一、責(zé)任范圍Ⅰ. Scope of Cover
本保險(xiǎn)分為冷藏險(xiǎn)和冷藏一切險(xiǎn)二種。被保險(xiǎn)貨物遭受損失時(shí)，本保險(xiǎn)按照保險(xiǎn)單上訂明承保險(xiǎn)別的條款規(guī)定，負(fù)賠償責(zé)任。
This insurance is classified into Risks for Frozen Products and All Risks for Frozen Products and shall be liable for loss of or damage to the insured goods according to the conditions of the risks covered under the Policy.
（一）冷藏險(xiǎn)1. Risks for Frozen Products:
本保險(xiǎn)負(fù)責(zé)賠償：
1.被保險(xiǎn)貨物在運(yùn)輸途中由于惡劣氣候、雷電、海嘯、地震、洪水自然災(zāi)害或由于運(yùn)輸工具遭受擱淺、觸礁、沉沒(méi)、互撞、與流冰或其他物體碰撞以及失火、爆炸意外事故或由于冷藏機(jī)器停止工作連續(xù)達(dá)二十四小時(shí)以上所造成的腐敗或損失。
Deterioration or loss of or damage to the insured goods caused in the course of transit by natural calamities-heavy weather, lightning, tsunami, earthquake, flood or by accidents-grounding, stranding, sinking or collision of the carrying conveyance or contact with floating ice or other substance or fire or explosion or stoppage of refrigerating machinery for more than 24 consecutive hours.
2.在裝卸或轉(zhuǎn)運(yùn)時(shí)由于一件或數(shù)件整件貨物落海所造成的全部或部分損失。
Partial or total loss arising from the falling of entire package or packages into sea during loading, unloading or transhipment.
3.被保險(xiǎn)人對(duì)遭受承保責(zé)任內(nèi)危險(xiǎn)的貨物采取搶救、防止或減少貨損的措施而支付的合理費(fèi)用，但以不超過(guò)該批被救貨物的保險(xiǎn)金額為限。
Reasonable cost incurred by the Insured in salvaging the goods or averting or minimizing a loss recoverable under this insurance, provided that such cost shall not exceed the sum insured of the goods so saved.
4.運(yùn)輸工具遭遇海難后，在避難港由于卸貨所引起的損失以及在中途港、避難港由于卸貨、存?zhèn)}以及運(yùn)送貨物所產(chǎn)生的特別費(fèi)用。
Losses attributable to discharge of the insured goods at the port of distress following a sea peril as well as special charges arising from loading, warehousing and forwarding of the goods at an intermediate port of call or refuge.
5.共同海損的犧牲、分?jǐn)偤途戎M(fèi)用。
Sacrifice in and contribution to General Average and Salvage Charges.
6.運(yùn)輸契約訂有“船舶互撞責(zé)任”條款，根據(jù)該條款規(guī)定應(yīng)由貨方償還船方的損失。
Such proportion of losses sustained by the shipowners as is to be reimbursed by the cargo owners under the Contract of Affreightment “Both to Blame Collision” Clause.
（二）冷藏一切險(xiǎn)All Risks for Frozen Products:
除包括上列冷藏險(xiǎn)的各項(xiàng)責(zé)任外，本保險(xiǎn)還負(fù)責(zé)被保險(xiǎn)貨物在運(yùn)輸途中由于外來(lái)原因所致的腐敗或損失。
Aside from the risks covered under the aforesaid Risks for Frozen Products, this insurance also covers deterioration or loss of or damage to the insured goods arising from external causes in the course of transit.
二、除外責(zé)任Ⅱ. Exclusions
本保險(xiǎn)對(duì)下列損失，不負(fù)賠償責(zé)任：This Insurance does not cover:
（一）被保險(xiǎn)人的故意行為或過(guò)失所造成的損失。
Loss or damage caused by the intentional act or fault of the Insured.
（二）屬于發(fā)貨人責(zé)任所引起的損失。
Loss or damage falling under the liability of the consignor.
（三）被保險(xiǎn)貨物在運(yùn)輸過(guò)程中的任何階段因未存放在有冷藏設(shè)備的倉(cāng)庫(kù)或運(yùn)輸工具中，或輔助運(yùn)輸工具沒(méi)有隔溫設(shè)備所造成的貨物腐敗。
Deterioration of the insured goods caused by the failure in any stage of transit to store or stow the said goods in warehouse or in the carrying conveyance provided with refrigeration installation or in insulated space in conveyance.
（四）被保險(xiǎn)貨物在保險(xiǎn)責(zé)任開始時(shí)因未保持良好狀態(tài)，包括整理加工和包扎不妥，冷凍上的不合規(guī)定及骨頭變質(zhì)所引起的貨物腐敗和損失。
Deterioration or loss of or damage to the insured goods arising from failure to keep the goods in good condition, including improper dressing and wrapping and/or packing, failure to comply with the freezing standard and bone taint at the time of commencement of this insurance.
（五）被保險(xiǎn)貨物的自然損耗、本質(zhì)缺陷、特性及市價(jià)跌落、運(yùn)輸延遲所引起的損失和費(fèi)用。
Loss or damage arising from normal loss, inherent vice or nature of the insured goods, loss of market and/or delay in transit and any expense arising therefrom.
（六）本公司海洋運(yùn)輸貨物戰(zhàn)爭(zhēng)險(xiǎn)條款和貨物運(yùn)輸罷工險(xiǎn)條款規(guī)定的責(zé)任范圍和除外責(zé)任。
6. Risks and liabilities covered and excluded by the Ocean Marine Cargo War Risks Clauses and Strikes, Riot and Civil Commotion Clauses of this Company.
三、責(zé)任起訖C(jī)ommencement and Termination of Cover
（一）本保險(xiǎn)責(zé)任自被保險(xiǎn)貨物運(yùn)離保險(xiǎn)單所載起運(yùn)點(diǎn)的冷藏倉(cāng)庫(kù)裝入運(yùn)送工具開始運(yùn)輸時(shí)生效，包括正常運(yùn)輸過(guò)程中的海上、陸上、內(nèi)河和駁船運(yùn)輸在內(nèi)，直到該項(xiàng)貨物到達(dá)保險(xiǎn)單所載明的最后卸載港三十天內(nèi)卸離海輪，并將貨物存入岸上冷藏庫(kù)后繼續(xù)有效。但以貨物全部卸離海輪時(shí)起算滿十天為限。在上述期限內(nèi)貨物一經(jīng)移出冷藏倉(cāng)庫(kù)，則責(zé)任即行終止，如卸離海輪后不存入冷藏倉(cāng)庫(kù)，則至卸離海輪時(shí)終止。
This Insurance attaches from the time the goods hereby insured leave the cold stores at the place of shipment named in the Policy and are loaded onto the conveyance for the commencement of transit, including sea, land and inland water transit and transit in lighter, until the expiry of ten （10） days upon completion of discharge of the goods the seagoing vessel and delivery thereof to the cold stores at the final port of destination. It is warranted, however, that the discharge, from the seagoing vessel must be completed within thirty （30） days after their arrival at the port of discharge; that liability under this insurance shall cease to attach once the insured goods are moved out of the cold stores within the aforesaid period; and that if the goods are not delivered to the cold stores after discharge from the seagoing vessel the insurance shall terminate immediately upon such discharge.
（二）由于被保險(xiǎn)人無(wú)法控制的運(yùn)輸延遲、繞道、被迫卸貨、重行裝載、轉(zhuǎn)載或承運(yùn)人運(yùn)用運(yùn)輸契約賦予的權(quán)限所作的任何航海上的變更或終止運(yùn)輸契約，致使被保險(xiǎn)貨物運(yùn)到非保險(xiǎn)單所載明目的地時(shí)，在被保險(xiǎn)人及時(shí)將獲知的情況通知保險(xiǎn)人，并在必要時(shí)加繳保險(xiǎn)費(fèi)的情況下，本保險(xiǎn)仍繼續(xù)有效。保險(xiǎn)責(zé)任按下列規(guī)定終止：
If, owing to delay, deviation, forced discharge, reshipment or transhipment beyond the control of the Insured or any change or termination of the voyage arising from the exercise of a liberty granted to the shipowners under the contract of affreightment the insured goods arrive at a port or place other than that named in the Policy, subject to immediate notice being given to the company by the Insured and an additional premium being paid, if required, this insurance shall remain in force and shall terminate as hereunder:
1.在貨物到達(dá)卸載港三十天內(nèi)卸離海輪并將貨物存入岸上冷藏倉(cāng)庫(kù)后繼續(xù)有效，但以貨物全部卸離海輪后時(shí)起算滿十天終止。在上述期限內(nèi)，被保險(xiǎn)貨物如在非保險(xiǎn)單所載明目的地出售，保險(xiǎn)責(zé)任至交貨時(shí)為止。
The Insurance shall terminate upon the expiry of the （10） days after completion of discharge from the seagoing vessel at the port of discharge and delivery to the cold stores on shore, it being warranted, however, that the discharge must be completed within thirty （30） days after the ship's arrival. Within the aforesaid period if insured goods are sold at a port or place of destination not named in the policy, then this insurance shall terminate when they are deliveried at such port or place.
2.被保險(xiǎn)貨物如在上述十天期限內(nèi)繼續(xù)運(yùn)往保險(xiǎn)單所載原目的地或其他目的地時(shí)，保險(xiǎn)責(zé)任仍按上述第（一）款的規(guī)定終止。
If the insured goods are to be forwarded to the final destination named in the Policy or to any other destination within the aforesaid period of ten （10） days, this insurance shall terminate in accordance with Section I above.
四、被保險(xiǎn)人的義務(wù)Duty of the Insured
被保險(xiǎn)人應(yīng)按照以下規(guī)定的應(yīng)盡義務(wù)辦理有關(guān)事項(xiàng)，如因未履行規(guī)定的應(yīng)盡義務(wù)而影響本公司利益時(shí)，本公司對(duì)有關(guān)損失有權(quán)拒絕賠償。
It is the duty of the Insured to attend to all matters as specified hereunder, failing which the Company reserve the right to reject his claim for any loss or damage if and when such failure prejudices the interest of the Company.
（一）當(dāng)被保險(xiǎn)貨物運(yùn)抵保險(xiǎn)單所載目的港以后，被保險(xiǎn)人應(yīng)及時(shí)提貨。當(dāng)發(fā)現(xiàn)被保險(xiǎn)貨物任何部分有腐敗或損失，應(yīng)立即向保險(xiǎn)單上所載明的檢驗(yàn)、理賠代理人申請(qǐng)檢驗(yàn)，由其在本保險(xiǎn)責(zé)任終止前確定腐敗件數(shù)或損失程度。如發(fā)現(xiàn)被保險(xiǎn)貨物整件短少或有明顯殘損痕跡應(yīng)即向承運(yùn)人、受托人或有關(guān)當(dāng)局（海關(guān)、港務(wù)當(dāng)局等）索取貨損貨差證明。如果貨損貨差是由于承運(yùn)人、受托人或其他有關(guān)方面的責(zé)任所造成，應(yīng)以書面方式向他們提出索賠，必要時(shí)還須取得延長(zhǎng)時(shí)效的認(rèn)證。
The Insured shall take delivery of the insured goods in good time upon their arrival at the port of destination named in the Policy. In case of discovery of any deterioration or loss of or damage to any part of the insured goods, immediate notice should be given to the surveying and claim settling agent named in the Policy to conduct survey and ascertain the quantity deteriorated or the extent of damage before termination of this insurance. If the insured goods are found short in entire package or packages or to show apparent traces of damage, the Insured shall obtain from the carrier, bailee or other relevant authorities （Customs and Port Authorities etc.） certificate of loss or damage and/or shortlanded memo. Should the carrier, bailee or the other relevant authorities be responsible for such shortage or damage, the Insured shall lodge a claim with them in writing and, if necessary, obtain their confirmation of an extension of the time limit of validity of such claim.
（二）對(duì)遭受承保責(zé)任內(nèi)危險(xiǎn)的貨物，應(yīng)迅速采取合理的搶救措施，防止或減少貨物的損失。被保險(xiǎn)人采取此項(xiàng)措施，不應(yīng)視為放棄委付的表示，本公司采取此項(xiàng)措施，也不得視為接受委付的表示。
The Insured shall take reasonable measures immediately in salvaging the insured goods when they sustain damage hereunder and in preventing or minimizing the loss. The measures so taken by the Insured shall not be considered as a waiver of abandonment, nor shall they be considered as an acceptance of abandonment in the event that they are taken by the Company.
（三）如遇航程變更或發(fā)現(xiàn)保險(xiǎn)單所載明的貨物、船名或航程有遺漏或錯(cuò)誤時(shí)，被保險(xiǎn)人應(yīng)在獲悉后立即通知保險(xiǎn)人并在必要時(shí)加繳保險(xiǎn)費(fèi)，本保險(xiǎn)才繼續(xù)有效。
In case of a change of voyage or any omission or error in the description of the interest, the name of the vessel or voyage, this insurance shall remain in forcce only upon prompt notice to this Company when the Insured becomes aware of the same and payment of an additional premium if required.
（四）在向保險(xiǎn)人索賠時(shí)，必須提供下列單證：
保險(xiǎn)單正本、提單、發(fā)票、裝箱單、磅碼單、貨損貨差證明、檢驗(yàn)報(bào)告及索賠清單。如涉及第三者責(zé)任，還須提供向責(zé)任方追償?shù)挠嘘P(guān)函電及其他必要單證或文件。
he Insured shall submit the following documents when presenting a claim under this insurance: Original Policy, Bill of Lading, Invoice, Packing List, Tally Sheet, Certificate of Loss or Damage and/or Shortlanded Memo, Survey Report and Statement of Claim. f third party liability is involved, letters and cables relative to recovery from the responsible party and other relative documents shall also be submitted.
（五）在獲悉有關(guān)運(yùn)輸契約中“船舶互撞責(zé)任”條款的實(shí)際責(zé)任后，應(yīng)及時(shí)通知保險(xiǎn)人。Immediate notice should be given to the Company when the cargo owner's actual responsibility under the contract of affreightment “Both to Blame Collision” clauses becomes known.
五、賠款的處理Treatment of Claim
（一）本保險(xiǎn)對(duì)同一標(biāo)記和同一價(jià)值的或不同標(biāo)記但是同一價(jià)值的各種包、件、扎、塊，除非另有規(guī)定，均視作同一重量和同一保險(xiǎn)價(jià)值計(jì)算處理賠償。
In settling any claim under this insurance, all packages, pieces or packs shall, unless otherwise stipulated, be considered as of the same weight and insured value, irrespective of whether such packages, pieces or packs bear the same mark and are of the same value or bear different marks but are of the same value.
（二）本保險(xiǎn)的索賠時(shí)效，從被保險(xiǎn)貨物在最后卸載港全部卸離海輪后起計(jì)算，最多不超過(guò)二年。
The time of validity of a claim under this insurance shall not exceed a period of two years counting from the time of completion of discharge of the insured goods from the seagoing vessel at the final port of discharge.
