1.INTRODUCTION. Tourism Packages 導(dǎo)言     旅游團隊
Stated that: 即
a.) The organizer and the vendor of the tourism packages, who the consumer refers to, should be in possession of amministrative authorization for the completion of their services,
具有經(jīng)政府批準的旅游服務(wù)的組織人和銷售者,本文稱之為客戶。
 
b.) The consumer has the right to recieve a copy of the sales contract of the tourism packages, that is documented as necessary to access the guarantee in reference to article 18 of these general conditions of the contract. The concept of tourism packages is the following: tourism packages regard trips, vacation holidays and its “all inclusive” stays, resulting from the prefixed combinations of at least two elements indicated as follows, sold or offered as a flat rate price with a duration of over 24 hours or extending over a period of time the comprises at least one night:

2. LEGISLATIVE RESOURCES 法律依據(jù)
The sales transaction of tourism packages, with the the object of providing services both nationally as well as abroad, regulated  by ratification and fulfillment of International Convention relative to travel contracts (CCV) signed in Brussels on 23th. April, 1970 as applicable to the Consumer Code.
開展國內(nèi)外旅游團隊服務(wù)經(jīng)營,應(yīng)按照1970年4月23日在布魯塞爾簽訂的與旅游合同有關(guān)的國際協(xié)定進行批準和執(zhí)行,該協(xié)定適用消費者法。
 
3. OBLIGATORY INFORMATION 必要信息

4. RESERVATIONS 預(yù)定
The request for reservations must be written on specific contract forms, in the case that forms should be electronically submitted, they must be compiled in each part and signed by the client, who will recieve a copy. The reservation agreement is valid only, with consequent conclusion of the contract.
客戶的預(yù)定要求必須以書面合同格式明確約定,如果該格式必須以電子發(fā)送,必須按每一部分匯總并由代理人簽署。代理人持一份。預(yù)定協(xié)議必須在簽署合同才生效。
 
when the organizer sends relative confirmation, which can occur also by means of telecommunications, to the client or through the vending travel agency.
The indications that are relative to the tourism packages not contained in contractual documents, in the brochures or by other means of written communication, will be provided by the organizer with standard completion

5. PAYMENT 款項支付
The downpayment, up to a maximum of 25% of the price of the tourism package, to be paid at the time of the booking or at the time of the binding request and the date with which the payment must be paid in full, as listed in the catalogue brochure. Non payment of the sum above mentioned, on the preset dates constitutes the conditions clause expressed in such a way as determined, by the intermediary agency and/or for the conditions of rights to be determined by the organizer.
旅游團隊在提出預(yù)定要求時或者提出有約束力的請求時支付預(yù)付定金,定金標準為最高團隊總價的25%。全款支付時間按照宣傳冊的列出安排。在預(yù)定的日期,如果上訴款項未能由中介機構(gòu)支付,或者由組織者為確定權(quán)利條款而支付,則不構(gòu)成確定性條款,
 
6. PRICE 價款
The price of the tourism package are expressed in Euros and have been calculated based on hotel rates, means of transportation and additional services .
This can be subject to change within 20 days before the date of departure and only in consequence to the variation of:
旅游團隊的價格以歐元計價,按照酒店報價、交通方式和其他服務(wù)計算。在啟程前20天如果以下情況出現(xiàn)變動可以對合同做變更:
 
-cost of transport, cost of petrol and insurance costs are included;
運輸費用,汽油費用,保險費用;
 
-rights and taxes on certain types of tourism services for which are landing tax, disembarkation or embarkation of passengers in ports or airports;
某些旅游服務(wù)項目的權(quán)利和稅金,入境稅,港口和機場旅客出入。
 
 -changes applied to the package in question. For such variations there is referral to the exchange rate and to the above mentioned current prices advertised in the program, referred to on the technical chart of the brochure or of the referred date of the above mentioned update. Variations will incur price changes to the flat rate fee of the tourism package in the percentage expressly indicated on the technical chart or the out of catalog program.

7. CONSUMER WITHDRAWAL 消費者不履行合同的處理方式
The consumer can withdraw from the contract, without paying penalties, in the following circumstances:
如果出現(xiàn)以下情況,消費者可以不履行合同并免違約金。
 
-price increase according to article 6 exceeding 10% of the price;
根據(jù)第6條之規(guī)定,如果價格上漲10%;
 
-Modification in significant manner of one or more elements of the contract,that can be configured the time of use, of the tourism package and proposed by the organizer after the conclusion of this contract but before the departure and not accepted by the consumer.
合同中一項或者多項主要履行方式發(fā)生變更,而這種變更已經(jīng)設(shè)定了利用的時間和旅游綜合服務(wù)的時間,是組織者在合同簽訂后但啟程前所提議的時間,這個時間未能被消費者所接受。
 
In the above mentioned cases, the consumer alternatively has rights:
在上述情況,消費者有權(quán)選擇:
 
-To take advantage of an alternative tourism package, without supplemental charges or with the restitution of the surplus of the price, should the second package have an inferior value than the first;
接受變更了的旅游服務(wù),不支付另外費用,或者如果變更了的服務(wù)質(zhì)量不如原定的服務(wù),則退還多的費用。
 
-To the restitution of the sum already paid. This restitution must be made within 7 working days from the moment of recieving the refund request.
退還已交費用。在接到消費者退款要求后7個工作日內(nèi)退還。
 
The consumer must comunicate their decision (to accept the modification or withdraw) within and not longer than 2 working days from the moment in which the increase notification or modification is recieved. In failing to meet the abovementioned period of time, the offer proposed by the organizer is understood as accepted.
The consumer that withdraws from the contract before the departure, outside of the circumstances mentioned at the first point, independently from the downpayment by which article 5, the registration dues, the insurance premium and the percentages of the participation due calculated based on how many days the trip was cancelled before the start of the trip ( the calculation of days does not include the day of withdrawal) by which the communication must occur on a working day previous to that of the start of the trip:
消費者須在接到漲價通知或者變更通知之日起2個工作日內(nèi)通報其決定,即是接受變更還是撤銷合同。如在上述時間內(nèi)未予回復(fù),則組織者所報價視為接受。如果消費者在啟程前提出撤銷合同的原因非上述第一點所涉及的原因,而是僅僅要求退還預(yù)付定金,則應(yīng)支付登記稅、保險費和根據(jù)從啟程前撤銷合同之日到應(yīng)當(dāng)通告組織者的啟程前工作日之間的天數(shù)所計算的參團比率費用。
 
from 59 to 30 days 10 % for all trips and stays
從第59天至30天扣除旅行和住宿費用的10%;
 
From 29 to 15 days 20 % for all trips and stays
從第29天至15天扣除旅行和住宿費用的20%;
 
from 14 to 9 days 30 % for all trips and stays
從第14天至9天扣除旅行和住宿費用的30%;
 
from 8 to 4 days 50 % for all trips and stays
從第8天至4天扣除旅行和住宿費用的50%;
 
from 03 to 0 days 100 % for all trips and stays
從第3天至0天扣除旅行和住宿費用的100%;
 
These sums must be paid by who is unable to carry out the the trip for lack or irregularity of the expected emigration documents. In the case of pre-established groups these sums will be agreed upon each time at the signing of the contract.
如果因出境文件欠缺或者不合規(guī)定而不能進行該旅行,應(yīng)承擔(dān)這些費用。在預(yù)先已經(jīng)明確團隊的情況下,這些費用應(yīng)當(dāng)每次在簽訂合同時商定。
 
8. MODIFICATION OR ANNULLMENT OF THE TOURISM PACKAGE BEFORE DEPARTURE
BY THE CONSUMER
啟程前由消費者變更或取消團隊合同的處理方式
 
The modifications requested by the client as soon as the booking has been already accepted do not oblige the organizer in the cases where these requests cannot be fulfilled.
在預(yù)定已經(jīng)被消費者接受的情況下,消費者提出對行程的變更,如果這種請求無法得到實現(xiàn),其責(zé)任與組織者無關(guān)。
 
9. MODIFICATION OR CANCELLATION OF THE TOURISM PACKAGE BEFORE
DEPARTURE BY THE ORGANIZER.
啟程前組織者提出變更或撤銷合同
 
Whichever significant modification on behalf of the organizer, or the package or of one of its essential elements is subject to acceptance by the client according to the law of article 91 Codice del Consumo (Consumer Code). In the case of non acceptance the consumer can exercise their rights with reference to article 7. The consumer can exercise their above mentioned rights foreseen in the program or owing to circumstances beyond ones control, related to the purchased tourism package. For the cancellations different from those ones caused by circumstances that are beyond ones control, fortuitous events, and by not reaching minimum number of participants as well as for those ones different from the missed acceptance by
the consumer of the alternative tourism package, the organizer that cancels is due to give back the consumer the double of what was paid and collected by the consumer .
根據(jù)《消費者法》第91條的規(guī)定,代表組織者或團隊接待或任何一個實質(zhì)性的事項發(fā)生變更,應(yīng)取決于客戶是否接受。如果不予接受,消費者有權(quán)依照第7條規(guī)定行使自己權(quán)利。消費者對于已經(jīng)付費的旅游服務(wù),如果可預(yù)見的日程安排或由于超出自己可控制情況,可以行使上述權(quán)利。合同取消可分不同的情況:超出可控制的情況、意外事故、未達到最少參團人數(shù)以及因旅游計劃變更而未能得到消費者的接受、組織者按照消費者已付款金額的雙倍返還消費者。
 
10. MODIFICATIONS AFTER DEPARTURE  啟程后的變更
The organizer, if after the departure finds him/herself unable to provide for any reason, excluding a personal case of the consumer, an essential part of the services written contract, must give alternative solutions, without additional costs at the expense of the contracting party and if the services provided are of an inferior
value with respect to those expected, the reimbursement will be a standard of value equal to the difference.
如果在發(fā)團之后,無論任何原因,組織者發(fā)現(xiàn)無法提供書面合同所約定的主要服務(wù)部分,必須在不增加當(dāng)事方費用的條件下提出變更方案。如果提供的服務(wù)價值將低于預(yù)期的話,應(yīng)給予差價補償。
 
If there other alternative solutions are not possible, or if the proposed solution by the organizer is refused by the consumer for serious and justified reasons, the organizer will provide without additional charges a means of transportation equivalent to the means of transportation originally expected for the return to the location of departure or to a different location eventually agreed upon compatibly with the availability of the given means of transport and available seating/space and they will be refunded for the difference of the cost of the services provided and those of the services carried out from the moment of advanced re-entry
如果其他變更的方案不可行,或者因嚴重和正當(dāng)?shù)脑虮幌M者所拒絕,組織者應(yīng)以原先所預(yù)期的交通方式將消費者送回出發(fā)地點,或者最終協(xié)商的其他地點,為其提供交通方式和座位/艙位,并返還消費者已經(jīng)支付的服務(wù)費用與返回時已給予了的服務(wù)所用費用之間的差價。
 
11. SUBSTITUTIONS   合同方的受讓人
The renouncing client can be substituted by another person provided that:
明示放棄合同的當(dāng)事方可以由其他人受讓。只要受讓人符合以下條件:
 
a.) The organizer is informed in writing at least 4 working days before the fixed date of departure, receiving contextually communication regarding the generalities of the transferee assignee;
組織者在約定啟程前至少提前4個工作日得到書面通知,并接到有關(guān)受讓方的的一般情況的常規(guī)通報。
 
b.) The substitute satisfies all the conditions for the fruition of the service (
ex art. 89 Cod. Cons.) and in particular the prerequisites relative to passport, visa and health certificates;
受讓方應(yīng)符合接受服務(wù)的條件,如:消費者法第89條 ( art. 89 Cod. Cons.) 之規(guī)定,特別是有必需的護照、簽證和健康證明。
 
c.) The individual sub appointed must repay to the organizer all the additional expenses incurred to continue the substitution in the way that will be quantified before the transfer. The transferring party and the transferee assignee are responsible jointly and severally for the payment of the cost as well as the amount in letter c) of this article. In regards to certain types of services, it could occur that a third service provider refuse the modification of the named transferee assignee,such non-acceptance will be communicated in good time by the organizer to the concerned parties before the departure.
指定的個人受讓方必須在轉(zhuǎn)讓參團資格前向組織者償付辦理延續(xù)參團資格的格外費用。轉(zhuǎn)讓方和受讓方要承擔(dān)連帶責(zé)任,保證支付參團費用和本條第C款規(guī)定的費用。有可能發(fā)生第三方服務(wù)提供者拒絕被指定的受讓方的變更,如有該情況,組織者會在出發(fā)前及時通告相關(guān)方。
 
12. OBLIGATIONS OF THE PARTICIPANTS  參團人員的義務(wù)
The participants must have an (individual or personal ) passport or other documentation valid for all the countries in the contents of the itinerary, as well as a visa of transportation and health certificates that will be requested. The participants must adhere to the rules of prudence and caution and to those rules the laws enforced within the Italian territory, to all the information provided to them by the organizer, and to the rules and administrative and legislative provisions relative to the tourism package. The participants will be held responsible for any damages caused to the organizer caused by the non-fulfilment of the above mentioned obligations by the participants. The consumer must provide the organizer all the documentation, information and the elements in their possession useful to exercise the right of replaceability towards third parties responsible for the damage and he is responsible towards the organizer of the prejudice caused to the right of replaceability. The consumer will inform the organizer in writing, at the time of the reservation, particular personal requests that could become subject of specific agreements regarding the trip conditions, providing that these requests result possible to be carried out.
參團人員必須持有個人護照或旅行路線上各個國家都有效的其他證件,以及旅行簽證和必需的健康證明。參團人員必須審慎遵守規(guī)定,遵守意大利境內(nèi)實施的法律法規(guī),依從組織者提供給他們的所有信息以及涉及團隊旅游的規(guī)章、行政法令和其他立法。參團人員如果因未能履行上述義務(wù)而給組織者造成損失,應(yīng)承擔(dān)相應(yīng)責(zé)任。參團人員為了有利于行使第三方承擔(dān)該損害責(zé)任的受讓權(quán)利,必須向組織者提供他所有的文件、信息和重要材料,還要承擔(dān)因責(zé)任受讓權(quán)而給組織者造成的損失。在參團前,消費者應(yīng)向組織者書面提出可能會對涉及旅行條件的具體協(xié)議構(gòu)成前提的個人特殊要求,只要這些要求最終可以被接受。
 
13. HOTEL CLASSIFICATION  酒店的等級
The official classification of the hotels are provided by the program with informative material based on the explicit and formal indications by competent authority of the Province of Arezzo. The organizer reserves the right to provide in the program or tourist brochure a personal description of the accommodation structure, so to permit an evaluation and consequent acceptance on behalf of the consumer.
酒店的等級是在日程中根據(jù)Arezzo省主管當(dāng)局的明文正式規(guī)定在通報資料中提供的。組織者有權(quán)在日程中或者旅游宣傳冊中做自己的描述,因此也允許代表消費者做評估和接受。
 
14. SYSTEM OF RESPONSIBILITY 責(zé)任劃分
The organizer is responsible for damages caused to the consumer due to partial or total non-fulfilment of the contractual services due, both if these are caused by him or by third party service providers, unless proved by the consumer (therewith initiative independently taken upon themselves in the course of the tourist services) or by extraneous circumstances to the services provided in the contract, a fortuitous event, circumstances beyond ones control or circumstances that the organizer could not, in accordance with standard professionalism, reasonably foresee or resolve.
The vendor at the location of where the reservation was made of the tourism package is not responsible in any case of the obligations that arise from the organization of the trip, but is responsible exclusively for the obligations that arise regarding the intermediarys qualities and within the limits of responsibility of the
regulations in force on the subject.
組織者要對由于自己未能部分或者全部履行合同服務(wù)而給消費者造成的傷害負責(zé),包括這些傷害是組織者或者第三方服務(wù)提供者的責(zé)任,除非能夠證明是消費者在旅游過程中自己造成的,或者是合同履行過程中外來因素、偶然事件、無法控制的因素、或者是由于組織者無法根據(jù)職業(yè)規(guī)范標準合理預(yù)見和解決的原因造成的。在旅游團隊所預(yù)定的場所的客戶不對旅途中組織所發(fā)生的任何事件負責(zé),但要對組織質(zhì)量承擔(dān)完全義務(wù),其責(zé)任限于對該事件的強制性規(guī)定。
 
15. LIMITS OF COMPENSATION  賠償標準
Compensation for damages to the person cannot exceed the foreseen limits by the international conventions for which Italy and the European Union are part of with reference to the services whose performance has determined the responsability. In any case the compensation limit cannot exceed the amount of 50,000 Euro for damages to people, 2,000 Euro for damages to objects, 5000 Euro for any other damage.
對人身的傷害賠償,根據(jù)意大利和歐盟所參與的國際公約,不超過可預(yù)見的范圍,參照服務(wù)的履行而定責(zé)任。無論任何情況下,對人身的傷害賠償不超過5萬歐元;對財物的損失不超過2千歐元;其他賠償不超過5千歐元。
 
16. OBLIGATIONS OF ASSISTENCE 組織者的協(xié)助義務(wù)
The organizer is responsible to provide the measure of assistance to the consumer that is imposed by the criteria of the professional standard exclusively in reference to the obligations of his/her job under the provisions of the law or contract. The organizer and the vendor are exonerated from the respective responsibilities. (art. 14 and15 of these General Conditions) when the missing or inexact carrying out of the contract is chargeable to the consumer or is dependent on a third party in an unforeseeable or inevitable way, or in the case of fortuitous event or circumstances beyond ones control.
組織者應(yīng)根據(jù)法律和合同所規(guī)定的職責(zé),按照職業(yè)規(guī)范為消費者提供協(xié)助。如果合同履行義務(wù)被免除是因為消費者的原因,或無法預(yù)料和不可避免的第三方的原因,或是因為意外事故,或是因為超出人力控制情況,組織者和客戶免除承擔(dān)相應(yīng)責(zé)任。
 
17. COMPLAINTS AND CHARGES 投訴受理
Any fault in carrying out the terms of the contract must be notified without delay so that the organizer, their local representative or guide can resolve the issue in good time. The consumer must complaint for the loss of a right and send a written complaint registered mail with return receipt to the organizer or vendor, within and no later than ten working days from the date of return at the place of departure.
任何有關(guān)合同違約的情況應(yīng)立即予以通報,使得組織者及其駐地代表或者導(dǎo)游妥善解決處理。消費者必須在返還出發(fā)地10個工作日之內(nèi),以附回執(zhí)的掛號信函向組織者或者客戶投訴。
 
18. INSURANCE AGAINST THE EXPENSES OF CANCELLATION AND OF REPATRIATION
對行程取消或者遣返的保險
If not expressly included in the price, it is possible, and rather advisable, to stipulate during the booking insurance policies against the consequential expenses derived from the cancellation of the package, accidents and baggages. It will be possible to stipulate a contract of assistance that covers the expenses of repatriation in case of accidents and illnesses.
如果價格中沒有明示的話,最好在預(yù)定保險時針對行程取消或者遣返、意外事故和行李投保。也可以在合同中設(shè)置一項涉及因意外事故和疾病原因而被遣返的輔助條款。
 
19. FUND OF GUARANTEE 國家擔(dān);鸬木葷
It is founded near the General Direction for the Tourism of the Office of the Productive Activities, the National Fund of Guarantee which the consumer can address to (according to the art.100 Consumer Code), in case of insolvency or declared failure of the seller or the organizer, for the guardianship of the following
demands:
國家擔(dān)保基金會生產(chǎn)活動部頒布的旅游綜合指導(dǎo)中規(guī)定,消費者如因破產(chǎn)或聲稱服務(wù)提供商和組織者失職,可以就以下要求請求保護(根據(jù)消費者法第100條):
 
to)refund of the deposited price;
返還保證金;
 
b) repatriation in case of trips in foreign countries
在國外履行過程中被遣返
The fund also has to give an immediate economic availability in case of forced reentry of tourists from non – European Countries on the occasion of emergencies due to the organizer’s behaviour.
如果是因為組織者行為而導(dǎo)致發(fā)生歐盟以外的國家強制遣返的緊急情況,基金會將立即提供經(jīng)濟協(xié)助。
