第1條 風(fēng)險(xiǎn)條款 Risks Clause

1 This insurance covers all risks of loss of or damage to the subject-matter insured except as provided in clause 4,5,6 and 7 below

本保險(xiǎn)承保除了下述第4、5、6 和7 條規(guī)定的除外責(zé)任以外的保險(xiǎn)標(biāo)的的滅失或損害的一切風(fēng)險(xiǎn)。

  

第2條 共同海損條款(General Average Clause)

2 This insurance covers general average and salvage charges, adjusted or determined according to the contract of affreightment and /or the governing law and practice, incurred to avoid or in connection with the avoidance of loss from any cause except those excluded in Clause4,5,6 and 7 or elsewhere in this insurance.

本保險(xiǎn)承保根據(jù)貨運(yùn)合同及/或管轄的法律和慣例理算或確定的，為避免或與避免任何原因造成的有關(guān)引起共同海損和救助費(fèi)用的損失，但第4，5，6和7條或本保險(xiǎn)其他條文的除外條款除外。

This insurance is extended to indemnify the Assured against such proportion of liability under the contract of affreightment “Both to Blame Collision” Clause as is in respect of a loss recoverable hereunder. In the event of any claim by shipowners under the said Clause the Assured agree to notify the Underwriters who shall have the right, at their own cost and expense, to defend the Assured against such claim.

第4條 一般除外條款(General Exclusions Clause)

4 In no case shall this insurance cover

4.1 loss damage or expense attributable to wilful misconduct of the Assured.

可歸因于被保險(xiǎn)人的故意不端行為造成的滅失、損害或費(fèi)用

 

4.2ordinary leakage, ordinary loss in weight or volume, or ordinary wear and tear of the subject-matter insured

保險(xiǎn)標(biāo)的通常的滲漏、通常重量或體積損失或通常磨損。

 

4.3loss damage or expense caused by insufficiency or unsuitability of packing or preparation of the subject-matter insured (for the purpose of this Clause 4.3 “packing” shall be deemed to include stowage in a container or lift tray but only when such stowage is carried out prior to attachment of this insurance or by the Assured or their servants)

保險(xiǎn)標(biāo)的的包裝或準(zhǔn)備不足或不當(dāng)造成的滅失、損害或費(fèi)用（在本款的意義上，“包裝”應(yīng)視為包括集裝箱或托盤內(nèi)的積載，但僅限于此種積載是在本保險(xiǎn)責(zé)任開始之前進(jìn)行或是由被保險(xiǎn)人或其雇員進(jìn)行這場(chǎng)合。）

 

4.4 loss damage or expense caused by inherent vice or nature of the subject-matter insured

保險(xiǎn)標(biāo)的的固有缺陷或性質(zhì)造成的滅失、損害或費(fèi)用。

 

4.5 loss damage or expense proximately caused by delay, even though the delay be caused by a risk insured against (except expenses payable under Clause 2 above).

遲延直接造成的滅失、損害或費(fèi)用，即便該遲延是由于某種承保風(fēng)險(xiǎn)造成的（但根據(jù)上述第2條支付的費(fèi)用除外）。

 

4.6 loss damage or expense arising from insolvency or financial default of the owners managers charterers or operators of the vessel.

因船舶所有人、管理人、承租人或經(jīng)營(yíng)人的無(wú)償付能力或財(cái)務(wù)困境引起的滅失、損害或費(fèi)用。

 

4.7 loss damage or expense arising from the use of any weapon of war employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter

因使用原子或核裂變和/或聚變或其他類似反應(yīng)或放射性力量或物質(zhì)造成的任何戰(zhàn)爭(zhēng)武器產(chǎn)生的滅失、損害或費(fèi)用。

  

第5條不適航和不適運(yùn)除外條款 (Unseaworthines and Unfitness Exclusion Clause)

5.1 In no case shall this insurance cover loss damage or expense arising from

unseaworthness of vessel or craft, unfitness of vessel craft conveyance container or lifivan for the safe carriage of the subject-matter insured, where the Assured or their servants are privy to such unseaworthiness or unfitness, at the time the subject-matter insured is loaded therein.

本保險(xiǎn)在任何情況下均不承保因下述原因所致的滅失、損害或費(fèi)用：  船舶或駁船不適航，

船舶、駁船、運(yùn)輸工具、集裝箱和托盤對(duì)安全運(yùn)輸保險(xiǎn)標(biāo)的不適合，在保險(xiǎn)標(biāo)的被裝上船當(dāng)時(shí)，被保險(xiǎn)人或其雇員對(duì)此種不適航或不適合有私謀。

 

5.2 The Underwriters waive any breach of the implied warranties of seaworthiness of the ship and fitness of the ship to carry the subject-matter insured to destination, unless the Assured or their servants are privy to such unseaworthiness or unfitness.

保險(xiǎn)人放棄運(yùn)載保險(xiǎn)標(biāo)的至目的港的船舶不得違反船舶適航和適運(yùn)的任何默示保證，除非被保險(xiǎn)人或其雇員對(duì)此種不適航或不適運(yùn)有私謀。

 

第6條 戰(zhàn)爭(zhēng)除外條款 (War Exclusion Clause)

6 In no case shall this insurance cover loss damage or expense caused by

6.1 war civil war revolution rebellion insurrection, or civil strife arising therefrom, or any hostile act by or against a belligerent power

戰(zhàn)爭(zhēng)、內(nèi)戰(zhàn)、革命、叛亂、暴動(dòng)，或由此引起的民間沖突(civil strife)，或來(lái)自交戰(zhàn)方或針對(duì)交戰(zhàn)方的任何敵對(duì)行為。

 

6.2 capture seizure arrest restraint or detainment (piracy excepted), and the consequences thereof or any attempt thereat

捕獲、扣押、扣留、拘留或羈押（海盜除外），及由此引起的后果或企圖這么做的任何威脅。

 

6.3 derelict mines torpedoes bombs or other derelict weapons of war.

丟棄的水雷、魚雷、炸彈或其他被遺棄的戰(zhàn)爭(zhēng)武器。

  

第7條 罷工除外條款(Strikes Exclusion Clause)

7 In no case shall this insurance cover loss damage or expense(

7.1 caused by strikers, locked-out workmen, or persons taking part in labour disturbances, riots or civil commotions

由罷工、被迫停工工人或參加工潮、暴亂（riots）民事騷亂（civil commotions）的人員造成者

 

7.2 resulting from strikes, lock-outs, labour disturbances, riots or civil commotions

罷工、停工、工潮、暴亂或民事騷亂引起者

 

7.3 caused by any terrorist or any person acting from a political motive.

第8條 運(yùn)輸條款(Transit Clause)

8.1 This insurance attaches from the time the goods leave the warehouse or place of storage at the place named herein for the commencement of the transit, continues during the ordinary course of transit and terminates either

8.1 本保險(xiǎn)責(zé)任始于貨物運(yùn)離保險(xiǎn)單載明的倉(cāng)庫(kù)或貯存處所開始運(yùn)送之時(shí)，在運(yùn)送的通常過程期間持續(xù)，終止于

 

8.1.1 on delivery to the Consignees’ or other final warehouse or place of storage at the destination named herein,

8.1.2 on delivery to any other warehouse or place of storage, whether prior to or at the destination named herein, which the Assured elect to use either

8.1.2.1 for storage other than in the ordinary course of transit or

8.1.3 on the expiry of 60 days after completion of discharge overside of the goods hereby insured from the oversea vessel at the final port of discharge, whichever shall first occur.

8.2  if, after discharge overside from the oversea vessel at the final port of discharge, but prior to termination of this insurance, the goods are to be forwarded to a destination other than that to which they are insured hereunder, this insurance, whilst remaining subject to termination as provided for above, shall not extend beyond the commencement of transit to such other destination.

8.2 如果在最后卸貨港卸離來(lái)自海外的船舶后，但在本保險(xiǎn)終止之前，貨物被轉(zhuǎn)運(yùn)至非保險(xiǎn)承保的其他目的地，本保險(xiǎn)在依然受前述規(guī)定的終止制約的同時(shí)，截止于開始向此種其他目的地運(yùn)送之時(shí)。

 

8.3 This insurance shall remain in force (subject to termination as provided for above and to the provisions of Clause 9 below) during delay beyond the control of the Assured, any deviation, forced discharge, reshipment or transhipment and during any variation of the adventure arising from the exercise of a liberty granted to shipowners or charterers under the contract of affreightment.

8.3 在被保險(xiǎn)人不能控制的遲延任何繞航、強(qiáng)制卸貨、重裝或轉(zhuǎn)運(yùn)期間，以及船東或承租人行使根據(jù)貨運(yùn)合同賦予的自由權(quán)引起的海上冒險(xiǎn)的任何變更期間，本保險(xiǎn)仍然有效（但須受上述規(guī)定的終止和下述第9條規(guī)定的制約）。

  

第9條 運(yùn)輸合同終止條款(Termination of Contract of Carriage Clause)

9 If owing to circumstances beyond the control of the Assured either the contract of carriage is terminated at a port or place other than the destination named therein or the transit is otherwise terminated before delivery of the goods as provided for in Clause 8 above, then this insurance shall also terminate unless prompt notice is given to the Underwriters and continuation of cover is requested when the insurance shall remain in force, subject to an additional premium if required by the Underwriters, either

9如果由于被保險(xiǎn)人不能控制的情況，運(yùn)輸合同在保險(xiǎn)單載明的目的地以外的港口或地點(diǎn)終止，或運(yùn)送在上述第8條規(guī)定的交付貨物前另行終止，那么本保險(xiǎn)也終止，除非迅速地通知了保險(xiǎn)人且在本保險(xiǎn)仍有效時(shí)要求繼續(xù)承保，并受保險(xiǎn)人要求的附加保險(xiǎn)費(fèi)的制約：

 

9.1 until the goods are sold and delivered at such port or place, or unless otherwise specially agreed, until the expiry of 60 days after arrival of the goods hereby insured at such port or place, whichever shall first occur, or

9.2 if the goods are forwarded within the said period of 60days (or any agreed extension thereof)to the destination named herein or to any other destination, until terminated in accordance with the provisions of Clause 8 above.

第10條 航程變更條款(Change of Voyage Clause)

10Where, after attachment of this insurance, the destination is changed by the Assured, held covered at a premium and on conditions to be arranged subject to prompt notice being given to the Underwriters.

10如果在本保險(xiǎn)責(zé)任開始后，被保險(xiǎn)人變更目的地，應(yīng)按重新商定的保險(xiǎn)費(fèi)率和條件續(xù)保(held covered)，但以迅速通知了保險(xiǎn)人為前提。

  

第11條 保險(xiǎn)利益條款(Insurable Interest Clause)

1111.1In order to recover under this insurance the Assured must have an insurable interest in the subject-matter insured at the time of the loss.

11.1 為了根據(jù)本保險(xiǎn)索賠，在保險(xiǎn)標(biāo)的損失當(dāng)時(shí)被保險(xiǎn)人必須具有某種可保利益。

 

11.2 Subject to 11.1 above, the Assured shall be entitled to recover for insured loss occurring during the period covered by this insurance, notwithstanding that the loss occurred before the contract of insurance was concluded, unless the Assured were aware of the loss and the Underwriters were not.

11.2 根據(jù)上述11.1款，被保險(xiǎn)人有權(quán)索賠在本保險(xiǎn)承保期間發(fā)生的承保損失，盡管該滅失發(fā)生于本保險(xiǎn)合同成立之前，除非被保險(xiǎn)人已知悉該滅失，而保險(xiǎn)人不知情。

  

第12條續(xù)運(yùn)費(fèi)用條款(Forwarding Charges Clause)

12 Where, as a result of the operation of a risk covered by this insurance, the insured transit is terminated at a port or place other than that to which the subject-matter is covered under this insurance, the Underwriters will reimburse the Assured for any extra charges properly and reasonably incurred in unloading storing and forwarding the subject-matter to the destination to which it is insured hereunder.

This Clause 12, which does not apply to general average or salvage charges, shall be subject to the exclusions contained in Clause 4,5,6 and 7 above, and shall not include charges arising from the fault negligence insolvency or financial default of the Assured or their servants.

12 若由于本保險(xiǎn)承保的風(fēng)險(xiǎn)的作用，導(dǎo)致承保的運(yùn)輸在保險(xiǎn)標(biāo)的根據(jù)本保險(xiǎn)承保的目的地以外的港口或地點(diǎn)終止，保險(xiǎn)人將補(bǔ)償被保險(xiǎn)人因卸下、貯存和續(xù)運(yùn)保險(xiǎn)標(biāo)的至所承保的目的地而適當(dāng)和合理發(fā)生的額外費(fèi)用。

對(duì)共同海損和救助費(fèi)用不適用的本條規(guī)定，須受上述第4、5、6和7條所包含的除外責(zé)任的制約，且不包括因被保險(xiǎn)人或其雇員的過錯(cuò)、疏忽、無(wú)償付能力或財(cái)務(wù)困境而引起的費(fèi)用。

     

第13條 推定全損條款(Constructive Total Loss Clause)

13No claim for Constructive Total Loss shall be recoverable hereunder unless the subject-matter insured is reasonably abandoned either on account of its actual total loss appearing to be unavoidable or because the cost of recovering, reconditioning and forwarding the subject-matter to the destination to which it is insured would exceed its value on arrival.

13 除非由于實(shí)際全損看來(lái)不可避免，或因?yàn)榛謴?fù)、修復(fù)和續(xù)運(yùn)保險(xiǎn)標(biāo)的至承保的目的地的費(fèi)用，將超過其抵達(dá)時(shí)的價(jià)值，而合理地委付保險(xiǎn)標(biāo)的，推定全損索賠不能獲得賠償。

  

第14條 增值條款(Increased Value Clause)

14.1 If any Increased Value insurance is effected by the Assured on the cargo insured herein the agreed value of the cargo shall be deemed to be increased to the total amount insured under this insurance and all Increased Value insurance covering the loss, and liability under this insurance shall be in such proportion as the sum insured herein bears to such total amount insured.

In the event of claim the Assured shall provide the Underwriters with evidence of the amounts insured under all other insurance.

14.1 如果被保險(xiǎn)人對(duì)保險(xiǎn)貨物辦理了增值保險(xiǎn)，貨物的約定價(jià)值應(yīng)視為增加至本保險(xiǎn)和承保滅失的所有增值保險(xiǎn)的保險(xiǎn)金額的總和，本保險(xiǎn)項(xiàng)下的責(zé)任應(yīng)按承保金額占此種保險(xiǎn)金額的總和的比例計(jì)算。

14.2 Where this insurance is on Increased Value the following clause shall apply:

The agreed value of the cargo shall be deemed to be equal to the total amount insured under the primary insurance and all Increased Value insurance covering the loss and effected on the cargo by the Assured,and liability under this insurance shall be in such proportion as the sum insured herein bears to such total amount insured.

In the event of claim the Assured shall provide the Underwriters with evidence of the amounts insured under all other insurance.

14.2 在本保險(xiǎn)是增值保險(xiǎn)的情況下，應(yīng)適用下述條款：貨物的約定價(jià)值應(yīng)視為等于由被保險(xiǎn)人對(duì)貨物辦理的原始保險(xiǎn)和承保滅失的所有增值保險(xiǎn)的保險(xiǎn)金額的總和，本保險(xiǎn)項(xiàng)下的責(zé)任應(yīng)按承保金額占此種保險(xiǎn)金額的總和的比例計(jì)算。

第15條 不生效條款（Not to Inure Clause）

15This Insurance shall not inure to the benefit of the carrier or other bailee.

承運(yùn)人或其他保管人不得主張本保險(xiǎn)的利益。

  

第16條 被保險(xiǎn)人的義務(wù)條款(Duty of the Assured Clause)

16It is the duty of the Assured and their servants and agents in respect of loss recoverable hereunder

16有關(guān)可索賠的損失，被保險(xiǎn)人及其雇員和代理人有下述義務(wù)：

 

16.1 to take such measures as may be reasonable for the purpose of averting or minimising such loss, and

16.1 采取為避免或盡量減少此種損失的全理措施，并

 

16.2 to ensure that all rights against carriers, bailees or other third parties are properly preserved and exercised

16.2 確保對(duì)承運(yùn)人、保管人或其他第三方追償?shù)乃�有�?quán)利被適當(dāng)保留和行使。

  

第17條 棄權(quán)條款(Waiver Clause)

17 Measures taken by the Assured or the Underwriters with the object of saving, protecting or recovering the subject-matter insured shall not be considered as a waiver or acceptance of abandonment or otherwise prejudice the rights of either party .

被保險(xiǎn)人或保險(xiǎn)人采取的旨在撈救、保護(hù)或恢復(fù)保險(xiǎn)標(biāo)的的措施不得視為放棄或接受委付或在其他方面損害任何一方的權(quán)利。

  

第18條 合理速辦(Reasonable Dispatch Clause)

18 It is a condition of this insurance that the Assured shall act with reasonable despatch in all circumstances within their control.

被保險(xiǎn)人應(yīng)在所有其控制的情況下合理迅速地行動(dòng)是本保險(xiǎn)的一項(xiàng)條件。

  

第19條 英國(guó)法律與慣例條款（English Law and Practice Clause）

19 This insurance is subject to English law and practice.

本保險(xiǎn)受英國(guó)法律與慣例制約。
