1.定義Definitions
a.運(yùn)單上的“本公司”指速運(yùn)(香港)有限公司或速運(yùn)(澳門)有限公司(如適用)、或其所屬的集團(tuán)內(nèi)的任何團(tuán)體、以及它們各自的雇員、代理人和獨(dú)立承辦商。如快件寄件地為香港或澳門以外的地區(qū),運(yùn)輸合同是與接收該快件的實(shí)體簽訂。
On this Waybill, “us” refers to Express (Hong Kong) Limited or Express (Macau) Limited (as applicable), or any member of the group of companies to which they belong, and their respective employees, agents, and independent contractors (“IC”). For shipment originates outside Hong Kong SAR or Macau, contract of carriage is with the EXPRESS’s entity who originally accepts your "Package" means any container or envelope that is accepted by us for delivery.
b.“包裹”指同意收寄的任何包裝箱或文件信封。
c.“快件”指單個(gè)運(yùn)單中,同意收寄的所有包裹。
d.“個(gè)人資料”是指任何可以直接或間接與個(gè)人有關(guān)的數(shù)據(jù)、可以切實(shí)可行地透過該資料確定有關(guān)人仕的身份、及該資料的存在形式,讓人可切實(shí)可行地查閱及處理。
e.“條款和條件” 指本條款和條件,除非適用法律或法規(guī)另有規(guī)定,可隨時(shí)自行更改,而不需另行通知。為避免爭(zhēng)議,任何修改在官方網(wǎng)站上發(fā)布時(shí)立即生效并具有約束力。
c."Shipment" means all packages which are tendered to and accepted by us on one waybill.
d."Personal Data" means any data relating directly or indirectly to an individual, from which it is possible and practical to ascertain the identity of the individual from the said data, in a form in which access to or processing of the data is practicable.
e.“T&Cs” refers to these terms and conditions hereunder and are subject to change by EXPRESS from time to time at its own discretion without prior notification except to the extent otherwise provided by applicable laws or regulations. For the avoidance of doubt, any such change shall become effective and binding on the Shipper upon its publication on the official website of EXPRESS.
 
2.不予收寄的快件Unacceptable Shipments
寄件人同意,如發(fā)生以下情況,其快件則被視為不可接受:
a.國際航空貨運(yùn)協(xié)會(huì)、國際民航組織及其它相關(guān)政府部門或組織所規(guī)定為有害物品、危險(xiǎn)物品,禁運(yùn)物品或限運(yùn)物品;
b.未按照有關(guān)海關(guān)規(guī)定辦理報(bào)關(guān)手續(xù)的;
The Shipper agrees that its Shipment is deemed unacceptable if:
a.it is classified as hazardous material, dangerous goods, prohibited or restricted articles by International Air Transport Association, International Civil Aviation Organization, any applicable government department or other relevant organisation;
b.no customs declaration is made when required by applicable customs regulations;
c.快件被列為危險(xiǎn)物品,或者認(rèn)為不能安全地或合法地運(yùn)輸?shù)目旒缟婕皠?dòng)物及其部分、貨幣、債券、證券、假冒商品、貴重金屬和寶石、槍械及其零件、火藥、人體部份或尸骸、色情物品,非法毒品/毒品或任何決定不能安全或合法運(yùn)輸?shù)奈锲?;?/div>
d.地址是不正確或沒有正確標(biāo)記,或快件包裝有缺陷或不妥善而至不足以在正常情況下能確保安全運(yùn)輸?shù)摹?/div>
有權(quán)因應(yīng)相關(guān)法律或政府機(jī)構(gòu)要求摧毀任何本條列明為不予收寄的快件。
c.the goods are classified as dangerous goods or EXPRESS believes that it cannot transport the goods safely or legally, such as involving animals and parts thereof, currency, bearer form, negotiable instruments, counterfeit goods, precious metals and stones, firearms and parts thereof, ammunitions, human remains, pornography, illegal narcotics/drugs or any other items that EXPRESS decides they cannot be carried safely or legally; or
d.its addressed is incorrect or not properly marked or its packaging is defective or inadequate to ensure safe transportation with ordinary care in handling.
EXPRESS shall have the right to destroy any unacceptable Shipment as specified in this section, which is required under applicable laws or government authorities.
 
3.查驗(yàn)權(quán)Right to Inspect
出于安全,保安,海關(guān)或監(jiān)管的理由,有權(quán)自行根據(jù)需要或因應(yīng)政府部門的要求,隨時(shí)在未經(jīng)通知寄件人的情況下對(duì)快件進(jìn)行開箱查驗(yàn)。免生疑問,不會(huì)對(duì)因上述查驗(yàn)而導(dǎo)致的任何延誤造成的直接、間接或任何損失負(fù)責(zé)。
The Shipment may, at our option or at the request of government authorities, be opened and inspected by us or such authorities at any time without notice for safety, security, customs or regulatory reasons. For the avoidance of doubt, EXPRESS shall not be responsible for any direct or indirect loss or any loss whatsoever for any delay caused to the Shipment due to such inspection.
 
4.寄件人的保證和彌償責(zé)任Shipper’s Warranties and Indemnity
如寄件人違反有關(guān)法律法規(guī)或違反以下保證和陳述,寄件人應(yīng)彌償并確保免受相關(guān)損失或損害:
The Shipper shall indemnify and hold EXPRESS harmless for any loss or damage in connection or resulting from the Shipper’s failure to comply with any applicable laws or regulations and for the Shipper’s breach of the following warranties and representations:
a.寄件人或其代理人提供的所有信息都是真實(shí)、完整和準(zhǔn)確的;
b.快件由寄件人或其雇員在安全的前提下準(zhǔn)備的;
c.為寄件人準(zhǔn)備快件的人員已獲得寄件人完全授權(quán);
a.all information provided by the Shipper or its representative(s) is true, complete and accurate;
b.the Shipment was prepared securely by the Shipper’s employees;
c.Staff employed to prepare the Shipment are duly authorised;
d.寄件人應(yīng)確??旒跍?zhǔn)備、倉儲(chǔ)和運(yùn)輸過程中免受他人不當(dāng)干擾;
e.快件所有標(biāo)識(shí)完整標(biāo)準(zhǔn),收件地址清晰;
f.快件包裝妥當(dāng),適用于正常安全運(yùn)輸;
d.the Shipper should ensure that EXPRESS will not improperly be interfered during the preparation, storage and transportation of the Shipment to EXPRESS;
e.the Shipment is properly marked and addressed;
f.the Shipment is packed in a manner that is suitable for shipping with ordinary care;
g.快件符合進(jìn)出口國家/地區(qū)海關(guān)、出口、入口及其它法律法規(guī)的規(guī)定,寄件人需配合辦理快件出/進(jìn)口清關(guān)手續(xù)并提供清關(guān)所需文件;
h.運(yùn)單由寄件人或其授權(quán)代表簽署,本條款和條件構(gòu)成對(duì)寄件人具有約束力和可強(qiáng)制執(zhí)行的義務(wù)。
g.the Shipment shall comply with all applicable customs, import, export and other laws and regulations, the Shipper should assist EXPRESS and provide necessary documents in arranging the import/export the waybill has been signed by the Shipper or the Shipper’s authorised representative and these T&Cs constitute binding and enforceable obligations of the Shipper.
 
5.申報(bào)價(jià)值Declared Value
寄件人同意,運(yùn)單上申報(bào)價(jià)值與快件的實(shí)際現(xiàn)金價(jià)值相等。除已選用保價(jià)服務(wù)的快件外,均依據(jù)本條款和條件的第 13 條約定承擔(dān)賠償責(zé)任。
The Shipper agrees the declared value on this waybill is equivalent to the actual cash value of the Shipment (“Declared Value”). Save and except Shipment that acquires the Shipment Protection Plus Service, EXPRESS’s entire liability shall be limited to Section 13 hereof.
 
6.運(yùn)輸和路線Transport and Routing
a.可以于任何時(shí)候雇用獨(dú)立的承包商來提供運(yùn)輸和其它服務(wù)。及其承包商代表、其承包商、其雇員、代理和分包商。他們均享受及承擔(dān)本條款的權(quán)利和義務(wù)且他們?nèi)魏稳司鶡o權(quán)取消或改變此條款。
b.一張運(yùn)單僅包含一個(gè)快件。
c.有權(quán)選擇合適的港口、道路、通道或任何其他運(yùn)輸途徑來運(yùn)送快件。
EXPRESS can hire IC to complete the transportation and other services at any time. Both EXPRESS and its IC represent EXPRESS and its contractors, their employees, agents and sub-contractors. They shall enjoy the rights and bear the obligations under this clause, and none of them has the rights to cancel or change this clause.
b.A waybill should contain one Shipment only.
c.EXPRESS has the rights to choose any port, road or passageway or any other transportation means to tranExpresser the Shipment.
d.除非在收件時(shí)另有書面協(xié)議,提供的服務(wù)僅限于收件、發(fā)運(yùn)、運(yùn)輸和清關(guān)(如有需要)。
e.The Shipper acknowledges and agrees that the Shipment will be shipped in a mixed collection of cargos, and it shall ensure that the Shipment can be shipped safely by preparing appropriate protective packaging according to the nature of the Shipment.
 
7.出口和進(jìn)口清關(guān)Exports and Imports Customs
寄件人同意為完成整個(gè)托運(yùn)過程而可以代表寄件人從事如下事項(xiàng):
Shipper hereby agrees that EXPRESS may perform the following activities on behalf of the Shipper in order to complete the carriage process:
a.填寫各類清關(guān)申報(bào)文件,更正快件申報(bào)內(nèi)容,并按照有關(guān)法律及法規(guī)的要求繳納相關(guān)稅費(fèi);
b.作為寄件人/收件人的貨運(yùn)代理人,可以自行或委托第三方在合適的口岸完成快件出/進(jìn)口清關(guān)手續(xù);和
c.應(yīng)他人要求將承運(yùn)的快件轉(zhuǎn)交給收件人的進(jìn)口代理或運(yùn)送到其它地點(diǎn),只要有合理理由判斷該他人已獲得必要授權(quán)。
a.complete any custom declaration document, revise Shipment declared contents, and pay any duties and taxes required under applicable laws and regulations;
b.acting as the Shipper’s or the Receiver’s forwarding agent, EXPRESS may itself complete or consign a third party to complete export/import custom clearance process in an appropriate port; and
c.redirect the Shipment to the Receiver’s import broker or other address upon request by any person whom EXPRESS believes in its reasonable opinion to be authorised.
 
8.快件延誤Delay of Shipments
將按照其正常運(yùn)送標(biāo)準(zhǔn)以合理的努力派送快件,但這些標(biāo)準(zhǔn)并不具有約束力,也不構(gòu)成與寄件人之間的合同的一部分。不對(duì)由運(yùn)輸延誤而導(dǎo)致的任何損失或損害承擔(dān)責(zé)任。
EXPRESS will make reasonable effort to deliver the Shipment according to EXPRESS’s regular delivery schedules and arrangements. However, these are not guaranteed and do not form part of the contract between EXPRESS and Shipper and/or Receiver. EXPRESS is not liable for any direct or indirect damages or losses as a result of Shipment delays caused by EXPRESS.
 
9.派送和不能派送Deliveries and Undeliverable
a.快件不能派送到郵政信箱或僅按郵政編碼派送,只可按照寄件人提供的收件人地址派送。將以商業(yè)上合理的努力將快件交付予指定的收件人,但這并不能保證,也不構(gòu)成與寄件人及/或收件人之間的合同的一部分。免生疑問,在接收人地址獲得的簽名或印章即構(gòu)成快件已交付的充分證明。
Shipments cannot be delivered to PO boxes or postal codes but only to the Receiver’s address given by the Shipper. EXPRESS will make commercially reasonable effort to deliver the Shipment to the named Receiver personally, but this is not guaranteed and does not form part of the contract between EXPRESS and Shipper and/or Receiver. For the avoidance of doubt, a signature or a stamp obtained at the Receiver’s address shall constitute sufficient proof of delivery of the Shipment.
 
b.如果收件人地址設(shè)集中接收點(diǎn),快件將被派送到該接收點(diǎn)。若有如下情形之一,將以合理的努力將快件退還寄件人,因此額外發(fā)生的費(fèi)用由寄件人支付:收件人拒絕接收快件或支付運(yùn)費(fèi);該快件則被認(rèn)為是不可接受;海關(guān)認(rèn)為寄件人低報(bào)了貨物的價(jià)值;無法合理確定或找到收件人。如不能退還快件,可以對(duì)快件進(jìn)行放棄、處置或變賣,且無須就上述行為向寄件人或其他人承擔(dān)任何責(zé)任,所得收入將在扣除服務(wù)費(fèi)用及相關(guān)管理費(fèi)用后返還寄件人 (如有)。
Shipments to addresses with a central receiving area will be delivered accordingly. If the Receiver refuses delivery, to pay for delivery, or to sign for or stamp for delivery; or the Shipment is deemed to be unacceptable, or undervalued for customs purposes; or the Receiver cannot be reasonably identified or located, EXPRESS shall use reasonable efforts to return the Shipment to the Shipper at the Shipper’s cost, failing which the Shipment may be released, disposed of or sold by EXPRESS without incurring any liability to the Shipper or anyone else, with the proceeds applied against service charges and related administrative costs and the balance to be returned to the Shipper (if any).
 
10.運(yùn)費(fèi)、關(guān)稅及其它費(fèi)用Shipment Charges, Tariff and other charges
a.的運(yùn)費(fèi)將按照貨物實(shí)際重量或體積重量中較高者計(jì)算,可以對(duì)任何快件重新稱量和測(cè)量以確認(rèn)其計(jì)算結(jié)果。
EXPRESS’s Shipment charges are calculated according to the higher of actual or volumetric weight and Shipment may be re-weighted and re-measured by EXPRESS to confirm this calculation.
 
b.即使寄件人給出不同的付款指示,寄件人始終對(duì)所有費(fèi)用承擔(dān)主要責(zé)任。在收件人或第三方付費(fèi)的情況下,寄件人應(yīng)向支付收件人或第三方應(yīng)支付但未支付的所有運(yùn)費(fèi)
和其它費(fèi)用。若代表寄件人、收件人或任何第三方被要求繳納稅費(fèi),且無法從相關(guān)人士收回該金額,寄件人將按要求支付該金額。
Even if the Shipper provides different payment instructions, the Shipper will always be primarily responsible for all charges. The Shipper shall pay on demand all shipping costs and/or other charges not paid when due by the Receiver (in the case of the Receiver billing) or by the third party (in the case of third party billing). If EXPRESS is required to pay any taxes, duties as levies on behalf of the Shipper, the Receiver or some other party, and EXPRESS is unable to recover such amount from the relevant person, that amount will be payable by the Shipper on demand.
 
11.保價(jià)服務(wù)“Shipment Protection Plus” (“SPP”) Service
a.本保價(jià)服務(wù)是一項(xiàng)可選擇的增值服務(wù),是在下述第 13 條所規(guī)定的責(zé)任的延伸,對(duì)于因嚴(yán)重疏忽而直接對(duì)快件造成的遺失、破損或短缺,提供完全和最終的賠償。若快件遺失,則按照上述第 5 條所規(guī)定的申報(bào)價(jià)值作賠償;或若快件破損或短缺,則根據(jù)快件損毀程度或遺失的比例,按申報(bào)價(jià)值相應(yīng)比例賠償。如快件需寄還至寄件人,將從賠償金額中扣除所須運(yùn)費(fèi)。
This SPP Service is a value-added service which is OPTIONAL. It is an extension of EXPRESS’s liability as stipulated in Clause 13 herein below for any Shipment that is lost, damaged or partially missing as a direct result of our gross negligence and offers an alternative full and final settlement of either, if lost, the full Declared Value defined in Clause 5, or, if damaged or partially missing, a pro rata payment of the Declared Value assessed based upon the degree of damage on or the portion missing from the Shipment. EXPRESS shall deduct the returning fee from the compensation should the Shipment be returned to the Shipper.
b.在任何情況下都不會(huì)作出超出申報(bào)價(jià)值的賠償。
c.為免生疑問,除非本條款另有說明,其他與責(zé)任相關(guān)的條款和條件應(yīng)取決于第 13 條。
b.Under no circumstances shall EXPRESS be liable for any compensation exceeding the Declared Value to the Shipper.
c.For the avoidance of doubt, unless otherwise stipulated in this Clause, all other provisions concerning EXPRESS’s liabilities shall be governed by Clause 13.
 
12.不可抗拒因素Circumstances beyond EXPRESS’s Control
將不會(huì)對(duì)由于超出控制的原因造成的任何服務(wù)中斷負(fù)責(zé),包括但不限于:天災(zāi)、行政當(dāng)局以實(shí)際或明顯的權(quán)力行事、海關(guān)或相關(guān)部門的行為或不行為、客戶提供的數(shù)據(jù)不足、政府部門所施行安全規(guī)例或其他適用于交付地點(diǎn)的安全規(guī)例、被政府機(jī)構(gòu)扣留、暴亂、罷工或其他勞資糾紛、民間騷亂、通信和信息系統(tǒng)的故障或中斷 (包括但不限于的通信和信息系統(tǒng)) 、航空或路面交通網(wǎng)絡(luò)中的任何干擾,如因天文現(xiàn)像、自然災(zāi)害,包括地震,氣旋,風(fēng)暴,洪水等。
EXPRESS shall not be liable for to, any interruption of service due to causes beyond EXPRESSs control, including, but not limited to, the following: acts of God; acts of public authorities acting with actual or apparent authority; acts or omissions of customs or similar authorities; insufficient information provided by a customer; the application of security regulations imposed by the government or otherwise applicable to the delivery location; a government agency hold; riots; strikes or other labour disputes; civil unrest; disruptions or failure of communication and information systems (including, but not limited to EXPRESSs communication and information systems); disruptions of any kind in air or ground transportation networks; such as weather phenomena; and natural disasters including earthquakes, cyclone, storm, flood etc..
 
13.公司的責(zé)任EXPRESS’s liability
a.基于本條款和條件對(duì)寄件人所承擔(dān)的責(zé)任僅限于實(shí)際直接損失、且不超過本條款和條件第 13 條所規(guī)定的限額。因寄件人可自行事先對(duì)特殊風(fēng)險(xiǎn)投保,不承擔(dān)任何其它損失或損害 (包括但不限于利潤、收入、利息及未來業(yè)務(wù)的損失),無論這些其它損失和損害是特殊性或是間接性,無論是否在受理快件之前或之后知曉有這些損失或損害的風(fēng)險(xiǎn)。
EXPRESS contracts with the Shipper on the basis that EXPRESS’s liability is strictly limited to direct loss only and to the limits stipulated in this Section 13. All other types of loss or damage are excluded (including but not limited to lost profits, income, interest and future business), whether such loss or damage is special or indirect, and even if the risks of such loss or damage was brought to EXPRESS’s attention before or after acceptance of the Shipment since special risks can be insured by the Shipper.
b.僅基于以下規(guī)定承擔(dān)責(zé)任:
EXPRESS’s liability under a waybill shall be limited to the stipulation of the following:
 
i)如快件采取包含空運(yùn)、陸運(yùn)或其他方式運(yùn)送,除非另有證據(jù),否則任何損失或損害將被推定在空運(yùn)階段發(fā)生。對(duì)于快件運(yùn)送及/或提供清關(guān)服務(wù)的快件的責(zé)任,在不影響本條款和條件的第 8、11、14 條約定的前提下,均在任何情況下不超過貨物的申報(bào)價(jià)值,且不得超過以下各項(xiàng)中的較低者:100 美元;或在空運(yùn)或其他非陸運(yùn)條件下為 20.00 美元/公斤或 9.07 美元/磅;或在陸運(yùn)條件下為 10.00 美元/公斤或 4.54 美元/磅 (不適用于美國)。
If a Shipment combines carriage by air, road or other mode of transport, it shall be presumed that any loss or damage occurred during the air period unless proven otherwise. EXPRESS’s liability in respect of any one Shipment transported, and/or customs clearance service thereof, without prejudice to Sections 8, 11, 14, is limited to the Declared Value but shall in no event exceed the lesser of USD100 or USD20/kg or USD9.07/lb for Shipments transported by air or other non-road mode; or USD10/kg or USD4.54/lb for Shipments transported by road (not applicable to the US).
 
ii)每一快件只能提出一次索賠,且與該快件相關(guān)的所有損失或損壞的賠償是完全并最終的。如寄件人認(rèn)為本條款和條件關(guān)于賠償?shù)囊?guī)定將不足以補(bǔ)償其損失,則應(yīng)自行投保,否則寄件人將承擔(dān)一切損失和損害的風(fēng)險(xiǎn)。所有的索賠應(yīng)于規(guī)定的時(shí)間內(nèi)以書面形式提出。除非與相關(guān)適用法律沖突,任何索賠必須在接受快件后的三十 (30) 天內(nèi)以書面方式向提出,否則將不再承擔(dān)任何責(zé)任。在向提供書面通知索賠的九十 (90) 天內(nèi),應(yīng)向交付所有相關(guān)支持文件。若尚未支付所有運(yùn)輸費(fèi)用,無義務(wù)受理任何索賠。索賠金額不可用于抵消該等運(yùn)輸費(fèi)用。若收件人在簽收快件時(shí)沒有在快遞記錄上注明有任何損壞,視為快件被完好送達(dá)。若沒有提供原快件和包裝材料供檢查,將不受理任何對(duì)損壞的索賠。不作任何明示或默示保證。
Claims are limited to one claim per Shipment, settlement of which shall be full and final for all loss or damage in connection therewith. IF THE SHIPPER REGARDS THESE LIMITS AS INSUFFICIENT, IT MUST MAKE ITS OWN INSURANCE ARRANGEMENTS, OTHERWISE THE SHIPPER ASSUMES ALL RISKS OF LOSS OR DAMAGE. All claims must be made in writing and within strict time limits. Unless contrary to applicable laws, all claims must be submitted in writing to EXPRESS within 30 days from the date EXPRESS accepted the Shipment, otherwise EXPRESS shall have no liability whatsoever. Within 90 days after written notification of the claim to EXPRESS, all relevant supporting documents must be delivered to EXPRESS. EXPRESS is not obligated to act on any claim until all transportation charges have been paid. The claim amount shall not be set off against such charges. If the Receiver accepts the Shipment without noting any damage on the delivery record, EXPRESS will assume the Shipment was delivered in good condition. EXPRESS will not consider any claim for damages unless the original shipping and packing materials are available for inspection. EXPRESS makes no warranties, express or implied.
 
iii) 所有評(píng)估快件損壞程度或遺失比例應(yīng)該完全由的絕對(duì)酌情決定權(quán)自行決定。
iv)The Declared Value of a Shipment must be evident by an authentic and valid commercial invoice or receipt, which EXPRESS shall have the sole and absolute discretion to accept, inspect and verify thereof to its satiExpressaction or to reject thereof without giving any reason.

在空運(yùn)條件下,若派送的快件的最終目的地或者??繃辉诎l(fā)件國,對(duì)快件丟失、延誤或破損所負(fù)的責(zé)任應(yīng)遵守《華沙公約》和《蒙特利爾公約》以及任何后續(xù)發(fā)布的修正及協(xié)議(如適用)。對(duì)于國際陸運(yùn)運(yùn)輸,則依據(jù)《國際公路貨物運(yùn)輸合同公約》。該等公約限制對(duì)損失或損壞所負(fù)的責(zé)任。
If the Shipment is transported by air and involves an ultimate destination or stop in a country other than the country of departure, the Warsaw and Montreal Conventions and their subsequent amendments and protocols, if applicable, governs and limits EXPRESS’s liability for loss of, delay or damage to the Shipment. For international road transportation, the Convention for the International Carriage of Goods by Road (CMR) may apply. These conventions limit EXPRESS’s liability for loss or damage.
 
15.規(guī)管法律Governing Law
除非與適用法律沖突,與本條款和條件有關(guān)的任何爭(zhēng)議將受到快件原寄件地國家法院的非排他管轄,并適用于原寄件地國家法律。
Any dispute arising in connection with the T&Cs shall be subject, for the benefit of EXPRESS, to the non-exclusive jurisdiction of the courts of, and governed by the law of, the country of origin of the Shipment and the Shipper irrevocably submits to such jurisdiction, unless contrary to applicable law.
 
16.私隱政策Data Privacy Policy
矢志妥善保障由寄件人所提供的個(gè)人資料,并確保就收集、使用、保留、披露、傳輸、保安及存取個(gè)人資料時(shí)均符合由所發(fā)出的相關(guān)實(shí)務(wù)守則及指引之規(guī)定。詳情請(qǐng)瀏覽于官網(wǎng)上公布的《私隱政策聲明》。
EXPRESS is committed to safeguard the Personal Data provided by the Shipper. In relation to the collection, use, retention, disclosure, tranExpresser, security and access of the Personal Data, EXPRESS shall comply with the relevant code of practice and guidance issued by EXPRESS. Please refer to the Data Privacy Policy Statement published on the official website of EXPRESS.
 
17.可分割性Severability
本條款和條件任何部分的無效性或不可執(zhí)行性,不影響其他條款的效力和執(zhí)行。
The invalidity or unenforceability of any provision shall not affect any other part of these Terms and Conditions.
 
18.語言Governing Language
如果在此運(yùn)單上 (包括本條款和條件) 不同的語言有差異,則以英文版本為準(zhǔn)。
If there are different languages incorporated in this Waybill (including these Terms and Conditions), the English version shall prevail in the event of any inconsistency between the versions.
