LABOR CONTRACT OF SAILOR

甲方：（以下簡(jiǎn)稱甲方） party A： (hereinafter called as party A)
 
乙方：（以下簡(jiǎn)稱乙方） party B:  (hereinafter called as party B)
 
甲乙雙方本著平等，自愿的原則，簽訂本合同，雙方同意并承諾共同遵守以下合同條款：
In accordance with the principle of equality and voluntary party A and party B make and enter into this contract, agree and promise to be in common compliance with the terms and conditions hereunder.
 
一、工作內(nèi)容和合同期限  JOB DUTY AND TERM
1.甲方根據(jù)工作需要安排船員乙方到所屬      輪 擔(dān)任     職務(wù) ，合同期限為    個(gè)月，自上船之日起計(jì)算。合同期滿，雙方未辦理合同終止或者續(xù)訂手續(xù)的，視為本合同自動(dòng)延續(xù)，任何一方都有權(quán)利通知對(duì)方終止合同。但合同屆滿時(shí)或延續(xù)期間，如船舶在國(guó)外或者航行中或者不方便離船的港口，則合同自動(dòng)延續(xù)至船舶到達(dá)可離船的港口之日為止。
Party B (sailor) shall be appointed by party A ,pursuant to necessity of work, to assume the job of     vessel with the term of contract of     month which be calculated from the boarding day. If and when the expiration of contract parties hereto fail to make termination or renewal of contract, shall be deemed as automatic extension of contract. But however, where expiration or renewal of contract the vessel is abroad, or sailing, or at the port at which inconvenient to left vessel, the expiration of contract shall be automatically extend to the date on which vessel arrive and sailor can left away.
 
2乙方因傷病并經(jīng)醫(yī)生證明，或者由于不可抗力原因，造成乙方不能繼續(xù)在船工作的，合同自行終止。合同有效期內(nèi)，如發(fā)生賣船，更換船東等，甲方可以提前終止合同，乙方的遣返費(fèi)由甲方負(fù)擔(dān)。
If and when party B can not continue to work on board for the cause of injury or illness, or force majeure, contract shall be automatically terminated. Party A can , within the period of contract validity, in case of selling boat or replacing of ship owner, effect advance termination of contract and bear all costs and charges for party B’s repatriation.
 
3.乙方在合同期內(nèi)如遇配偶或者親屬舉喪之事，在征得甲方同意后可以安排下船。乙方因?yàn)閭�(gè)人原因，無(wú)正當(dāng)理由下船的，其下船的船差費(fèi)，代理費(fèi)等由乙方自負(fù)。由此造成甲方損失及更換船員費(fèi)用增加的，乙方負(fù)責(zé)賠償。
Party B can, within the validity period of contract get off boat prior to the consent of party A, in case of the death of spouse or relatives. However party B get off boat for himself matter or non-reasonable excuse, shall undertake to pay for travel fee and agent fee and other costs, in addition to compensate the loss and cost of change sailor incurred by party A arising from or related to party B’s leave.
 
二．工資福利待遇 SALARY AND WELFARE
1.乙方在船工作期間，月工資標(biāo)準(zhǔn)是     美元（包括基薪、固定加班費(fèi)、養(yǎng)老保險(xiǎn)、醫(yī)療保險(xiǎn)、工傷保險(xiǎn)和生育保險(xiǎn)）。乙方按照甲方的規(guī)定領(lǐng)取外派工資和相關(guān)津貼，甲方按照國(guó)家規(guī)定的繳費(fèi)基數(shù)，即平均工資的三倍繳納養(yǎng)老保險(xiǎn)、醫(yī)療保、失業(yè)保險(xiǎn)、工傷保險(xiǎn)以及生育保險(xiǎn)。如不滿一個(gè)月，按照實(shí)際天數(shù)/當(dāng)月天數(shù)×月工資計(jì)算，上下船工資結(jié)算時(shí)間為上船當(dāng)日起至下船前一日止（以交接單日期為準(zhǔn)）。
In the period of work on board, the month salary of party B would be     US Dollar which include base salary and insurances of firm overtime pay, endowment as well as medical treatment, labor injury and maternity. Party B shall, subject to the provisions of party A, receive his salary of assignment and related welfare, and party A shall, in accordance with the stipulations of state on the basic payment， viz. three times the mount of average salary, effect payment of endowment as well as medical treatment, labor injury and maternity. If and where fall short of one month, the salary would be calculated on virtual dates / the date of this month ×month salary. The time of salary settlement for on/off boat is from the date of on-boat to the former date of off-boat subject to the date of Bill of Handover.
 
2.甲方根據(jù)乙方提供的詳細(xì)匯款賬號(hào)，每月以銀行匯款方式于15日—20日之間結(jié)清上月工資，下船工資的結(jié)算為收到正常下船交接清單后一并結(jié)清。
Party A should, subject to the specific bank account provided by party B, by bank transfer in the period of 15th to 20th each month, effect the payment of last month salary of party B. The salary of party B’s off-boat would be settled when receiving the Bill of Handover.
 
3.甲方提供乙方在船生活費(fèi)為每日4.0美金以及在船期間相應(yīng)勞動(dòng)保護(hù)補(bǔ)助及醫(yī)療補(bǔ)助。
Party A shall offer party B with living cost 4 US Dollars one day on board and subsidies of labor protection as well as medicine.
 
4.乙方正常上下船的費(fèi)用由甲方承擔(dān)，但乙方必須按照甲方的規(guī)定的標(biāo)準(zhǔn)執(zhí)行，超出部分非特殊情況下甲方不予承擔(dān)，未完成合同提前下船的差費(fèi)乙方承擔(dān)。
The fees and costs of party B’s on/off boat shall, subject to the standard stipulated by party A, be born by party A, provided always that non-excess of such amount, except special circumstances, shall be paied by party A and in the event that party B get advance off boat without fulfill and complete the duty of contract, shall bear his travel  fee.
 
5.合同期內(nèi)，甲方根據(jù)保賠協(xié)會(huì)條款或者保險(xiǎn)公司條款為乙方提供涉及死亡、受傷、生病等意外的保險(xiǎn)，但以下情況除外：
Party A should, throughout of the life of the contract pursuant to the terms and conditions of Protection and Indemnity Club, as well as Insurer, provided party B with insurances related death, injury and illness, but except that:
 
（1）并非在船上是發(fā)生的受傷，死亡； injury or death not happened on board;
 
（2）受傷或者患病是由于乙方的故意行為，違章，酗酒或者不正當(dāng)舉止所致;
 injury or illness caused by intentional action，alcohol abuse or other misconducts of party B;
 
（3）簽訂合同時(shí)故意隱瞞疾病等;
Hide the truth of his illness at the time of signature of contract;
 
6.乙方在工作期間享受甲方的各項(xiàng)獎(jiǎng)勵(lì)，自修費(fèi)，勞務(wù)費(fèi)等分配。
Party B is entitle to enjoy rewards of the respective kinds, self-study fee and labor remuneration and the like provided from party A.
 
三、雙方的權(quán)利和義務(wù) THE RIGHTS AND LIABILITIES OF PARTIES HERETO
 
1.乙方應(yīng)保證身體健康，保證持有主管機(jī)關(guān)簽發(fā)的有效的船員服務(wù)證，基本安全培訓(xùn)合格證，海員證，職務(wù)證書(shū)以及公約要求的其他技術(shù)證書(shū)。根據(jù)需要乙方應(yīng)接受甲方的培訓(xùn)。
Party B should be healthy and hold the effective certificates issued by the competent authorities include Crew Service Card, Safety Training Certificate, Seamen Certificate, Post Certificate and other technical certificates required by international conventions. Party B should, where required, take part in the training made by party A.
 
   2.甲方負(fù)責(zé)為乙方辦理護(hù)照及出境手續(xù)，正常情況下所發(fā)生的費(fèi)用由乙方自負(fù)，在船工作滿      個(gè)月之后,費(fèi)用酌情報(bào)銷。
Party A should effect the passport and exit formalities for party B, in normal circumstances with all the expense of party B. Such expenses could be, as appropriate, applied for reimbursement on the date of sequent     months of working on boat.
 
3.根據(jù)配員要求，乙方需要值班的，船長(zhǎng)要求必須會(huì)操作使用船上的通導(dǎo)設(shè)備。
Party B should, if being on duty required to by master pursuant to the requirement of manning, be competent to operate the communication equipments on ship.
 
4.乙方在合同期內(nèi)，應(yīng)忠于職守，遵紀(jì)守法，盡職盡責(zé)，如有下列行為者，甲方有權(quán)終止合同，乙方除自行承擔(dān)后果外，對(duì)甲方造成的損失應(yīng)負(fù)賠償責(zé)任，甲方亦有權(quán)根據(jù)乙方行為后果的嚴(yán)重程度給予相應(yīng)的經(jīng)濟(jì)處罰：
Party B should, during the term of contract, be faithful in discharge of his duties, abide by discipline and law, fulfill his responsibility. Where and if party B do the following actions party A is entitle to terminate this contract. Party B should make compensation to party A for the damage and loss incurred arising therefrom in addition to undertake the consequence on his own account, and party A have rights to, accordance with the severity of consequence of party B’s action, make economic punishment on party B.
 
（1）乙方工作失職，給船舶安全性或者正常航行造成危險(xiǎn)或者損失的;
Party B’s breach of duty cause danger or loss to the safety or ordinary navigation of ship;
 
（2）乙方不遵守甲方的管理制度或者不服從公司管理的;
Party B break company rules or management regulations;
 
（3）乙方漏船或者擅自離船的;
Party B fail to be on ship for duty or leave ship without permission;
 
（4）乙方參與盜竊，走私，偷渡，販毒，色情等違法活動(dòng)的;
Where party B join illegal activities such as steal, smuggle, stowaway, drug trafficking and eroticism and so on;
 
（5）乙方不遵守所在港國(guó)家法令等被追究責(zé)任并給甲方造成損失的；
Party B is investigated for violation of state’s law and decree of the country of local port and cause the loss to party A resulting therefrom;
 
（6）乙方私自與及其他國(guó)際公會(huì)組織接觸的;
Party B contact with other international associations at his own initiative;
 
（7）其他嚴(yán)重違法違紀(jì)情形;  Other serious  illegal acts
 
四、違約責(zé)任 DEFAULT RESPONSIBILITIES
合同履行期間任何一方違約將導(dǎo)致合同終止，違約方應(yīng)向?qū)Ψ街Ц逗贤�期�?nèi)月工資總額的10%的違約金 。
The breach of any party in the period of contract shall bring on the termination of contract, the breach party should make payment of liquidate damages which equal to 10% month salary within the time of contract to opposite party.
 
五、爭(zhēng)議解決 DISPUTE RESOLUTION
合同履行期間內(nèi)，雙方如有爭(zhēng)議，應(yīng)協(xié)商解決，如協(xié)商不成，雙方同意由甲方所在地的法院解決。
Any dispute between parties in the performance of contract should be settled by amicable consultation, if fail to settle by consultation, shall be submitted to the competent court at the place of party A.
 
六、簽約生效 SIGNATURE AND VALIDITY
本合同雙方共同簽訂于    , 本合同一式兩份，甲乙各執(zhí)一份，合同自簽訂之日起生效。
This contract is signed  by parties on     , and made duplicated with one copy for each party, become effective from the date of signature.
