to attend, in the place and at the date and time specified in the Bid Data Sheet. The bidders, representatives who are present shall sign a register evidencing their attendance.
22.2開標時，招標機構當眾宣讀投標人名稱、修改和撤回投標的通知、投標價格、價格變更聲明、是否提交了投標保證金，以及招標機構認為合適的其他內容。除了按照本須知第20條的規(guī)定原封退回遲到的投標之外，開標時將不得拒絕任何已購買招標文件的投標人的投標。
The bidders’ names, bid ,modifications or withdrawals, bid prices, price modification statement, and the presence or absence of the requisite bid security and such other details as the Tendering Agent, at its discretion, may consider appropriate, will be announced at the bid opening. No bid shall be rejected at bid opening, except for late bids, which shall be returned unopened to the Bidder pursuant to ITB Clause 20.
22.3在開標時沒有啟封的投標文件和沒有讀出的上述第22。2條款的內容，在評標時將不予考慮。并將原封退回給投標人。
Bids that are not opened and the contents of ITB Clause 22.2 that are not read out at the bid opened shall not be considered further for evaluation. Such bids will be returned unopened to the bidders.
22.4 招標機構將做開標記錄。
The Tender1ng Agent wi1l prepare minutes of the bid opening.
23 投標文件的澄清Clarification of bids
23.1評標由依照有關法規(guī)組建的評標委員會負責。評標委員會將按照投標資料表中確定的最低評標價法或綜合評價法進行。本投標人須知第26條和第27條的規(guī)定適用于最低評標價法；綜合評價法的評分方法和標準在本招標文件第二冊中規(guī)定。評標委員會對投標文件的評審，分為符合性檢查、商務評議、技術評議和價格評議/綜合評議。
The Evaluation Committee will be in charge of the evaluation. Evaluation Committee will examine the bids per Lowest bid price evaluation or comprehensive evaluation method as specified in Bid Data Form. ITB Clause 26 and Clause 27 are applicable to the lowest bid price evaluation; while the standards and manners of the comprehensive evaluation are specified in Volume two of the bidding document. Evaluation committee will execute the technical and price/comprehensive evaluation to bids including the evaluation of conformity, commercial, technical, price and comprehensive capacity.
23.2在評標期間，評標委員會可要求投標人對其投標文件進行澄清，但不得尋求、提供或允許對投標價格等實質性內容做任何更改。有關澄清的要求和答復均應以書面形式提交。
During evaluation of the bids, the Evaluation Committee may, at its discretion, ask the Bidder for a clarification of its bid. The request for clarification and the response shall be in writing, and no change in the prices or substance of the bid shall be sought, offered or permitted.
24 投標文件的初審 Preliminary Examination
24.1評標委員會將審查投標文件是否完整、總體編排是否有序、文件簽署是否合格、投標人是否提交了投標保證金、有無計算上的錯誤等。
The Evaluation Committee will examine the bids to determine whether they are complete, whether the bids are generally in order, whether required securities have been furnished, whether the documents have been properly signed, and whether any computational errors have been made.
24.2 算術錯誤將按以下方法更正：若單價計算的結果與總價不一致，以單價為準修改總價；若用文字表示的 數值與用數字表示的數值不一致，以文字表示的數值為準。如果投標人不接受對其錯誤的更正，其投標將被拒絕。
Arithmetical errors will be rectified on the following basis. If there is a discrepancy between the unit price and the total price that is obtained by multiplying the unit price and quantity, the unit price shall prevail, and the total price shall be corrected. If there is a discrepancy between words and figures, the amount in words will prevail. If the bidder does not accept the correction of the errors, its bid will be rejected.
24.3 對于投標文件中不構成實質性偏差的不正規(guī)、不一致或不規(guī)則，評標委員會可以接受，但這種接受不能損害或影響任何投標人的相對排序。
The Evaluation Committee may waive any minor informality, nonconformity, or irregularity in a bid which does not constitute a material deviation, provided such waiver does not prejudice or affect the relative ranking of any Bidder.
24.4 在詳細評標之前，評標委員會要審查每份投標文件是否實質上響應了招標文件的要求。實質上響應的投標應該是與招標文件要求的關鍵條款、條件和規(guī)格相符，沒有重大偏離的投標。對關鍵條文的偏離、保留或反對，例如關于投標保證金、適用法律、稅及關稅等內容的偏離將被認為是實質上的偏離。評標委員會決定投標的響應性只根據投標本身的真實無誤的內容，而不依據外部的證據，但投標有不真實不正確的內容時除外。
Prior to the detailed evaluation, the Evaluation Committee will determine the substantial responsiveness of each bid to the bidding documents. For purposes of these Clauses, a substantially responsive bid is one which conforms to all the terms and conditions of the bidding documents without material deviations. Deviation from, or objections or reservations to critical provisions, such as those concerning Bid Security, Applicable Law, and Taxes and Duties, will be deemed to be a material deviation. The Evaluation Committee’s determination of a bid’s responsiveness is to be based on the contents of the bid itself without recourse to extrinsic evidence.
24.5 實質上沒有響應招標文件要求的投標將被拒絕。投標人不得通過修正或撤消不合要求的偏離或保留從而使其投標成為實質上響應的投標。
If a bid is not substantially responsive, it will be rejected and may not subsequently be made responsive by the Bidder having corrected or withdrawn the non-conforming deviation or reservation.
在商務評議時，如發(fā)現(xiàn)下列情況之一的，其投標將被拒絕：
During the economical evaluation, the bid will be rejected as non-responsiveness, if it is found having any of the following:
1）投標人未提交投標保證金或金額不足、保函有效期不足、投標保證金形式或投標保函出證銀行不符合招標文件要求的；
The bid is not accompanied with a bid security, or, in the case the submitted bid security is of less amount than required, or of shorter validity than required, or not conforming with the requirements of Bidding Documents in its form and issuing bank.
2）投標文件未按照要求逐頁簽字的；
The Bidding Documents is not initialized on each page;
3）投標人及其制造商與招標人、招標機構有利害關系的；
The bidder and his manufacturer has interest relations with the Tenderer and Tendering agent;
4）投標人的投標書或資格證明文件未提供或不符合招標文件要求的；
The Bidding Documents or qualification certifications not confirm with the tendering requirements;
5）投標文件無法定代表人簽字，或簽字人無法定代表人有效授權書的；
The bid has not been signed by the Bidder’s Legal Person, or by the person or persons with a Power of Attorney issued by the said Legal Person.
6）投標人業(yè)績不滿足招標文件要求的；
The experience of the Bidder does not meet the requirements of the Bidding Documents;
7）投標有效期不足的；
The bid validity offered by the Bidder is shorter than that stipulated in the Bidding Document; and
8）投標文件符合招標文件中規(guī)定廢標的其他商務條款。
The bids conform to other commercial clauses of bids abolition in the tendering document.
在技術評議時，如發(fā)現(xiàn)下列情況之一的，其投標將被拒絕：
During the technical evaluation, the bid will be rejected if it is found having any of the following:
1）投標文件不滿足招標文件技術規(guī)格中加注星號（“＊”）的主要參數要求或加注星號（“＊”）的主要參數無技術資料支持的。技術支持資料以制造商公開發(fā)布的印刷資料或檢測機構出具的檢測報告為準。若制造商公開發(fā)布的印刷資料與檢測機構出具的檢測報告不一致，以檢測機構出具的檢測報告為準。
The bids cannot satisfy the main parameter requirement of the specifications that annotated“＊”, or no technical support of the specifications that annotated“＊”;The technical supporting documents shall be based on the printing documents issued in public Or the checking report issued by the checking authority, if there are any difference between the two kinds, the checking report shall prevail.
2）投標文件技術規(guī)格中一般參數超出允許偏離的最大范圍或最高項數的；
The general parameter of the technical specification in the bidding document exceed the maximum range or highest items of the permitted deviation;
3）投標文件技術規(guī)格中的響應與事實不符或虛假投標的；
The responses to the technical specification in the bidding document are inconsistent with the reality or false bid;
4）投標人復制招標文件的技術規(guī)格相關部分內容作為其投標文件的一部分的；
The bidders copied some related contents of the technical specification, and take those as a part of the bid;
5）投標文件符合招標文件中規(guī)定廢標的其他技術條款。
The bids conform to other clauses of bids abolition in the bidding document.
25 轉換為單一貨幣 Conversion to Single Currency
25.1為了便于評標和比較，如果投標價中有多種貨幣，并開標當日中國人民銀行授權公布的投標貨幣對人民幣的中間價統(tǒng)一轉換成投標資料表中規(guī)定的投標貨幣。投標資料表中另有規(guī)定的除外。
To facilitate evaluation and comparison, the Tendering Agent will convert all bid prices expressed in the amounts in different currencies in which the bid prices are payable to U.S. Dollars at the selling exchange rate published by Bank of China on the date of bid opening. Except for the other stipulation in the Bid data sheet.
26 投標的評價 Evaluation and Comparison of Bids
26.1評標委員會將按照本須知第24條規(guī)定，只對確定為實質的上響應招標文件要求的投標進行評價和比較。
The Evaluation Committee will evaluate and compare the bids which have been determined to be substantially responsive, pursuant to ITB Clause 24.
26.2 計算評標總價時，以貨物到達招標人指定安裝地點為依據。境外產品為CIF價，進口環(huán)節(jié)稅及境內運輸費、保險費之和；境內產品為出廠價（含增殖稅和其他稅費）及境內運輸費、保險費之和。
The total Evaluated Bid Price (EBP) will be calculated on the basis that the goods be delivered to the designated erect site. For goods offered outside PRC, the total EBP shall be: CIF Price, plus Customs Duties, Import Taxes, and the cost of Inland Transportation and Insurance. For goods offered from within PRC, the total EBP shall be: EXW Price (including Value Added Tax and other taxes), plus the cost of Inland Transportation and Insurance.
26.3 評標委員會在評標時，除根據本須知第11.2條的規(guī)定考慮投標人的報價之外，還要按照招標文件的規(guī)定考慮量化以下因素：
The Evaluation Committee’s evaluation of a bid will take into account, in addition to the bid price quoted in accordance with ITB Clause 11.2, one or more of the following factors:
1）在中國境內所發(fā)生的內陸運輸費、保險費，及其將貨物運至最終目的地的伴隨服務費用；
Cost of inland transportation, insurance and other costs within PRC incidental to delivery of the goods to their anal destination;
2）投標文件申報的交貨期；Delivery schedule offered in the bid;
3）與合同條款規(guī)定的付款條件的偏差；
Deviations in payment schedule from that specified in the Terms and Conditions of contract;
4）所投貨物零部件、備品備件和伴隨服務的費用；
The cost of components, spare parts and services;
5）在中國境內得到投標設備的備件和售后服務的可能性；
The availability in PRC of spare parts and after-sales services for the equipment offered in
the bid;

The projected operating and maintenance costs during the life of the equipment;
7）投標設備的性能和生產率；
The performance and productivity of the equipment offered; and/or
8）備選方案及其他額外的評標因素和標準。

26.4 根據本須知第26.3條的規(guī)定，對投標資料表中選定的評標因素，可采用以下量化方法調整評標價格：
For factors retained in the Bid Data Sheet pursuant to ITB26.3, one or more of the following
quantification methods will be applied, as detailed in the Bid Data Sheet:
26.4.1在中國境內所發(fā)生的內陸運輸費、保險費及其他伴隨服務的費用.
評標委員會將按照鐵路/公路等交通部門、保險公司和/或其他有關機構發(fā)布的收費標準計算貨物從出廠地/進口港/邊境口岸運抵投標資料表所指明的項目現(xiàn)場所發(fā)生的內陸運輸、保險及其他伴隨服務的費用。為便于計算，投標人應在投標文件中提供估計的貨物尺寸、裝運重量和每個合同包的估計EXW價/CIF價/CIP價的價值。評標委員會將把上述費用加到EXW價/CIF價/CIP價上。
Cost of inland transportation, insurance, and incidentals occurred within PRC.
Inland transportation, insurance and other inddenta1 costs for delivery of the goods from EXW/ port of entry/border point to Project Site named in the Bid Data Sheet will be computed for each bid by the Evaluation Committee on the basis of published tariffs by the rail or road transport agencies, insurance companies, and/or other appropriate sources. To facilitate such computation, bidder shall furnish in its bid the estimated dimensions and shipping weight and the approximate EXW/CIF/CIP value of each package. The above costs will be added by the Evaluation Committee to EXW/CIF/CIP price.
26.4.2 投標文件申報的交貨期Delivery schedule.
1）本投標邀請項下的貨物按照貨物需求一覽表規(guī)定的時間交貨（或啟運）。以規(guī)定的時間為基礎，每超過基礎時間一周，其評標價將在投標價的基礎上增加投標資料表中規(guī)定的EXW價/CIF價/CIP價的某一百分比（%）來考慮。提前交貨不考慮降低評標價�；蛘�
The goods covered under the Invitation for Bids are required to be delivered (or shipped) at the time specifled1n the Schedule of Requirements. Taking this delivery requirements as the base, a delivery “adjustment” will be calculated-for each bid by applying a percentage, specified in the Bid Data Sheet, of the EXW/CIF/CIP price for each week of delay beyond the base, and this will be added to the bid price for evaluation. No credit shall be given to early delivery. Or

The goods covered under this invitation are required to be delivered (shipped) within an acceptable range of weeks specified in the Schedule of Requirement. No credit will be given to earlier deliveries, and bids offering delivery beyond this range will be treated as non-responsive. Within this acceptable range, an adjustment per week, as specified in the Bid Data Sheet, will be added for evaluation to the bid price of bids offering deliveries later than the earliest delivery period specified in the Schedule of Requirements. Or
3）本投標邀請項下的貨物按照貨物需求一覽表規(guī)定的分批交貨（啟運），提前交貨或者推遲交貨的投標將調整其評標價。方法是每提前或超過規(guī)定的交貨時間一周，其評標價將在投標價的基礎上減少或增加投標資料表中規(guī)定的EXW價/CIF價/CIP價的某一百分比（%）。
The goods covered under this invitation are required to be delivered (shipped) in partial shipments, as specified in the Schedu1e of Requirements. Bids offering deliveries earlier or later than the specified deliveries will be adjusted in the evaluation by decreasing from or adding to the bid price a factor equal to a percentage, specified in the Bid Data Sheet, of EXW/CIF/CIP price per week of variation from the specified delivery schedule.
26.4.3 付款條件的偏差Deviation in payment schedule.
1）投標人應按照合同條款所列的付款條件報價。評標時以此報價為基礎，但投標人可提出替代的付款計劃并說明采用該替代的付款計劃投標價可以降低多少。評標委員會可以考慮中標的投標人的替代的付款計劃�；蛘�
Bidden shall state their bid price for the payment schedule outlined in the Terms and Conditions of Contract. Bids will be evaluated on the basis of this base price. Bidders are, however, permitted to state an alternative payment schedule and indicate the reduction in bid price they wish to offer for such alternative payment schedule. The Evaluation Committee may consider the alternative payment schedule offered by the selected Bidder. Or
2）合同條款中規(guī)定了招標人提出的付款計劃。如果投標文件對此有偏離但又屬評標委員會可以接受的，評標時將按投標資料表所述的利率計算提前支付所產生的利息，并將其計入其評標中。
The Terms and Conditions of Contract stipulate the payment schedule offered by the Tenderer. If a bid deviates from the schedule and if such deviation is considered acceptable to the Tenderer, the bid will be evaluated by calculating interest earned for any earlier payments involved in the terms outlined in the bid as compared with those stipulated in this invitation, at a rate per annum as specified in the Bid Data Sheet.
26.4.4零部件和備品備件的費用 Cost of components and spare parts.
1）投標人將所投貨物的零部件及在投標資料表中規(guī)定的運行周期內必需的備品備件的名稱和數量清單附在技術規(guī)格中，按投標文件中所報的單價來計算其總價，并計入投標價中。或者
The list of items and quantities of components and selected spare parts, likely to be required during the initial period of operation specified in the Bid Data Sheet, is annexed the Technical Specif1cations. The total cost of these items, at the unit prices quoted in each bid, will be added to the bid price. Or
2）招標機構和招標人將開列經常使用的零部件和備件清單，以及在投標資料表中所規(guī)定的運行周期所需要的數量，按投標文件中所報的單價計算其總價，并計入投標價中�；蛘�
The Tendering Agent and the Tenderer will draw up a list of high-usage and high-va1ue items of components and spare parts, along with estimated quantities of usage in the initial period of operation specified in the Bid Data Sheet. The tota1cost of these items and quantities will be computed from spare pads unit prices submitted by the Bidder and added to the bid price. Or
3）招標機構和招標人將根據每一投標人提供的信息，以及招標人過去的經驗或其他購買人的經驗來估算在投標資料表中所規(guī)定的運行周期所需要的零部件和備件的費用，并計入投標.價中。
The Tendering Agent and the Tenderer will estimate the cost of spare parts usage in the initial period of operation specified in the Bid Data Sheet, based on information furnished by each Bidder, as well as on past experience of the Tendering Agent and the Tenderer or other purchasers in similar situations. Such costs shall be added to the bid price for evaluation.
26.4.5中國境內的備件供應和售后服務設施
26.4.6Spare parts and after sales service facilities in the PRC.
根據投標資料表或招標文件其他部分的規(guī)定，招標人建立最起碼的維修服務設施和零部件庫房所需的費用，評標時應計入評標價。
The cost to the Tenderer of establishing the minimum service facilities and pads inventories, as outlined in the Bid Data Sheet or elsewhere in the bidding documents, shall be added to the bid price.
26.4.7投標設備的預計運行和維護費用Operating and maintenance costs.
由于所采購的貨物的運行和維護費用是設備使用周期成本的一個主要部分，這些費用將根據投標資料表或技術規(guī)格中規(guī)定的標準進行評價。
Since the operating and maintenance costs of the goods under procurement form a major part of the life cycle cost of the equipment, these costs will be evaluated in accordance with the criteria specified in the Bid Data Sheet or in the Technical Specifications.
26.4.7投標設備的性能和生產率
Performance and productivity of the equipment.
1）投標人應響應技術規(guī)格中的規(guī)定，說明所提供的貨物保證達到的性能和效率。高于標準的，不考慮降低評標價；低于標準性能或效率的（假設為100%），每低一個百分點，投標價將增加投標資料表中規(guī)定的調整金額，采用投標資料表或技術規(guī)格中規(guī)定的方法，計算設備在使用年限中的運行成本所額外增加的費用。或
Bidders shall state the guaranteed performance or efficiency in response to the Technical Specifications. No credit shall be given to better performance and higher productivity. For each drop (of 1%) in the performance or efficiency below the norm of one hundred percent (100%), an adjustment for an amount specified in the Bid Data Sheet will be added to the bid price, representing the capitalised cost of additional operating costs over the life of the plant, using the methodology specified in the Bid Data Sheet or in the Technical Specifications. Or
2）所提供的貨物必須具備技術規(guī)格中相應條文所規(guī)定的最低性能或生產率才能被認為是具有響應性。若所提供的貨物與規(guī)定的要求有偏離時，評標將根據該貨物實際性能或生產率，采用投標資料表或技術規(guī)格中規(guī)定的方法，調整其評標價格。
Goods offered shall have a minimum productivity specified under the relevant provision in the Technical Specifications to be considered responsive. Evaluation shall be based on the cost Per unit of the actual productivity of goods offered in the bid, and adjustment will be added to the bid price using the methodology specified in the Bid Data Sheet or in the Technical Specifications.
26.4.8備選方案及其他額外的評標因素和標準
Alternative Bid and Other Additional Factor and Criteria
除非投標資料表或技術規(guī)格中另有規(guī)定，只允許投標人有一個投標方案，否則，其投標將被拒絕。如果投標資料表或技術規(guī)格中規(guī)定允許有備選方案， 投標人在投標文件中只能提供一個 備選方案并注明主選方案，且備選方案的投標價格及評標價格均不得高于主選方案。評標時僅對主選方案評議。如果投標人提供兩個以上備選方案或未注明主選方案，其投標將被拒絕。其他額外的評標因素和標準將在投標資料表和/或技術規(guī)格中詳細規(guī)定。
Unless otherwise specified, only one bid scheme of each bidder is permitted. Or, his bid will be rejected. If there are spare schemes permitted in “Bid Data Sheet” or Technical Specification, the bidder must explain the first-choose scheme. The bidder can only provide one spare scheme and state clearly the first-scheme, meanwhile the bidding price of the spare scheme shall not be higher than that of the first scheme. Only the first scheme can be evaluated during bid evaluation. The bid will be rejected if two schemes or more than two schemes are presented, or first scheme is not be stated. Other extra evaluation factors and standards will be detailed stipulated in “Bid Data Sheet” or Technical Specification.
27 最終評標價的確定Determination of Final Evaluated Bid Price
27.1根據本須知第24、25和26條所計算出的評標價應為最終評標價。
The Evaluated Bid Price calculated out in accordance with ITB Clause 24,25 and 26 shall be
treated as the final Evaluated Bid Price.
28 與招標機構和買方的接觸Contacting the Tendering Agent and the Tenderer
28.1除本須知第23.2條的規(guī)定外，從開標之日起至授予合同期間，投標人不得就與其投標有關的事項與招標機構、招標人和評標委員會接觸。
With exception for Clause 23, no Bidder shall contact the Tendering Agent, the Tenderer and the Evaluation Committee on any matter relating to its bid, from the time of the bid opening to the time the contract is awarded.
28.2 投標人試圖對招標機構、招標人和評標委員會的評標或授予合同的決定進行影響，都可能導致其投標被拒絕。
Any effort by a Bidder to influence the Tendering Agent, the Tenderer and the Committee in the Tendering Agent and the Tenderer’s decisions on bid evaluation, bid comparison, or contract award may result in the rejection of the Bidder’s bid.
