聯(lián)合投標(biāo)協(xié)議書(shū) （中英文）
          CONSORTIUM AGREEMENT

乙方：Party B
 
丙方: Party C
 
  甲方與乙方及丙方就招標(biāo)編號(hào)為        的招標(biāo)項(xiàng)目投標(biāo)有關(guān)事宜，經(jīng)各方充分協(xié)商一致，達(dá)成如下協(xié)議：
Party A,Party B and Party C fully agree on with respect to the bidding project No               , and arrive at the following agreement:
 
一、由甲方牽頭，乙方和丙方參加，組成聯(lián)合體共同進(jìn)行本招標(biāo)項(xiàng)目的投標(biāo)工作。
Party A as a leader, and Party B, Party C as members, form a CONSORTIUM to make a joint bidding for the project.
 
二、              為本次投標(biāo)的主體單位，聯(lián)合體以主體方的名義參加投標(biāo)，聯(lián)合體中標(biāo)后，聯(lián)合體各方共同與招標(biāo)方簽訂合同，就本中標(biāo)項(xiàng)目對(duì)招標(biāo)方承擔(dān)連帶責(zé)任。
          is the leading party for the tender, and the CONSORTIUM submit a bid on the behalf of the leading party, if the CONSORTIUM is awarded, all members of the CONSORTIUM sign a contract with the employer and assume joint and several liability for the employer on the project.
 
三、主體方負(fù)責(zé)        等工作；參加方          、         負(fù)責(zé)         工作。
The leader is in charge of        works; and the members        ,       and        complete         works.    
 
四、       負(fù)責(zé)              等工作，具體工作范圍、內(nèi)容以合同為準(zhǔn)。

五、各方對(duì)于分享項(xiàng)目成果和知識(shí)產(chǎn)權(quán)的約定為：
 The agreement for sharing results and intellectual property of the projects is:
 
七、各方的責(zé)任、權(quán)利、義務(wù)，在中標(biāo)后經(jīng)各方協(xié)商后報(bào)招標(biāo)方同意另行簽訂協(xié)議或合同。
The responsibility, right and obligation of members, consulting with each other on them and by agreement of the employer after award, are stated in further agreement or contract.
 
八、各方不得再以自己名義在本項(xiàng)目中單獨(dú)投標(biāo)。聯(lián)合投標(biāo)的項(xiàng)目責(zé)任人不能作為其它聯(lián)合體或單獨(dú)投標(biāo)單位的項(xiàng)目組成員。因發(fā)生上述問(wèn)題導(dǎo)致聯(lián)合體投標(biāo)成為廢標(biāo)，聯(lián)合體的其他成員可追究違約行為。
Each member shall not make a bid in this project in one’s own name. The leader shall not be a member of other CONSORTIUMS or solo bid party. If the CONSORTIUM bid becomes abandoned tender due to the problems above, other members of CONSORTIUM can take actions against his breach.
 
九、未中標(biāo)，本協(xié)議自動(dòng)廢止。
If the contract is not awarded to the CONSORTIUM, the agreement shall automatically be terminated.

 投標(biāo)聯(lián)合體授權(quán)主辦方協(xié)議書(shū)
                    The Agreement Authorized Leader by CONSORTIUM
 
(聯(lián)合體各方名稱(chēng))，         ，       組成聯(lián)合體，參加招標(biāo)編號(hào)為                                  的項(xiàng)目共同投標(biāo)，我單位現(xiàn)授權(quán)(聯(lián)合體主辦方名稱(chēng))為本投標(biāo)聯(lián)合體主辦方，聯(lián)合體主辦方負(fù)責(zé)投標(biāo)項(xiàng)目的一切組織、協(xié)調(diào)工作，并授權(quán)投標(biāo)代理人以聯(lián)合體的名義參加項(xiàng)目的投標(biāo)，代理人在投標(biāo)、開(kāi)標(biāo)、評(píng)標(biāo)、合同談判過(guò)程中所簽署的一切文件和處理與本次招標(biāo)有關(guān)的一切事務(wù)，聯(lián)合體各方均予以承認(rèn)并承擔(dān)法律責(zé)任。
本授權(quán)有效期至本次招投標(biāo)有關(guān)事務(wù)結(jié)束止。
(The names of members),    and        form a CONSORTIUM, and make a joint bid for the project No        , now we authorize XX (the name of CONSORTIUM) as the leader of CONSORTIUM and the leader is in charge of all organization and coordination work for bidding, and authorize tender agent to bid on the behalf of CONSORTIUM, and then all the members acknowledge and bear legal the liability for all documents signed and events dealt relating to the bid in the process of bidding, bid opening, bidding evaluation and contract negotiation by tender agent.
The authorization is valid until the related events of the bid ends.
