PROTOCOL ON THE ACCESSION OF THE PEOPLE'S REPUBLIC OF CHINA

 

  第16條 特定產(chǎn)品過(guò)渡性保障機(jī)制

  16. Transitional Product-Specific Safeguard Mechanism

  1.如原產(chǎn)于中國(guó)的產(chǎn)品在進(jìn)口至任何WTO成員領(lǐng)土?xí)r,其增長(zhǎng)的數(shù)量或所依據(jù)的條件對(duì)生產(chǎn)同類產(chǎn)品或直接競(jìng)爭(zhēng)產(chǎn)品的國(guó)內(nèi)生產(chǎn)者造成或威脅造成市場(chǎng)擾亂,則受此影響的WTO成員可請(qǐng)求與中國(guó)進(jìn)行磋商,以期尋求雙方滿意的解決辦法,包括受影響的成員是否應(yīng)根據(jù)《保障措施協(xié)定》采取措施。

  1. In cases where products of Chinese origin are being imported into the territory of any WTO Member in such increased quantities or under such conditions as to cause or threaten to cause market disruption to the domestic producers of like or directly competitive products, the WTO Member so affected may request consultations with China with a view to seeking a mutually satisfactory solution, including whether the affected WTO Member should pursue application of a measure under the Agreement on Safeguards.

  任何此種請(qǐng)求應(yīng)立即通知保障措施委員會(huì)。

  Any such request shall be notified immediately to the Committee on Safeguards.

  2.如在這些雙邊磋商過(guò)程中,雙方同意原產(chǎn)于中國(guó)的進(jìn)口產(chǎn)品是造成此種情況的原因并有必要采取行動(dòng),則中國(guó)應(yīng)采取行動(dòng)以防止或補(bǔ)救此種市場(chǎng)擾亂。任何此類行動(dòng)應(yīng)立即通知保障措施委員會(huì)。

  2. If, in the course of these bilateral consultations, it is agreed that imports of Chinese origin are such a cause and that action is necessary, China shall take such action as to prevent or remedy the market disruption. Any such action shall be notified immediately to the Committee on Safeguards.

  3.如磋商未能使中國(guó)與有關(guān)WTO成員在收到磋商請(qǐng)求后60天內(nèi)達(dá)成協(xié)議,則受影響的WTO成員有權(quán)在防止或補(bǔ)救此種市場(chǎng)擾亂所必需的限度內(nèi),對(duì)此類產(chǎn)品撤銷減讓或限制進(jìn)口。任何此類行動(dòng)應(yīng)立即通知保障措施委員會(huì)。

  3. If consultations do not lead to an agreement between China and the WTO Member concerned within 60 days of the receipt of a request for consultations, the WTO Member affected shall be free, in respect of such products, to withdraw concessions or otherwise to limit imports only to the extent necessary to prevent or remedy such market disruption. Any such action shall be notified immediately to the Committee on Safeguards.

  4. Market disruption shall exist whenever imports of an article, like or directly competitive with an article produced by the domestic industry, are increasing rapidly, either absolutely or relatively, so as to be a significant cause of material injury, or threat of material injury to the domestic industry.

  In determining if market disruption exists, the affected WTO Member shall consider objective factors, including the volume of imports, the effect of imports on prices for like or directly competitive articles, and the effect of such imports on the domestic industry producing like or directly competitive products.

  5.在根據(jù)第3款采取措施之前,采取此項(xiàng)行動(dòng)的WTO成員應(yīng)向所有利害關(guān)系方提供合理的公告,并應(yīng)向進(jìn)口商、出口商及其他利害關(guān)系方提供充分機(jī)會(huì),供其就擬議措施的適當(dāng)性及是否符合公眾利益提出意見(jiàn)和證據(jù)。

  5. Prior to application of a measure pursuant to paragraph 3, the WTO Member taking such action shall provide reasonable public notice to all interested parties and provide adequate opportunity for importers, exporters and other interested parties to submit their views and evidence on the appropriateness of the proposed measure and whether it would be in the public interest.

  該WTO成員應(yīng)提供關(guān)于采取措施的決定的書面通知,包括采取該措施的理由及其范圍和期限。

  The WTO Member shall provide written notice of the decision to apply a measure, including the reasons for such measure and its scope and duration.

  6. A WTO Member shall apply a measure pursuant to this Section only for such period of time as may be necessary to prevent or remedy the market disruption.

  If a measure is taken as a result of a relative increase in the level of imports, China has the right to suspend the application of substantially equivalent concessions or obligations under the GATT 1994 to the trade of the WTO Member applying the measure, if such measure remains in effect more than two years.

  However, if a measure is taken as a result of an absolute increase in imports, China has a right to suspend the application of substantially equivalent concessions or obligations under the GATT 1994 to the trade of the WTO Member applying the measure, if such measure remains in effect more than three years.

  中國(guó)采取的任何此種行動(dòng)應(yīng)立即通知保障措施委員會(huì)。

  Any such action by China shall be notified immediately to the Committee on Safeguards.

  7.在遲延會(huì)造成難以補(bǔ)救的損害的緊急情況下,受影響的WTO成員可根據(jù)一項(xiàng)有關(guān)進(jìn)口產(chǎn)品已經(jīng)造成或威脅造成市場(chǎng)擾亂的初步認(rèn)定,采取臨時(shí)保障措施。

  7. In critical circumstances, where delay would cause damage which it would be difficult to repair, the WTO Member so affected may take a provisional safeguard measure pursuant to a preliminary determination that imports have caused or threatened to cause market disruption.

  在此種情況下,應(yīng)在采取措施后立即向保障措施委員會(huì)作出有關(guān)所采取措施的通知,并提出進(jìn)行雙邊磋商的請(qǐng)求。

  In this case, notification of the measures taken to the Committee on Safeguards and a request for bilateral consultations shall be effected immediately thereafter.

  The duration of the provisional measure shall not exceed 200 days during which the pertinent requirements of paragraphs 1, 2 and 5 shall be met.

  The duration of any provisional measure shall be counted toward the period provided for under paragraph 6.

  8.如一WTO成員認(rèn)為根據(jù)第2款、第3款或第7款采取的行動(dòng)造成或威脅造成進(jìn)入其市場(chǎng)的重大貿(mào)易轉(zhuǎn)移,則該成員可請(qǐng)求與中國(guó)和/或有關(guān)WTO成員進(jìn)行磋商。

  8. If a WTO Member considers that an action taken under paragraphs 2, 3 or 7 causes or threatens to cause significant diversions of trade into its market, it may request consultations with China and/or the WTO Member concerned.

  此類磋商應(yīng)在向保障措施委員會(huì)作出通知后30天內(nèi)舉行。

  Such consultations shall be held within 30 days after the request is notified to the Committee on Safeguards.

  如此類磋商未能在作出通知后60天內(nèi)使中國(guó)與一個(gè)或多個(gè)有關(guān)WTO成員達(dá)成協(xié)議,則請(qǐng)求進(jìn)行磋商的WTO成員在防止或補(bǔ)救此類貿(mào)易轉(zhuǎn)移所必需的限度內(nèi),有權(quán)針對(duì)該產(chǎn)品撤銷減讓或限制自中國(guó)的進(jìn)口。此種行動(dòng)應(yīng)立即通知保障措施委員會(huì)。

  If such consultations fail to lead to an agreement between China and the WTO Member or Members concerned within 60 days after the notification, the requesting WTO Member shall be free, in respect of such product, to withdraw concessions accorded to or otherwise limit imports from China, to the extent necessary to prevent or remedy such diversions. Such action shall be notified immediately to the Committee on Safeguards.

  9.本條的適用應(yīng)在加入之日后12年終止。

  9. Application of this Section shall be terminated 12 years after the date of accession.

  第17條WTO成員的保留  17. Reservations by WTO Members

 。祝裕铣蓡T以與《WTO協(xié)定》不一致的方式針對(duì)自中國(guó)進(jìn)口的產(chǎn)品維持的所有禁止、數(shù)量限制和其他措施列在附件7中。

  All prohibitions, quantitative restrictions and other measures maintained by WTO Members against imports from China in a manner inconsistent with the WTO Agreement are listed in Annex 7.

  所有此類禁止、數(shù)量限制和其他措施應(yīng)依照該附件所列共同議定的條件和時(shí)間表逐步取消或加以處理。

  All such prohibitions, quantitative restrictions and other measures shall be phased out or dealt with in accordance with mutually agreed terms and timetables as specified in the said Annex.

  第18條過(guò)渡性審議機(jī)制  18. Transitional Review Mechanism

  1.所獲授權(quán)涵蓋中國(guó)在《WTO協(xié)定》或本議定書項(xiàng)下承諾的WTO下屬機(jī)構(gòu)[1],應(yīng)在加入后1年內(nèi),并依照以下第4款,在符合其授權(quán)的情況下,審議中國(guó)實(shí)施《WTO協(xié)定》和本議定書相關(guān)規(guī)定的情況。

  1. Those subsidiary bodies[1] of the WTO which have a mandate covering China's commitments under the WTO Agreement or this Protocol shall, within one year after accession and in accordance with paragraph 4 below, review, as appropriate to their mandate, the implementation by China of the WTO Agreement and of the related provisions of this Protocol.

  中國(guó)應(yīng)在審議前向每一下屬機(jī)構(gòu)提供相關(guān)信息,包括附件1A所列信息。

  China shall provide relevant information, including information specified in Annex 1A, to each subsidiary body in advance of the review.

  中國(guó)也可在具有相關(guān)授權(quán)的下屬機(jī)構(gòu)中提出與第17條下任何保留或其他WTO成員在本議定書中所作任何其他具體承諾有關(guān)的問(wèn)題。

  China can also raise issues relating to any reservations under Section 17 or to any other specific commitments made by other Members in this Protocol, in those subsidiary bodies which have a relevant mandate.

  每一下屬機(jī)構(gòu)應(yīng)迅速向根據(jù)《WTO協(xié)定》第4條第5款設(shè)立的有關(guān)理事會(huì)報(bào)告審議結(jié)果(如適用),有關(guān)理事會(huì)應(yīng)隨后迅速向總理事會(huì)報(bào)告。

  Each subsidiary body shall report the results of such review promptly to the relevant Council established by paragraph 5 of Article IV of the WTO Agreement, if applicable, which shall in turn report promptly to the General Council.

  2.總理事會(huì)應(yīng)在加入后1年內(nèi),依照以下第4款,審議中國(guó)實(shí)施《WTO協(xié)定》和本議定書條款的情況。

  2. The General Council shall, within one year after accession, and in accordance with paragraph 4 below, review the implementation by China of the WTO Agreement and the provisions of this Protocol.

  總理事會(huì)應(yīng)依照附件1B所列框架,并按照根據(jù)第1款進(jìn)行的任何審議的結(jié)果,進(jìn)行此項(xiàng)審議。

  The General Council shall conduct such review in accordance with the framework set out in Annex 1B and in the light of the results of any reviews held pursuant to paragraph 1.

  中國(guó)也可提出與第17條下任何保留或其他WTO成員在本議定書中所作任何其他具體承諾有關(guān)的問(wèn)題。總理事會(huì)可在這些方面向中國(guó)或其他成員提出建議。

  China also can raise issues relating to any reservations under Section 17 or to any other specific commitments made by other Members in this Protocol. The General Council may make recommendations to China and to other Members in these respects.

 。常鶕(jù)本條審議問(wèn)題不得損害包括中國(guó)在內(nèi)的任何WTO成員在《WTO協(xié)定》或任何諸邊貿(mào)易協(xié)定項(xiàng)下的權(quán)利和義務(wù),并不得排除或構(gòu)成要求磋商或援用《WTO協(xié)定》或本議定書中其他規(guī)定的先決條件。

  3. Consideration of issues pursuant to this Section shall be without prejudice to the rights and obligations of any Member, including China, under the WTO Agreement or any Plurilateral Trade Agreement, and shall not preclude or be a precondition to recourse to consultation or other provisions of the WTO Agreement or this Protocol.

  4.第1款和第2款規(guī)定的審議將在加入后8年內(nèi)每年進(jìn)行。此后,將在第10年或總理事會(huì)決定的較早日期進(jìn)行最終審議。

4. The review provided for in paragraphs 1 and 2 will take place after accession in each year for eight years. Thereafter there will be a final review in year 10 or at an earlier date decided by the General Council.

 

  第二部分減讓表  Part II - Schedules

  1.本議定書所附減讓表應(yīng)成為與中國(guó)有關(guān)的、GATT1994所附減讓和承諾表及GATS所附具體承諾表。

  1. The Schedules annexed to this Protocol shall become the Schedule of Concessions and Commitments annexed to the GATT 1994 and the Schedule of Specific Commitments annexed to the GATS relating to China.

  減讓表中所列減讓和承諾的實(shí)施期應(yīng)按有關(guān)減讓表相關(guān)部分列明的時(shí)間執(zhí)行。

  The staging of concessions and commitments listed in the Schedules shall be implemented as specified in the relevant parts of the relevant Schedules.

  2.就GATT1994第2條第6款(a)項(xiàng)所指的該協(xié)定日期而言,本議定書所附減讓和承諾表的適用日期應(yīng)為加入之日。

  2. For the purpose of the reference in paragraph 6(a) of Article II of the GATT 1994 to the date of that Agreement, the applicable date in respect of the Schedules of Concessions and Commitments annexed to this Protocol shall be the date of accession.

  第三部分最后條款  Part III - Final Provisions

  1.本議定書應(yīng)開(kāi)放供中國(guó)在2002年1月1日前以簽字或其他方式接受。

  1. This Protocol shall be open for acceptance, by signature or otherwise, by China until 1 January 2002.

  2.本議定書應(yīng)在接受之日后第30天生效。

  2. This Protocol shall enter into force on the thirtieth day following the day of its acceptance.

 。常咀h定書應(yīng)交存WTO總干事?偢墒聭(yīng)根據(jù)本議定書第三部分第1款的規(guī)定,迅速向每一WTO成員和中國(guó)提供一份本議定書經(jīng)核證無(wú)誤的副本和中國(guó)接受本議定書通知的副本。

  3. This Protocol shall be deposited with the Director-General of the WTO. The Director-General shall promptly furnish a certified copy of this Protocol and a notification of acceptance by China thereof, pursuant to paragraph 1 of Part III of this Protocol, to each WTO Member and to China.

  4.本議定書應(yīng)依照《聯(lián)合國(guó)憲章》第102條的規(guī)定予以登記。

  4. This Protocol shall be registered in accordance with the provisions of Article 102 of the Charter of the United Nations.

  2001年11月10日訂于多哈,正本一份用英文、法文和西班牙文寫成,三種文本具有同等效力,除非所附減讓表中規(guī)定該減讓表只以以上文字中的一種或多種為準(zhǔn)。

  INFORMATION[1] TO BE PROVIDED BY CHINA IN THE CONTEXT OF THE TRANSITIONAL REVIEW MECHANISM

  中國(guó)需要依照加入議定書第18條第1款,提供關(guān)于以下內(nèi)容的信息。所要求的信息應(yīng)每年提供,中國(guó)和各成員同意審議不再需要此類信息的情況除外。

  China is requested to provide information on the following in accordance with Article 18.1 of the Protocol of Accession. The requested information should be provided annually, except in those cases where China and the Members agree that it is no longer required for the review.

  (a) most recently available import and export statistics by value and volume, by supplier country at the HS 8-digit level

  (b) current account data on services, by source and destination in line with the statistical requirements of the IMF

  (g) the value of commissions, mark ups and other fees charged on imports subject to state trading or designated trading imposed through government regulation or guidance, if any

  (h) the shares of imports and exports accounted for by the trading activities of state-owned enterprises

  (i) annual economic development programmes, China's five-year programmes and any industrial or sectoral programmes or policies (including programmes relating to investment, export, import, productions, pricing or other targets, if any) promulgated by central and sub-central government entities

  (j) annual receipts under the Value-Added Tax (VAT), with separate information for imports and domestic products as well as information on VAT rebates

  1. Non-Discrimination (to be notified to the Council for Trade in Goods)

  (a)廢止和停止關(guān)于國(guó)民待遇的所有與WTO不一致的法律、法規(guī)及其他措施

  (a) the repeal and cessation of all WTO inconsistent laws, regulations and other measures on national treatment

  (b)廢止或修改適用于下列產(chǎn)品的國(guó)內(nèi)銷售、許諾銷售、購(gòu)買、運(yùn)輸、分銷或使用的法律、法規(guī)及其他措施,以提供完全的GATT國(guó)民待遇:售后服務(wù)、藥品、香煙、酒類、化學(xué)品和鍋爐壓力容器(對(duì)于藥品、化學(xué)品及酒類,有權(quán)保留自加入時(shí)起為期1年的過(guò)渡期,以便修正或廢止有關(guān)法律)

  (a) administration of TRQs on a transparent, predictable, uniform, fair and non-discriminatory basis using clearly specified timeframes, administrative procedures and requirements and evidence of a consistent national allocation (and reallocation) policy including:

  (i) provision of volume/value of the quota or TRQ made available;

  (b) periodic review of existing standards of government standardizing bodies and harmonization of the same with relevant international standards where appropriate

  (c) revision of current voluntary national, local and sectoral standards so as to harmonize them with international standards

  (h) provision of a list of relevant local governmental and non-governmental bodies that are authorized to adopt technical regulations or conformity assessment procedures as part of China's notification under Article 15.2 of the Agreement

  (i) ongoing updates on the conformity assessment bodies that are recognized by China

  (j) enactment and implementation of a new law and relevant regulations regarding assessment and control of chemicals for the protection of the environment in which complete national treatment and full consistency with international practices would be ensured within one year after China's accession following conditions set out in 3(t) of the TBT Working Party Report

 。╧)加入后1年,關(guān)于所有合格評(píng)定機(jī)構(gòu)和部門是否獲得既對(duì)進(jìn)口產(chǎn)品又對(duì)國(guó)產(chǎn)品進(jìn)行合格評(píng)定的授權(quán)及是否遵循議定書第13條第4款(a)項(xiàng)所列條件的信息

  (k) information on whether, one year after accession, all conformity assessment bodies and agencies are authorized to undertake conformity assessment for both imported and domestic products and are following the conditions outlined in Section 13, subparagraph 4(a) of the Protocol

  (m) notification of the respective responsibilities assigned to China's conformity assessment bodies to the TBT committee 12 months after accession

  8.與貿(mào)易有關(guān)的投資措施(向與貿(mào)易有關(guān)的投資措施委員會(huì)作出通知)

  8. Trade-Related Investment Measures (to be notified to the Committee on Trade-Related Investment Measures)

 。╝)取消和停止通過(guò)法律、法規(guī)或其他措施實(shí)施貿(mào)易和外匯平衡要求、當(dāng)?shù)睾恳蟆⒊隹趯?shí)績(jī)要求、補(bǔ)償和技術(shù)轉(zhuǎn)讓要求的情況

  (a) elimination and cessation of enforcement of trade and foreign exchange balancing requirements, local content and export performance offsets and technology transfer requirements made effective through laws, regulations or other measures

 。╞)進(jìn)行修正以保證取消適用于汽車生產(chǎn)者的限制允許生產(chǎn)的車輛類別、類型或車型的所有措施(將在加入后2年完全取消)的情況

  (b) amendments to ensure lifting of all measures applicable to motor vehicle producers restricting the categories, types or models of vehicles permitted for production (to be completely removed two years after accession)

  (c)按報(bào)告書中所列標(biāo)準(zhǔn),提高省一級(jí)政府可批準(zhǔn)的對(duì)汽車制造的投資限額的情況

  (c) increased limits within which investments in motor vehicle manufacturing could be approved at the provincial government at the levels outlined in the Report

  9.國(guó)營(yíng)貿(mào)易實(shí)體(向貨物貿(mào)易理事會(huì)作出通知)

  9. State Trading Entities (to be notified to the Council for Trade in Goods)

 。╝)關(guān)于逐步取消絲綢措施方面的國(guó)營(yíng)貿(mào)易,增加和擴(kuò)大貿(mào)易權(quán),不遲于2005年1月1日對(duì)所有個(gè)人給予貿(mào)易權(quán)的情況

  (a) progressive abolishment of state trading in respect of silk measures, increasing and extending trading rights, granting the right to trade to all individuals no later than 1 January 2005

  (b)關(guān)于接觸紡織品部門原材料供應(yīng)的條件不低于國(guó)內(nèi)用戶的條件,并保證現(xiàn)有安排下所享受的接觸原材料供應(yīng)的條件不受到不利影響的情況

  (b) access to supplies of raw materials in the textiles sector at conditions no less favourable than for domestic users, and not adversely affected access to supplies of raw materials as enjoyed under existing arrangements

 。╟)關(guān)于非國(guó)營(yíng)貿(mào)易實(shí)體對(duì)化肥和油品貿(mào)易準(zhǔn)入的逐步擴(kuò)大的情況,及非國(guó)營(yíng)貿(mào)易實(shí)體可進(jìn)口數(shù)量的足額使用情況

  (c) progressive increases in access by non state trading entities to trade in fertilizer and oil and the filling of quantities available for import by non state trading entities

  The Rules of Procedure of the WTO General Council shall apply unless specified otherwise. China shall submit any information and the documentation relating to the review no later than 30 days prior to the date of the review.
