It is on this date mutually agreed between the undersigned parties for the following terms and conditions:
經(jīng)雙方友好協(xié)商,達(dá)成如下協(xié)議:
1.Performing vessel particulars (載貨船舶狀況):

Owner has the right to choose substitute vessel upon advanced advice at least 3 days .before lay/can:
船東有權(quán)選擇替代船,但必須至少提前船期三天通知租家。

運(yùn)費(fèi)率: 美元/噸,船東不負(fù)責(zé)裝貨、卸貨和平艙,一港裝一港卸
7.1 30% down payment by T.T within 3 working days from date of this C/P.
30%的海運(yùn)費(fèi)作為保證金,在簽完此合同 3天之內(nèi)一電匯的方式打到船東的指定賬戶。
7.2 Exact carrying quantity to be determined by draft survey. total freight less 30% prepaid shall be paid through t/t within 2 banking days after completion of loading.
實(shí)際裝運(yùn)的數(shù)量由吃水檢量決定。總運(yùn)費(fèi)扣除30%預(yù)付款在裝貨完成后的2個(gè)銀行工作日內(nèi)電匯支付。
7.3 Freight deemed earned once cargo on board, non-returnable, non-deductable, whether cargo/vessel lost or not.
一旦貨物裝船, 運(yùn)費(fèi)視為已賺取,不能返還, 不能折扣,無論貨物/船舶滅失與否。
8. Loading rate: MT PWWD FSHINC
裝貨率:每個(gè)晴天工作 日噸,星期五、星期日和節(jié)假日包括在內(nèi)。
Discharging rate: MT PWWD SSHINC
卸貨率:每個(gè)晴天工作日 噸,星期六、星期日和節(jié)假日包括在內(nèi)。
9. Demurrage: USD per day or pro rata. once on demurrage, always on demurrage. demurrage incurred at loading port to be paid through T/T within 2 banking days from completion of loading. demurrage incurred at discharge port to be paid through t/t within 3 banking days from completion of discharge.
滯期費(fèi):每天 美元,不足一天按比例計(jì)算。一旦滯期,永遠(yuǎn)滯期。裝貨港產(chǎn)生的滯期費(fèi)在裝貨完成后的2個(gè)銀行日內(nèi)電匯支付。 卸貨港產(chǎn)生的滯期費(fèi)在卸貨完成后的3個(gè)銀行日內(nèi)電匯支付。
10. Nor shall be tendered on vessel’s arrival at pilot station or quarantine anchorage of loading/ discharging port at any time day or night, Sunday & holiday included, whether in berth or not, whether free pratique or not, whether customs cleared or not.
就緒通知書在船舶到達(dá)裝/卸港引水站或檢疫錨地時(shí)提交,無論白天和黑夜,包括節(jié)假日和星期天,無論是否檢疫,是否清關(guān),是否靠泊。
11. Laytime calculation: laytime for loading and discharging shall commence 12 hours after tendering nor. time actually used before commencement and time lost in waiting for berth to be counted. separate laytime for loading and discharging.
裝卸時(shí)間的計(jì)算:裝卸時(shí)間在遞交就緒通知書后的12小時(shí)開始起算。裝卸時(shí)間開始前實(shí)際使用的時(shí)間和等泊位的時(shí)間計(jì)入裝卸時(shí)間。裝貨與卸貨時(shí)間分開計(jì)算。
12. Charterers guarantee that cargo, documents and gears shall be ready upon vessel's arrival at the port. otherwise, if loading not to be commenced 96 hours after vessel’s arrival because of above mentioned reasons, owners shall have the right to withdraw vessel and claim relevant loss.
租家保證船舶抵港時(shí),貨物、單證和裝卸設(shè)備已備妥。否則,在船舶抵達(dá)裝港48小時(shí)后,因?yàn)樽饧业纳鲜鲈蛉圆荒苓M(jìn)行裝貨作業(yè),船東有權(quán)撤船,并索賠相關(guān)損失。
13. In absence of original BS/L at discharging port, master/owr/ owr’s agent shall allow cargo to be discharged against consignee or notify party’s letter of indemnity in owr’s standard p&i club wording without bank guarantee or endorsement.
如果正本提單在船舶到港之前不能到達(dá)卸貨港,船長(zhǎng)/船東/船東代理應(yīng)允許憑收貨人或通知方的按照船東互保協(xié)會(huì)格式的沒有銀行擔(dān)保的保函卸貨.
14. Taxes/dues on cargo to be for charterer’s account, same on vessel/freight to be for owner’s account.
因貨物產(chǎn)生的稅費(fèi)由租家承擔(dān), 因船舶和運(yùn)費(fèi)產(chǎn)生的稅費(fèi)由船東承擔(dān)。
15. Owners should advise charterer 5/3/2/1 days before arrival at loading/ discharging port.
在船到達(dá)裝港或卸港前,船東需提前5/3/2/1天向租家通報(bào)船舶預(yù)抵動(dòng)態(tài)。
16. Lighterage/lightering/shore crane/floating crane/shifting, if any, shall be for charterers’ time and account at bends.
如果在裝卸港需要安排駁船/過駁/岸吊/浮吊/移泊,由租家承擔(dān)時(shí)間和費(fèi)用。
17.Oowrner’s agent at both ends. 裝卸港代理由船東指定。
18. Disputes, if any, to be setteled at sub-commission of china maritime arbitration commission,English law to apply.
如發(fā)生爭(zhēng)議,應(yīng)在中國(guó)海事仲裁委員會(huì)廣東分會(huì)解決,適用英國(guó)法。
19. On discrepancy between Enlish and Chinese, English to apply.
中英文如有差異,以英文為準(zhǔn)。
20. Others as per GENCON94.其它未盡事宜依據(jù)金康合同94年版。

柬埔寨旗,1982年造,船長(zhǎng)/型寬/船高:76/12/6m,載重噸/吃水 2500mt,總噸/凈噸 1528/1010mt 散裝艙容/包裝艙容3700/3600cbm,1船艙/1艙口 ,鋼甲板,吊桿12mtx2
2)Cgo:2000mt cotton seed meal in bulk,5%moloo,S.F 1.8
貨物:2000mt 散裝棉籽粕,5%增減由船東選擇,積載因素 1.8
3) L/P:1sbp Dalain, China 裝港:中國(guó)大連 1個(gè)安全港口1個(gè)安全泊位
4) D/P:1sbp Inchon, Korea 卸港:韓國(guó)仁川 1個(gè)安全港口1個(gè)安全泊位

(注:所謂受載期是指船舶到達(dá)裝港并做好裝貨準(zhǔn)備的期限。)
6) L/D RATE:CQD BENDS 裝卸效率:按港口習(xí)慣速度盡快裝卸
7)Detention charges at the rate of usd2500 per day or pro-rata, if time lost in waiting for cargo and/or documents at both ends.
detention charges incurred at loading port, if any, to be settled together with freight payment and which incurred at discharging port, to be settled before commence of discharging.
滯留損失:如果船舶在雙邊港口因貨物和/或單證未備妥而遭受船期損失,租船人應(yīng)每日支付usd2500,不足一天按比例計(jì)算。
滯留損失費(fèi)在裝港發(fā)生的話,連同運(yùn)費(fèi)一起支付,若在卸港發(fā)生,則在卸貨開始前支付。
8) FREIGHT:USD9/MT,FIOST,BASIS 1/1
運(yùn)費(fèi):Usd9/Mt,Fiost(船東不管裝,卸,理艙,平艙),一裝一卸
編輯附注:
LINER TERMS:由船東負(fù)責(zé)裝卸。
FIO:FREE IN AND OUT,船東不管裝,不管卸。
FIOST:FREE IN AND OUT,STOWED,TRIMMED,船東不負(fù)責(zé)裝卸及理艙,平艙。
FILO:FREE IN LINER OUT,船東不管裝管卸。
LIFO:LINER IN FREE OUT,船東管裝不管卸。
9) Full freight WB paid to owrs nominated bank acct W/I 2 bank days ACOL N S/R Bs/L which marked ‘FRT PREPAID’. full freight to be deemed as earned with discountless and non-returnable on cargo shipped on board whether ship and/or cargo lost or not lost.
所有運(yùn)費(fèi)在裝完貨并簽發(fā)預(yù)付運(yùn)費(fèi)提單后兩個(gè)銀行工作日內(nèi)付至船東指定帳號(hào)。所有運(yùn)費(fèi)在裝完貨后即視為已賺取,不得扣減,無須返還,無論船舶和/或貨物滅失與否。
10) Owrs agent bends.兩邊港口由船東指定代理。
11) L/S/D IF ANY CHTR’S ACCT 捆扎/加固/墊艙費(fèi)如有發(fā)生,由租船人承擔(dān)。
12) Lighterage/lightering if any chtrs acct
駁船費(fèi)/過駁費(fèi)如發(fā)生由租船人承擔(dān)。
13) Shipside /dockside tally TBF owrs/chtrs acct
船邊理貨/岸邊理貨分別由船東/租船人承擔(dān)。
14) Taxes/dues on CGO/FRT TBF chtrs/owrs acct
關(guān)于貨物/運(yùn)費(fèi)的稅費(fèi)分別由租船人/船東承擔(dān)。
15) Fumigation:fumigation if any to be for chtr’s acct. owr allow 24hrs for fumigation, chtr should compensate owr usd1500 for crews hotel/traffic/ accomodation charges.
熏艙:如果需要熏艙的話,由租船人承擔(dān)熏蒸費(fèi)用。船東允許熏艙24小時(shí),租船人需補(bǔ)償船東usd1500,作為船員食宿交通費(fèi)用。
16) Dispute to be settled by arbitration in hk and english law to be applied.
如有爭(zhēng)議,在香港仲裁并適用英國(guó)法。
