Trade unions and employers associations shall issue their own constitutions. The constitutions may include inter alia the following;
工會和雇主協(xié)會將頒布各自的章程,章程可特別包括下列內(nèi)容:
 
       1) name of the organization;    組織名稱;
       2) address of the head office of the organization;    組織的總部地址;
       3) purpose of the organization;     組織的目的;
       4) date of formation of the organization;   組織成立的日期;
       5) emblem of the organization;     組織的標(biāo)志;
       6) qualifications for leadership;    領(lǐng)導(dǎo)人的資格;
       7) contribution of its members;      其成員的組成;
        8) financial and property administration of the organization;  組織的財(cái)政及財(cái)產(chǎn)管理;
        9) meeting and election procedures;     會議及選舉程序;
        10) disciplinary measures; and    紀(jì)律性措施;及
         11) the conditions for dissolving the organization.    解散組織的條件。
12) Status of the property in case of the dissolution of the organization 解散組織時的財(cái)產(chǎn)狀況。
 
118. Registration of Organizations   組織的注冊
1) Every organization shall be registered by the Ministry in Accordance with this Proclamation;
        每個組織必須根據(jù)本公告由部門登記;
 
2) Every organization shall, upon its establishment, submit to the Ministry for registration the following documents:
        一旦組織成立,必須向部門呈報(bào)下列文件以便注冊:
 
 (a) constitution of the organization;        組織的章程;
 (b) a document containing the names; address and signatures of its leader;
        包括名稱、地址及其領(lǐng)導(dǎo)簽字的文件;
 
 (c) in the case of a general union, the names of undertakings where members are working;
        關(guān)于成員們工作的企業(yè)總工會的名稱;
 
  (d) where the organization is a federation or a confederation, the names, address and signatures of their leaders and the member trade unions or employers’ associations;
  若此組織屬于聯(lián)合會或同盟,其領(lǐng)導(dǎo)及其成員工會或雇主協(xié)會的名稱、地址及簽字;
 
(e) name and emblem of the organization;     此組織的名稱及標(biāo)志;
3) The Ministry shall, after examining the documents and ascertaining that they are duly completed, issue a certificate of registration within fifteen days of receiving the application. Where the Ministry does not notify its decision within this period, the organization shall be deemed registered;
在檢查并確認(rèn)這些文件充分完成之后,部門必須在收到申請書的15天內(nèi)簽發(fā)注冊證,若在此期間部門未通知其決定,此組織將被視為已注冊。
 
4) An organization which is not registered in accordance with the provisions of this Proclamation may not perform activities set forth in this Proclamation;
根據(jù)本公告的規(guī)定未注冊的工會組織不能開展本公告提出的活動;
 
5) A trade union or employers association registered by the Ministry in accordance with this Proclamation shall have legal personality and in particular, have the capacity to undertake the following activities;
根據(jù)本公告,經(jīng)部門登記的工會或雇主協(xié)會將具有法人資格,特別是具有從事下列活動的能力:
 
        (a) to enter into contract;        參與締約;
        (b) to sue and be sued;         起訴和被起訴;
         (c) to own, use and transfer property;         擁有、使用并轉(zhuǎn)移財(cái)產(chǎn);
         (d) to represent members at any level, and     代表任何級別的成員,并
        (e) to perform any legal act necessary for the attainment of its purposes.
        實(shí)施為達(dá)其目的的任何必要的合法行為。
 
119. Refusal to Register    注冊的拒絕
The Ministry may refuse to register an organization for anyone of the following reasons.
因下列任何一條理由,部長可以拒絕登記:
 
1) Where the organization does not fulfill the requirements laid down in this Proclamation, regulations and directives issued in accordance with this Proclamation;
       當(dāng)組織未履行本公告中規(guī)定的要求及根據(jù)本公告頒布的規(guī)章和指令時;
 
2) where the objectives and the constitution of the organization are illegal;
當(dāng)組織的目標(biāo)及章程違法時;
 
3) where the name of the organization is similar to another organization established prior to it or so closely similar as to confuse its members and the general public in any manner; or
若組織的名稱先之于登記成立的另一方組織的名稱相同,或非常相似,以致其成員及普通公眾發(fā)生混淆;或
 
4) where one or more than one of those elected as leaders of the organization have been convicted and punished, within the late ten years, of serious, nonpolitical offences and the organization is not willing to substitute them by others.
被選為該組織的領(lǐng)導(dǎo)中,有一個或一個以上在最近10年內(nèi)曾被判為嚴(yán)重的非政治罪,而該組織又不愿由別人替換他們。
 
120. Cancellation of Registration    取消注冊
1) The Ministry may apply to the competent court to cancel the certificate of registration of an organization, on anyone of the following grounds:
出現(xiàn)下列情形之一,部門可向主管法庭申請取締組織的注冊證:
 
 (a) where the certificate of registration is obtained by fraud or mistake or deceit;
若通過假冒、錯誤或欺騙得到注冊證;
 
 (b) where anyone of the objectives or constitution of the organization is found to be illegal under this Proclamation and the organization is not willing to remedy or correct the illegal provisions or conditions, or
根據(jù)本公告,如發(fā)現(xiàn)該組織的任何一個目標(biāo)或章程是非法的,而該組織又不愿補(bǔ)救或糾正這些非法規(guī)定或條件;或
 
 (c) where the organization is found to have engaged in activities which are prohibited under this Proclamation or performed acts which are contrary to its purposes and constitution and it is not willing to cease or remedy or eliminate them.
若發(fā)現(xiàn)該組織從事本公告禁止的活動,或從事與其目的和章程相反的行為,而該組織又不愿意停止、補(bǔ)救或清除這些行為。
 
2) The Ministry may upon request by an organization ensure that the organization is dissolved in such manner as it thinks appropriate.
一旦組織請求,部門可以保證以其認(rèn)為合適的方式解散該組織。
 
121. Notice to Cancel Registration organization    取消注冊的通知
1) The Ministry shall before applying for the cancellation of the registration of an organization in accordance with sub-article 1of Article 120, give to the concerned organization one month prior notice specifying the reasons for the cancellation and the opportunity to oppose it. The Ministry may not specify any reason other than those enumerated in sub-article 1 of Article 120.
根據(jù)第120條附款1)的規(guī)定,在取消組織的注冊之前,部門必須給予有關(guān)組織一個月的時間說明取消注冊的理由及反對的機(jī)會。對于除第120條附款1)中列舉的理由外的任何理由,部門可不做說明。
 
2) Where the one month period of notice provided for in sub-article (1) of this Article has expired and the organization does not oppose the notice or the opposition is considered groundless by the ministry, the Ministry may apply to the competent court for the cancellation of registration.
若本條附款1)中規(guī)定的一個月的通知時間到期,而該組織未反對此通知,或部門認(rèn)為反對無理,部門可以申請主管法院取消該注冊。
 
3) without prejudice to sub-article 2 of this Article the Ministry may suspend the organization to refrain from the act which is prohibited by the proclamation or contrary to its objectives and the constitution which may give rise to cancellation of the certificate as provided for under sub-article l(c) of Article 120 of this Proclamation.
不違反本條附款2)的規(guī)定,若組織從事違反本公告或與其指令和章程相反的行為而導(dǎo)致如本公告第120條附款1)c)中規(guī)定的取消證件,部門可阻止其行為。
 
122. Appeal    控訴
Where the Ministry refuses registration of the organization, the organization may appeal to the competent court within fifteen days (15) from the date of the receipt of the decision in writing. During the hearing, the Ministry shall be given the opportunity to appear before the court and forward its opinion.
若部拒絕注冊該組織,該組織可從接到書面通知之日起15天內(nèi)向主管法院控訴。在聽證期間,將給予部出庭機(jī)會,并可申述其意見。
 
123. Consequence of Cancellation of Registration or upon request by the Organization
        注冊被撤銷或組織請求撤銷的結(jié)果
 
An organization shall be deemed dissolved where the registered organization is dissolved by a decision of a court or upon request by the organization to the Ministry and is dissolved from the day a decision is made.
自法院決定撤銷已注冊的組織或該組織向部申請撤銷之日起,該組織將視為已被撤銷。
 
CHAPETER TWO Collective agreement第二章 集體協(xié)議
SECTION ONEGeneral第一節(jié) 總則
124. Definition    定義
1) "Collective agreement" means an agreement concluded in writing between one or more representative of trade unions and one or more employers or agents or representatives of employers organizations.
 “集體協(xié)議”指工會的一個或以上的代表與一個或以上的雇主、或代理人或雇主協(xié)會的代表之間書面締結(jié)的協(xié)議。
 
2) "Collective Bargaining" means a negotiation made between employers and workers organizations or their representatives concerning conditions of work or collective agreement or the renewal and modifications of the collective agreement.
 “集體磋商”指雇主與工人組織或其有關(guān)工作條件的代表之間就集體協(xié)議或該集體協(xié)議的更新和修改所進(jìn)行的談判。
 
125. Collective bargaining    集體磋商
1) Trade union shall have the right to bargain a collective agreement with one or more employers or their organization in matters provided for in Article 128.
工會有權(quán)與一個或以上的雇主或其組織就第128條中規(guī)定的事務(wù)進(jìn)行集體磋商。
 
2) Employer or employer's associations shall have the right to bargain a collective agreement with their workers organized in a trade union.
雇主或雇主協(xié)會有權(quán)同以工會形式組織的工人磋商集體協(xié)議。
 
126. Representation     代表
1) The following shall have the right to represent workers during collective bargaining.
        在集體磋商期間,下列人員有權(quán)代表工人:
 
 (a) Where there is a trade union, the leaders of the union who are empowered to represent the workers during collective bargaining.
        如有工會,授權(quán)的工會領(lǐng)導(dǎo)人在集體磋商期間代表工人。
 
 (b) where there is a general trade union, the leaders of the union, who are authorized in accordance with the constitution of the union.
        如有總工會,根據(jù)工會章程被授權(quán)的工會領(lǐng)導(dǎo)人。
 
2) The person who represents the employer shall be the concerned employer or employers or those who are delegated by more than one employer’s associations.
代表雇主的將是相關(guān)的雇主或雇主或由一個或以上的雇主協(xié)會授權(quán)的那些人員。
 
127. Advisors    顧問
Any bargaining party to a collective agreement may be assisted by advisors who render expert advice during the negotiation.
任何參加集體協(xié)議磋商的一方可接受在談判期間給予其專門指導(dǎo)的顧問的協(xié)助。
 
128. Subject Matter of a Collective Agreement   集體協(xié)議的從屬事務(wù)
Matters concerning employment relationship and conditions of work as well as relations of employers and their organizations with workers' organizations may be determined by collective agreement.
有關(guān)雇傭關(guān)系、工作條件以及雇主與其組織同工人的組織的關(guān)系的有關(guān)事務(wù),可在集體協(xié)議中決定。
 
129. Contents of the Collective Agreement    集體協(xié)議的內(nèi)容
Without prejudice to the generality of Article 128 of this Proclamation, the following may inter alia, be determined by collective agreement:
在不違反本公告第128條之通則的情況下,下列有關(guān)情況特別由集體協(xié)議決定:
 
1) matters left by the provisions of this Proclamation or other laws to be regulated by collective agreement;
本公告或其他法律遺留的問題待由集體協(xié)議調(diào)整;
 
2) the conditions for protection of occupational safety and health and the manner of improving social services;
        職業(yè)安全、健康及改善社會服務(wù)的條件;
 
3) workers' participation, particularly, in matters regarding promotion, wages, transfer, reduction and discipline;
工人的參與,尤其是對有關(guān)進(jìn)級、工資、調(diào)動、裁員及紀(jì)律等事務(wù)的參與;
 
4) conditions of work, the procedure for making work rules and grievance procedures;
         工作條件、制定工作準(zhǔn)則的程序及糾偏程序;
 
  5) arrangement of working hours and interval break times; 工作時間及間隔休息時間的安排;
6) parties covered by the collective agreement and its duration of validity.
         集體協(xié)議中涉及的幾方及其有效期。
 
130. Procedure for Collective Bargaining    集體磋商的程序
1) A party wishing to conclude a collective bargaining may request the other party in writing. It shall also prepare and submit draft necessary for the negotiation.
愿意締結(jié)合同的一方可書面請求另一方,同時必須準(zhǔn)備并呈報(bào)必要的談判草案。
 
2) The requested party shall within 10 days of receiving the request, appear for collective bargaining.
在收到請求的五天內(nèi),被請求的一方必須對集體磋商表態(tài)。
 
3) The parties shall before commencing collective bargaining draw up the rules of procedure.
雙方在開始集體磋商前必須草擬程序規(guī)則。
 
4) each party shall have the duty to bargain in good faith.  雙方有義務(wù)以良好的誠意進(jìn)行磋商。
5) Issues on which the parties could not reach agreement by negotiations in good faith shall be submitted to the competent labor disputes settlement tribunal.
雙方就不能以良好的誠意談判達(dá)成協(xié)議的問題,將提交至主管勞務(wù)糾紛的法庭。
 
6) Parties to a collective agreement that is enforced shall decide to amend or replace their collective agreement within 3 months before the validity date expires. Each Party, after having decided to amend or replace the collective agreement, shall finalize it within 3 months as of the date of its expiry. If the negotiation is not finalized with the said period of time the collective agreement whose validity date is expired shall cease to be effective.
被強(qiáng)迫簽訂集體協(xié)議的一方將在協(xié)議有效期前三個月內(nèi)決定修改或代替其集體協(xié)議。在決定修改或代替其集體協(xié)議后,每一方將在協(xié)議有效期前三個月內(nèi)結(jié)束其更改。若在上述時間內(nèi)談判未結(jié)束,集體協(xié)議在超過有效期時仍將有效。
 
131. Registration of Collective Agreement    集體協(xié)議的注冊
Upon executing a collective agreement, the parties shall send sufficient copies of the same to the Ministry for registration.
一旦執(zhí)行了集體協(xié)議,雙方將向部呈送一份完整的復(fù)印件以注冊。
 
132, Accession     同意
A collective agreement which has already been signed and registered may be acceded to by others.
已經(jīng)過簽字并注冊了的集體協(xié)議,其他人都必須承認(rèn)。
 
SECTION TWO Conditions of Validity of Collective Agreement第二節(jié) 集體協(xié)議的有效條件
133. Duration of Validity of Collective Agreement     集體協(xié)議的有效期
1) Any provision of a collective agreement which provides for conditions of work and benefits which are less favorable than those provided for under this Proclamation or other laws shall be null and void;
若集體協(xié)議中規(guī)定的工作條件和利益,比本公告及其它法律中的那些規(guī)定更不利,則此規(guī)定無效;
 
2) Unless otherwise decided therein, a collective agreement shall have a legal effect as from the date of signature;
 除非另有決定,集體協(xié)議自簽字之日起便具有法律效力;
 
3) unless expressly stipulated otherwise in a collective agreements, no party may challenge the collective agreement before 3 year from the date of its validity, provided, however, that;
除非在集體協(xié)議中另有規(guī)定,任何一方都不得在其生效日期起的前三年就該集體協(xié)議提出異議,然而,倘若:
 
(a) Upon the occurrence of a major economic change, a challenge to the collective agreement may be submitted to the Minister by either party before the expiry of the fixed time.
一旦出現(xiàn)較大的經(jīng)濟(jì)變化,對集體協(xié)議的異議可在規(guī)定時間到期之前,由任何一方向部長呈報(bào)。
 
 (b) The Minister shall, upon receipt of a challenge to a collective agreement in accordance with this sub-article 3 (a), assign advisor with a view to enabling the two parties settle the matter by agreement. If the two parties fail to settle the matter by agreement, Article 142 of this Proclamation shall apply.
一旦收到根據(jù)本附款3)a) 對集體協(xié)議的異議,部長將指派顧問以使雙方能通過協(xié)商解決該問題。若雙方未能通過協(xié)商解決,本公告第142條規(guī)定將適用。
 
(c) the parties may at any time change or modify their collective agreement, provided, however, that without prejudice to the special conditions set forth in sub-article 3 (a) and (b) of this Article, a party may not be obliged without his consent to bargain a collective agreement to change or modify it before the said time limit expires.
雙方可在任何時候改變或修正其集體協(xié)議,然而,若不損害本條附款3)a)  及b)提出的特殊條件,無需對方同意,可允許一方磋商集體協(xié)議,以便在上述限定時間到期前改變或修正集體協(xié)議。
 
SECTION THREE Scope of Application of a Collective Agreement
第三部分 集體協(xié)議的申請范圍
134. Scope of Application       申請范圍
1) The provision of a collective agreement shall be applicable to all parties covered by it.
   每個集體協(xié)議將適用于該協(xié)議所涉及的所有各方。
 
 2) Where the collective agreement is more favorable to the workers in similar matters than those provided for by law, the collective agreement shall prevail. However, where the law is more favorable to the workers than the collective agreement the law shall be applicable.
在類似的事件中,若集體協(xié)議比法律規(guī)定的更有利,則以集體協(xié)議為準(zhǔn),然而,若法律比集體協(xié)議更有利,則以法律為準(zhǔn)。
 
135. Exception     例外
1) Where a trade union which is a party to a collective agreement is dissolved, the collective agreement shall continue to be valid between the employer and the workers.
若集體協(xié)議的一方的工會被解散,集體協(xié)議在雇主與工人之間將繼續(xù)有效。
 
2) In the case of amalgamation of two or more undertakings, unless decided otherwise by the concerned parties:
對于兩個或更多的企業(yè)合并的情況,除非有關(guān)各方另有規(guī)定:
 
(a) where undertakings which have their own collective agreement are dissolved the collective agreement concluded by more workers before the dissolution shall be deemed as concluded by the others and shall be applicable.
若有其自身集體協(xié)議的企業(yè)被解散合并,在解散前由比較多工人締結(jié)的集體協(xié)議,將被視為其他人締結(jié)的,并將是適用的。
 
(b) where only one of the undertakings has a collective agreement, it shall be applicable to the undertaking which results from the amalgamation.
若僅有其中一個企業(yè)有集體協(xié)議,該協(xié)議將適用于因合并而成立的企業(yè)。
 
 (c) where the number of workers of all of the undertakings, are equal and they have their own collective agreements, the one more favorable in general, shall be applicable.
若所有企業(yè)的工人數(shù)相等,而他們又都有自己的集體協(xié)議,一般來說,更有利的那個集體協(xié)議將是適用的。
 
3) Where an undertaking is amalgamated or divided, the provisions of Sub-Article (2) of this Article shall, mutatis mutandis, apply.
若企業(yè)合并或分離,在已作必要修正的前提下,本條附款2)的規(guī)定將適用。
 
PART NINE Labor Dispute第九部分 勞務(wù)糾紛
CHAPTER ONE General第一章總則
136. Definitions     定義
  In this Proclamation:    本公告中:
1) "conciliation" means the activity conducted by a private person or persons appointed by the Ministry at the joint request of the parties for the purpose of bringing the parties together and seeking to arrange between them voluntary settlement of a labor dispute which their own efforts alone do not produce;
 “調(diào)解”指應(yīng)雙方的聯(lián)合請求,為使雙方一起并尋求通過其自身努力不能自愿解決勞資糾紛之目的,由部指派的某個人或多人實(shí)施的活動。
 
2) "essential public services undertakings" means those services rendered by undertakings to the general public and includes the following:
“必要的企業(yè)服務(wù)”指由企業(yè)向公眾提供的那些服務(wù),并包括以下情況:
       (a) air transport;     空運(yùn);
        (b) undertakings supplying electric power;     供給電力的企業(yè);
        (c) undertakings supplying water and carrying out city cleaning and sanitation services;
        供水及執(zhí)行城市清潔、衛(wèi)生服務(wù)的企業(yè);
 
        (d) urban bus services;     城市公共汽車服務(wù);
        (e) hospitals, clinics, dispensaries and pharmacies; 醫(yī)院、附屬醫(yī)院、診療所及藥店;
        (f) fire brigade services; and    消防服務(wù);及
        (g) telecommunication services;     通訊服務(wù);
        3) "labor dispute" means any controversy arising between a worker and an employer or trade union and employers in respect of the application of law, collective agreement, work rules, employment contract or customary rules and also any disagreement arising during collective bargaining or in connection with collective agreement:
 “勞資糾紛”指在工人與雇主或工會與雇主之間, 關(guān)于法律、集體協(xié)議、工作準(zhǔn)則、雇傭合同、習(xí)慣準(zhǔn)則的應(yīng)用而引起的爭論,及在集體磋商期間,或有關(guān)集體協(xié)議引起的不同看法。
 
4) "lock-out" means an economic pressure applied by closing a place of employment in order to persuade workers to accept certain labor conditions in connection with a labor dispute or to influence the outcome of the dispute;
“停工”指為說服工人接受有關(guān)勞務(wù)糾紛,或影響糾紛后果的某些勞務(wù)條件,通過關(guān)閉雇傭地所應(yīng)用的經(jīng)濟(jì)壓力。
 
5) "Strike" means the slow-down of work by any number of workers in reducing their normal out-put on their normal rate of work or the temporary cessation of work by any number of workers acting in concert in order to persuade their employer to accept certain labor conditions in connection with a labor dispute or to influence the outcome of the dispute.
 “罷工”指為說服其雇主接受有關(guān)勞務(wù)糾紛或影響糾紛后果的某些勞動條件,由一些工人集體行動在正常工作效率下減少工作產(chǎn)量或暫時停止工作的怠工行為。
 
CHAPTER TWO Labors Courts第二節(jié) 勞工法院
137. Establishment of Labor Divisions    勞工分部的建立
1) There shall be set up labor divisions, as may be necessary, at each regional first instance court, each regional court which hears appeals from regional first instance courts and at the Central High Court.
若有必要,在每個初審法院、接受初審法院上訴的地區(qū)法院和高等法院應(yīng)建立勞工分部。
 
2) The Minister shall submit the number of labor divisions to be established in accordance with Sub-Article (1) of this Article to be determined by the appropriate authority.
根據(jù)本條附款1)部長應(yīng)提交擬建勞務(wù)分部的數(shù)目,并由有關(guān)機(jī)關(guān)決定。
 
138. Labor Division of the Regional First Instance Court  地區(qū)初審法庭勞工分部
1) The labor division of the regional first instance court shall have jurisdiction to settle and determine the following and other similar individual labor disputes;
地區(qū)初審法庭勞工分部將擁有解決和決定下列及其它類似情況的個人勞資糾紛的司法權(quán):
        (a) disciplinary measures including dismissal;     紀(jì)律性措施包括解雇;
        (b) claims related to the termination or cancellation of employment contracts;
        有關(guān)雇傭合同終止或取消的索賠;
 
        (c) questions related to hours of work, remuneration, leave and rest day;
       有關(guān)工作時間、報(bào)酬 、休假及休息日的問題;
 
       (d) questions related to the issuance of certificate of employment and release;
       有關(guān)雇傭證書頒布和發(fā)行的問題;
 
       (e) claims related to employment injury;    有關(guān)工傷的索賠;
       (t) unless otherwise provided for in this Proclamation, any criminal and petty offences under this Proclamation.
        除非本公告另有規(guī)定,本公告中的任何犯罪及小的過失。
 
2) The labor division of the regional first instance court shall give decisions within 60 days from the date on which the claim is lodged.
地區(qū)初審法庭勞工分部必須在要求提出之日起60天內(nèi)作出決定。
 
3) The party who is not satisfied with the decision of the regional first instance court may, within 30 days from the date on which the decision was delivered, appeal to the labor division of the regional court which hears appeals from the regional first instance court.
對地區(qū)初審法庭判決不滿的一方可在判決發(fā)出之日起30天內(nèi)向聽取地區(qū)初審法庭控訴的地區(qū)法院勞資分部上訴。
 
139. The Labor Division of the Regional Appellate Court   地區(qū)控訴法院勞資分部
1) The labor division of the regional court which hears appeals from the regional first instance court shall have jurisdiction to hear and decide on the following matters:
聽取地區(qū)初審法庭控訴的地區(qū)法院勞資分部將具有就下列問題的審判和判決權(quán):
 
 (a) appeals submitted from the labor division of the regional first instance courts in accordance with Article 138 of this Proclamation;
根據(jù)本公告第138條規(guī)定,由地區(qū)初審法院勞資分部呈送的控訴;
 
 (b) objections on question of jurisdiction;     對審判的否決;
(c) appeals submitted against the refusal of the registration of an organization by the Ministry in accordance with Article 122 of this Proclamation;
根據(jù)本公告第122條規(guī)定,針對組織的注冊被部拒絕而提交的控訴;
 
(d) appeals submitted by an employer who is affected by the order of labor inspector in accordance with Article 180 (1) of this Proclamation;
根據(jù)本公告第180條附款1)的規(guī)定,受勞資檢查員命令影響的雇主呈送的控訴;
 
(e) appeals submitted against the decision of the Ministry in accordance with Sub-Article (3) of Article 20.
根據(jù)第20條附款3)的規(guī)定,針對部的決定提交的控訴;
 
  (f) request submitted for the cancellation of the registration of an organization in accordance with Sub-Article 2 of Article 121.
  根據(jù)第121條附款2)的規(guī)定, 為取消組織的注冊提交的請求。
 
2. The decision of the court on appeal submitted under Sub-Article (1) of this Article shall be final.
本條附款1)中提交控訴的法院,其判決為終審判決。
 
3. The Regional appellate labor division court shall make decision within 60 days from the date of the appeal lodged in accordance to sub-Article 1 of this Article.
根據(jù)本條附款1)的規(guī)定,受理上訴的勞資分部法庭應(yīng)在上訴提出后60天內(nèi)作出判決。
 
140. The Labor Division of the Federal High court    聯(lián)邦高級法院勞資分部
1) The labor division of the Federal High Court shall have jurisdiction to hear and decide on appeals against the decision of the Board on question of law in accordance with Article 154 of this Proclamation.
根據(jù)本公告第154條規(guī)定,聯(lián)邦高級法院勞資分部有權(quán)審判并裁決針對法律委員會的裁決所提出的控訴。
 
2) The decision of the court under Sub-Article (1) of this Article shall be final.
本條附款1)中提及的法院的判決為終審判決。
 
CHAPTER THREE Conciliation第三章 調(diào)停
141. Assignment of Conciliator    調(diào)停人的任命
1) When a dispute in respect of matters specified under Article 142 is reported to the Ministry by either of the disputing parties, it shall assign a conciliator to bring about a settlement of the case.
與第142條的規(guī)定的問題相關(guān)的糾紛,由爭議中的任何一方報(bào)告給部,部必須任命一名調(diào)停人以解決該問題。
 
2) The Ministry may assign conciliators at the National and when necessary at the Wereda level.
部可任命國家級或地區(qū)級調(diào)停人,必要時可任命縣級調(diào)停人。
 
142. Duties and Responsibilities of the Conciliator    調(diào)停人的義務(wù)和責(zé)任
1) The conciliator appointed by the Ministry shall endeavor to bring about a settlement on the following, and other similar matters of collective labor disputes:
部委派的調(diào)停人應(yīng)盡力解決下列集體勞資糾紛及其它類似問題:
 
         (a) wages and other benefits;       工資及其它利益;
         (b) establishment of new conditions of work:     新工作條件的建立;
         (c) the conclusion, amendment, duration and invalidation of collective agreements:
         集體協(xié)議的締結(jié)、修正、持續(xù)期和廢除;
 
  (d) the interpretation of any provisions of this Proclamation, collective agreements or work rules;
        本公告、集體協(xié)議或工作準(zhǔn)則中任何規(guī)定的解釋;
 
(e) procedure of employment and promotion of workers;    雇傭程序及工人的晉級;
 (f) matters affecting the workers in general and the existence of the undertaking;
        基本上影響工人和企業(yè)生存的問題;
 
 (g) claims related to measures taken by the employer regarding promotion, transfer and training.
        涉及雇主采取的關(guān)于晉級、調(diào)動及培訓(xùn)措施的要求;
 
  (h) claims relating to the reduction of workers.    有關(guān)工人減員的索賠。
2. The conciliator shall endeavor to bring about a settlement by all reasonable means as may seem appropriate to that end.
調(diào)停人必須盡力通過盡可能適當(dāng)?shù)?,所有合情合理的手段來解決問題。
 
3. whenever the conciliator fails to settle a labor dispute within 30 days, he shall report with detailed reason thereof to the ministry and shall serve the copy to the parties involved. Any party involved other than those indicated under Sub-Article (1) (a) of this Article may submit the matter to Labor Relation Board. If the dispute as per sub-Article 1 (a) of this Article concerns those undertaking described under Article 136(2) of this proclamation one of the disputing party may submit the case to adhoc Board.
只要調(diào)停人在30天內(nèi)未能解決勞資糾紛,則其必須將詳盡理由向部報(bào)告,并必須向涉及的雙方提供復(fù)印件。其中涉及的而非本條附款1)a) 中提到的任何一方,可將此問題提交至勞務(wù)關(guān)系委員會。若本條附款1)a)中的爭議與本公告第136條附款2)中描述的那些企業(yè)有關(guān),爭議雙方中的任意一方可將此問題提交至臨時委員會。
 
143. Conciliation and Arbitration     調(diào)停及仲裁
1) Notwithstanding the provisions of Article 141 of this Proclamation parties to a dispute may agree to submit their case to arbitrators or conciliators, other than the Minister for settlement in accordance with the appropriate law.
盡管有本公告第141條的規(guī)定,糾紛雙方可同意將其問題提交至仲裁委員會或調(diào)停人,根據(jù)適當(dāng)?shù)姆啥皇且块L解決。
 
2) If the disputing parties fail to reach an agreement on the case submitted to arbitration or conciliation under Sub-Article (1) of this Article the party aggrieved may take the case to the Board or to the appropriate court.
若爭議雙方未能就本條附款1)中涉及的提交到仲裁或調(diào)停委員會的問題達(dá)成協(xié)議,受到法律侵害的一方可將此問題提交至委員會或適當(dāng)?shù)姆ㄔ骸?br />  
CHAPTER FOUR The Labor Relations Board第四章 勞資關(guān)系委員會
144. Establishment of the Board    委員會的成立
1) One or more permanent Labor Relations Boards (here in after referred as permanent Board) may be established in Regional Government.
可在地區(qū)自治政府成立一個或一個以上的永久勞資關(guān)系委員會(以下簡稱永久委員會)。
 
2) The adhoc labor Relation Board (here in after referred as adhoc Board) may be established to hear and decide disputes that may arise on matters specified in sub-article l(a) of Article 142 at undertakings referred to Article 136(2) of this proclamation.
為審理和裁決本公告第136條附款2)中涉及的企業(yè)中,由第142條附款1)a)中規(guī)定的問題產(chǎn)生的爭議,可以建立臨時勞資關(guān)系委員會(以下簡稱臨時委員會)。
 
3) Each permanent or adhoc Board shall be under the local authority responsible for the implementation of labor laws.
每個永久或臨時委員會必須在當(dāng)?shù)仡I(lǐng)導(dǎo)機(jī)關(guān)的領(lǐng)導(dǎo)下對勞動法的實(shí)施負(fù)責(zé)。
 
145. Composition of the Permanent or adhoc Board   永久或臨時委員會的組成
  1) The Board shall consist of a chairman, two qualified members who have the knowledge and skill on labor relation, appointed by the Minister, four members of whom two represent the trade unions and two represent employer's associations, and two alternate members one from the workers side and one from the employer’s side.
委員會將由部長任命的一名主席、兩名擁有勞資關(guān)系知識和技能的合格成員、四名工會的代表,兩名雇主委員會的代表,以及兩名候補(bǔ)成員(一名來自工人方,一名來自雇主方)組成。
 
2) Employers representatives shall be appointed from the most representative of employers associations and workers representatives shall be appointed from the most representative of trade unions.
雇主代表將從雇主協(xié)會中最具代表性的人中選出,工人代表將從工會中最有代表性的人中選出。
 
3) The Minister shall assign a secretary and such other necessary staff to the Board.
部長需向委員會委派一名秘書及其他必要的人員。
 
4) Members and alternate members of the Board shall serve on part time basis without remuneration, provided, however, that the Minister may fix standard fees for attendances at meetings of the Board.
若部長能為出席委員會會議的人員確定標(biāo)準(zhǔn)費(fèi)用,委員會成員及候補(bǔ)成員可不要報(bào)酬而兼職服務(wù)。
 
5) Members and alternate members of the Board shall be appointed for a term of three (3) years; provided, however, that in making the initial appointments, the terms of one, two and three years, respectively, shall be specified so that in each subsequent year the terms of not more than one-third (1/3) of the members and alternate members then serving shall expire in anyone calendar year.
委員會成員及候補(bǔ)成員將任期三年,然而,若在初次任命時,分別是規(guī)定一年、兩年、三年的任期,以便在任意一年內(nèi)有不超過三分之一的成員及候補(bǔ)成員到期。
 
6) The Minister shall dismiss a member in case of negligence of duty or malfeasance in office and shall arrange for the appointment of a substitute for the remaining, unexpired term.
如遇成員失職或?yàn)^職,部長將開除其成員資格,并安排其他成員接替其剩余未到期的工作。
 
146. Meeting procedure of the permanent and the adhoc Board  永久及臨時委員會的會議程序
1) In the absence of the Chairman another member of the Board designated by him as Acting Chairman, shall preside over the meetings of the Board. Where no such member is designated, the member of the Board with the greatest seniority shall serve as Acting Chairman.
在部長缺席時,由其指定的委員會另一成員為代理主席主持委員會會議。若未指定這一成員,委員中資歷最老的那一成員將被視為代理主席。
 
2) In the absence of a member at any meeting of the board, the Chairman may designate an alternate member to replace the absent member at such meetings. An alternate member so designated shall be deemed a member for the meeting for which he is designated.
委員會成員未出席會議,主席可指派一名候補(bǔ)成員代替其參加這樣的會議。這樣經(jīng)指定的候補(bǔ)委員必須視為指定出席該會議的成員。
 
3) Four members of the Board shall constitute a quorum at any meetings provided, however, that a minimum of one member representing workers and one member representing employers shall be present.
若至少有一名成員代表工人,一名成員代表雇主到會,委員會的四名成員將組成任何委員會會議的法定人數(shù)。
 
4) Decision of the Board shall be taken by a majority vote of the members present. In case of a tie, the Chairman shall have a casting vote.
       委員會的決議將由到會的多數(shù)投票表決,若票數(shù)相等,主席必須投決定票。
 
5) Each decision of the Board shall be signed by all members present.
       委員會的每一次決定都必須有所有與會者簽字。
 
6) Minutes of meetings after approval by the Board shall be certified by the secretary and shall thereafter constitute the official record of the said meetings.
經(jīng)委員會批準(zhǔn)后,會議記錄將由秘書證明,并由此構(gòu)成上述會議的正式記錄。
 
147. Power of the permanent and the adhoc Board   永久及臨時委員會的權(quán)力
1) The permanent Board shall have the following power:     永久委員會的權(quán)力如下:
(a) to hear labor disputes on matters specified in sub-article (1) of Article 142, except for (a), to conciliate the parties and to give orders and decisions:
聽取有關(guān)第142條附款1)中除a) 條規(guī)定之外的問題的勞資糾紛,以調(diào)解雙方并發(fā)布指令和決定;
 
 (b) except for sub-article l(a) of Article 142 to hear cases submitted to it by one of the disputing parties after the parties fail to reach an agreement in accordance with sub-article (3) of article 142:
根據(jù)第142條附款,雙方未能達(dá)成協(xié)議時,聽取有爭議的一方提交的除了第142條附款1)a)規(guī)定的情況。
 
(c) to hear cases on prohibited actions referred to in Article 160;
        聽取第160條中提及的被禁止的行為的情況;
 
(d) to require any person or organization to submit information and documents required by the Board for the carrying out of its duties;
為盡其義務(wù),要求任何個人或組織提交委員會要求的信息和文件;
 
 (e) to require parties and witness to appear and testify at hearings;要求各方及見證人出庭作證;
 (f) to administer oaths or take affirmations of persons appearing before the Board and examine any such persons upon such oath or affirmation;
提出在委員會面前出庭的人的誓言,或記錄其證詞,審查有關(guān)這樣的誓言或證詞的任何人。
 
 (g) to enter the premises of any working place or undertaking during working hours in order to obtain relevant information, hear witnesses or to require the submission of documents or other articles for inspection from any person in the premises;
為獲得有關(guān)信息,在工作時間內(nèi)登記任何工作地或企業(yè)的契約,聽取見證人的意見或要求契約中的任何人呈報(bào)調(diào)查資料或其他實(shí)物。
 
2) The adhoc Board shall have the power to hear labor disputes on matters specified in sub-article l (a) of Article 142, to conciliate the parties and to give any orders and decisions.
臨時委員會有權(quán)聽取有關(guān)第142條附款1)a) 中規(guī)定的問題的勞資爭議,以調(diào)和雙方矛盾并給出指令和裁決。
 
3) Except in cases of emergency the person in charge of the premises or the undertaking shall be given reasonable advance notice before any entry in accordance with sub-article 1 (g) of this Article.
根據(jù)本條附款1)g) ,除在危急關(guān)頭,企業(yè)的負(fù)責(zé)人在登記前將被給予提前通知。
 
4) Orders and decisions of the Board shall be considered as those decided by civil courts of law.
委員會的指令及裁決將被認(rèn)為是民事法庭的決定。
 
148. Rules of Procedure    議事規(guī)則
The permanent or the adhoc Board shall issue its own rules of evidence and procedure.
        永久或臨時委員會必須頒布其關(guān)于證據(jù)的法規(guī)及議事規(guī)則。
 
149. Hearings of cases     聽取意見
1) Before giving decisions, the permanent or the adhoc Board shall notify the parties involved and afford them an opportunity to be heard. At least three (3) days advance notice of hearing shall be given to the parties and the notice shall contain in the date, hour and place of hearing.
做出裁決前,永久或臨時委員會必須通知涉及的雙方,并向其提供陳述的機(jī)會。聽取意見的通知至少提前三天送達(dá)雙方,而且通知書應(yīng)包括聽取意見的日期,具體時間及地點(diǎn)。
 
2) If any of the parties or any other person properly summoned to appear at a hearing fails to appear at the fixed time and place, the Board may proceed with the hearing. If failure to appear was not the fault of the person involved the Board shall grant that person a second opportunity to appear before it.
若被傳喚出庭聽取意見的任何一方或任何個人,未在規(guī)定時間和地點(diǎn)出庭,委員會仍可繼續(xù)聽取意見。如未出庭不屬當(dāng)事人的過失,委員會必須給予此人第二次出庭的機(jī)會。
 
3) No appeal may be taken on the Board’s decision given in accordance with Sub-Article (2) of this Article.
   根據(jù)本條附款2),對于委員會做出的裁決,不能提出任何申訴。
 
4) All hearings of the Board shall be public unless the Chairman for good cause decides otherwise.
除非主席有充分的理由決定,委員會所有聽取的意見將是公開的。
 
5) The permanent or the adhoc Board shall not be bound by the rules of evidence and procedure applicable to courts of law, but may inform itself in such manner at it thinks fit.
永久或臨時委員會將不受適用于關(guān)于證據(jù)的法規(guī)及議事規(guī)則的約束,但當(dāng)其認(rèn)為適宜時可參照辦理。
 
6) Trade unions, employers associations and other parties notified to appear at the hearing may be represented by their duly authorized representatives or appointed legal council. The Board may limit the number of such representatives who may actively participate in a hearing on behalf of any single party.
被通知出庭聽取意見的工會、雇主協(xié)會及其他各方可由其適當(dāng)?shù)娜珯?quán)代表或被委任的法律顧問出庭。委員會可限制積極參加聽證會的任何一方代表的人數(shù)。
 
150. Consideration of Matters    問題的審議
1) The permanent or the adhoc Board shall endeavor to settle by agreement Labor disputes submitted to it, and to this end it shall employ and make use of all such means of conciliation, as it deems appropriate.
永久或臨時委員會必須盡力通過協(xié)商解決提交的勞資糾紛, 為此目的,在其認(rèn)為適當(dāng)時,必須使用并充分利用所有這樣的調(diào)解手段。
 
  2) The Board may in appropriate circumstances consider not only the interest of the parties immediately concerned but also the interest of the community of which they are apart and may in such circumstances grant a motion to intervene by the government as amicus curiae.
在適當(dāng)?shù)那闆r下,委員會不僅可以立即審議有關(guān)各方的利益,而且可審議其所屬部分團(tuán)體的利益、國家利益以及經(jīng)濟(jì)利益,在這樣的情況下,可由政府作為法官顧問來協(xié)助解決。
 
3) In reaching any decision, the Board shall take into account the substantial merits of the case, and need not follow strictly the principles of substantive law followed by civil courts.
在達(dá)成任何決議時,委員會必須考慮案情的實(shí)際價(jià)值,不必嚴(yán)格地遵照民事法庭所參照的獨(dú)立存在的法律原則。
 
151. Decisions     決議
1) The permanent or the adhoc Board shall give decision within 30 days from the date on which the claim is lodged.
  永久或臨時委員會必須在要求提出之日起30天內(nèi)作出決議。
 
2) Decisions of the permanent or adhoc Board shall be made in writing and signed by the Board members who concur therein. Dissenting opinions shall also be made in writing and signed by the members in dissent.
永久或臨時委員會的決議需書面作出,同時由委員會成員簽字,不同的意見也需用書面作出,并由持異議者簽字。
 
3) In every decision of the Board the judgment shall contain the following:
       在委員會的每一個決議中,判決必須包括下列情況:
 
(a) the issue or controversy submitted for decision;    提交的決議的問題或爭論;
 (b) the substance and source of relevant testimony and evidence received in the course of the proceedings;
在執(zhí)行過程中得到的相應(yīng)證詞和證據(jù)的梗概及來源;
 
(c) the findings of the fact made and the evaluation of the evidence which leads the Board to make such findings;
       所作的事實(shí)結(jié)論及委員會做出這樣結(jié)論的證據(jù)的估價(jià);
 
 (d) the decision of each issue or controversy;    每個問題或爭論的決議;
 (e) the action to be taken on the basis of such decision.   在這樣的決議基礎(chǔ)上所采取的行動。
4) A copy of the decision of the Board shall be served upon the parties involved within 5 days from the date of decision.
       委員會決議的復(fù)印件將在決議之日起五天內(nèi)送至各方。
 
152. Effect of Decisions     決議的效果
1) Subject to article 154 of this Proclamation, each decision of the permanent or the adhoc Board shall have immediate effect.
        受本公告第154條規(guī)定的支配,永久或臨時委員會的每一份決議將立即生效。
 
2) Where a decision of the permanent or adhoc Board relates to working conditions, it shall be a term of the contract of employment between the employer and the worker, to whom it applies, and the terms and conditions of employment to be observed and the contract shall be adjusted in accordance with its provisions.
若永久或臨時委員會的決議與工作條件有關(guān),該決議將適用于雇主與工人之間的雇傭合同的一項(xiàng),而擬遵守的雇傭條款以及合同將根據(jù)其規(guī)定進(jìn)行調(diào)整。
 
153. Finality of the Board's Findings of Fact   委員會對事實(shí)判定的最后判決
All findings of facts made by the Board shall be final and conclusive.
       委員會所作的所有事實(shí)判定將是最終的決定性的。
 
154. Appeal   申訴
 1) In any Labor dispute case an appeal may be taken to the Federal High Court by an aggrieved party on questions of law, within thirty (30) days after the decision has been read to, or served upon, the parties whichever is earlier.
在任何勞資糾紛中,雙方無論哪一方較早,委屈方可在判決宣讀或?qū)嵤┲蟮?0天內(nèi),就法律爭端向聯(lián)邦高級法院申訴。
 
2) The court shall have the power to uphold, reverse or modify the decision of the Board.
       法院有權(quán)贊成、反對或修改委員會的決議。
 
3) The court shall give its decision within thirty days from the date on which the appeal is submitted to it in accordance with Article 1 of this Article.
根據(jù)本條附款1),法院需在提出申訴30天內(nèi)作出決定。
 
155. Offences against the permanent or the adhoc Board    觸犯委員會的行為
1) Whosever in the course of a Board in-quiry, proceeding or hearing in any manner degrades, holds up to ridicule, threatens or disturbs the Board or any of its member in the discharge of their duties, shall be punishable with simple imprisonment not exceeding six months, or with fine not exceeding Birr 1000 (Birr one thousand.)
在委員會詢問過程中,無論何人以何種方式拉攏、諷刺、威脅或騷擾委員會或其履行義務(wù)的任何成員,將被處以6個月的監(jiān)禁或處以不超過1000比爾的罰款。
 
2) Where the offence described in sub-article (1) of this article is not committed openly or during open hearing the punishment, except in more serious cases, shall be a fine not exceeding Birr 500 (five hundred Birr).
若本條附款1)中所述的違紀(jì)非公開所為或在公開審理期間,除更為嚴(yán)重的案例外,則處以不超過500比爾的罰款。
 
3) Proceedings of the Board shall be considered “quasi-judicial proceedings" and the Board "a competent judicial tribunal" for the purpose of Article 442 of the Penal Code, and violations thereof shall be punishable as provided there under.
委員會的活動將被視為“具有準(zhǔn)司法性的活動”,而對刑事法典第442條來說,委員會是“具有法定資格的審判庭”。因此,任何侵犯行為將按下述的規(guī)定予以處罰。
 
4) The Board may punish any person who committed any offence described in this Article.

156. Annual Report    年報(bào)
The permanent or the adhoc Board shall submit to the Minister an annual report of its activities.
       委員會必須向部長呈報(bào)其活動年報(bào)。
 
CHAPTER FIVE Strike and Lock-out第五章 罷工及停工
157. General    總則
1) Workers have the right to strike to protect their interest in the manner prescribed in this Proclamation.
工人有權(quán)以本公告規(guī)定的方式罷工以保護(hù)其利益。
 
2) Employers have the right to lock-out in the manner prescribed in this Proclamation.
         雇主有權(quán)以本公告規(guī)定的方式停工。
 
3) The provisions of Sub-Articles 1 and 2 of this Article shall not apply to workers and employers of undertakings referred to in Article 136 (2) of this Proclamation.
本條附款1)和2)之規(guī)定,將不適用于本公告第136條中提及的企業(yè)的工人和雇主。
 
158. Conditions to be fulfi1ed    要求的條件
Before initiating a strike or lock-out partially or wholly the following steps shall be taken:
在進(jìn)行罷工或部分地、完全地停工之前,必須采取下列步驟:
 
1) Unless otherwise provided in this Proclamation, the party initiating a strike or lock-out shall give advance notice to the other concerned party indicating its reasons for taking the said action;
除非本公告另有規(guī)定,準(zhǔn)備罷工或停工的一方必須提前通知有關(guān)的另一方,說明其采取上述行動的原因;
 
2) Both parties should make all efforts to solve and settle their labor dispute through conciliation;
雙方應(yīng)通過調(diào)解盡一切努力妥善解決勞資糾紛;
 
  3) The strike to be taken by the workers should be supported by a majority of the workers concerned in a meeting in which at least 2/3rd of the members of the trade union were present;
罷工應(yīng)受到出席會議的至少2/3的工會成員及有關(guān)的大多數(shù)工人的支持;
 
  4) Measures should be taken to ensure the observance, by employers and workers, of safety regulations and accident prevention procedures in the undertaking.
雇主和工人必須采取措施,確保企業(yè)中遵守安全規(guī)則,預(yù)防發(fā)生事故。
 
159. Procedure for Notice     通知的程序
1) The notice under Article 158 (1) shall be given by the party initiating a strike or lock-out to the other concerned party and to the representative of the Ministry in the region or the concerned government office.
根據(jù)第158條附款1)的規(guī)定,準(zhǔn)備罷工或停工的一方必須向另一方和部在地區(qū)或有關(guān)政府機(jī)關(guān)的代表發(fā)出通知。
 
2) The notice specified in Sub-Article (1) shall be served 10 days in advance of taking action.
        附款1)規(guī)定的通知必須在采取實(shí)際行動前十天送達(dá)。
 
160. Prohibited Actions     禁止
1) Without Prejudice to the provision of Sub-Article (1) of Article 159, a strike or lock-out initiated after a dispute has been referred to the Board or to the court and 30 days have not elapsed before any order or decision is given by the Board or the prescribed period has elapsed before the court gives decisions is unlawful;
在不違背第159條附款1)的規(guī)定時,當(dāng)把糾紛提交至委員會或法院之后,在委員會下達(dá)任何指令或作出決定前的三十天尚未結(jié)束,或在法院作出決定前規(guī)定的時間尚未結(jié)束,這樣開始的罷工或停工將是非法的。
 
2) It shall be unlawful to refuse to obey, or to take or continue to strike or to lock-out against or in conflict with the final order or decision of the Board or of the court disposing in whole or in part of labor dispute proceedings or to delay unwarrantedly in obeying such Board or court order or decisions; provided, however, that the strike or lock-out initiated, which is not against or in conflict with any such order or decision, but seeks to compel compliances therewith, shall not be deemed illegal or prohibited.
拒絕服從、繼續(xù)罷工或停工,或在與部分或全部處理勞資糾紛活動的委員會或法院的最后命令或決定沖突時,或在聽從這樣的委員會或法院指令或裁決時,擅自拖延將是非法的。然而,倘若進(jìn)行的罷工或停工與任何這樣的指令或決定不相悖或不沖突,而是用這種方法尋求對方答應(yīng),則不視為非法也不禁止。
 
3) It is prohibited to accompany strike or lock-out with violence, threats of physical force or with any act which is clearly and officially unlawful.
嚴(yán)禁在罷工或停工時使用暴力,身體的威脅或使用明顯和公然采用非法的任何行為。
 
CHAPTER SIX Fees第六章 費(fèi)用
161. Exemption from Fees     免繳訴訟費(fèi)
1) No court fees shall be charged in respect of cases submitted to conciliation and to the Labor Relations Board by any workers or trade union, employer or employers’ associations in accordance with Articles 141 and 147.
根據(jù)第141和第147條的規(guī)定,任何工人或工會、雇主或雇主協(xié)會提交的,給調(diào)解和勞資關(guān)系委員會的有關(guān)案子都免繳訴訟費(fèi)。
 
2) No court fees shall be charged in respect of cases submitted by any worker or trade union to courts.
        由任何工人向法院提交的有關(guān)案子免繳訴訟費(fèi)。
 
PART TEN Period of Limitation and Priority of Claims第十部分 優(yōu)先和限制投訴的期限
CHAPTER ONE Period of Limitation第一章 限制階段
162. Limitation    限制
1) Unless a specific time limit is provided otherwise in this Proclamation or other relevant law, an action arising from an employment relationship shall be barred by limitation after one year from the date on which the claim becomes enforceable.
除非在本公告中或其它相關(guān)法律中規(guī)定了時限,由雇傭關(guān)系合同引起的訴訟,必須限制在索賠成立之日起的一年之內(nèi)。
 
2) Any claim to be reinstated by a worker arising from the unlawful termination of a contract of employment shall be barred after three months from the date of the termination of the contract of employment.
由非法終止雇傭合同,引起工人提出恢復(fù)該合同的任何要求,必須限定在雇傭合同終止之日起的三個月內(nèi)。
 
  3) Claims by a worker for payment of wages, overtime and other payments shall be barred after six months from the date it become due.
由工人提出的工資支付、加班及其他報(bào)酬的索賠要求將限定在這些費(fèi)用已兌現(xiàn)之日起的六個月內(nèi)。
 
4) Any claims by a worker or employer for any kind of payment shall be barred by limitation unless an action is brought within six months from the date of termination of the contract of employment.
除非在雇傭合同終止之日起的六個月內(nèi)提出訴訟,由工人或雇主對任何種類報(bào)酬提出的要求將不能付諸訴訟。
 
5) The relevant law shall be applicable to the period of limitation which is not provided for in this Proclamation.
相關(guān)法律必須適用于本公告中未規(guī)定的時限。
 
163. Calculation of Period of Limitation    時限的計(jì)算
1) Unless otherwise specifically provided for in this Proclamation, the period of limitation shall begin to run from the day following the day when the right may be exercised.
除非本公告中另有規(guī)定,時限必須從可行使權(quán)利之日后的那一天起計(jì)算。
 
2) Whenever the last day of a period of limitation falls on a day other than a working day, it shall expire on the next working day.
無論何時,如時限的最后之日并非工作日,時限必須延長至下一個工作日。
 
164. Interruption of a Period of Limitation.     時限的中斷
A Period of limitation shall be interrupted by     時限必須在下列情況下中斷:
1) any action taken before an authority responsible for the determination of labor disputes until a final decision is given.
在對勞務(wù)糾紛終止負(fù)責(zé)的權(quán)威機(jī)關(guān)作出最后的決定之前采取了任何行動;
 
2) any action taken before the competent authority responsible for the enforcement and application of this proclamation until a final decision is given in writing.
        在負(fù)責(zé)本公告的執(zhí)行和應(yīng)用的主管機(jī)構(gòu)做出最終書面決定前,采取了任何行動;
 
3) the express recognition of the other party's right provided, however, that a period of limitation interrupted on such ground may not be interrupted for more than three times in the aggregate.
明確承認(rèn)另一方的權(quán)利,然而,根據(jù)這樣的理由中斷的期限,總計(jì)中斷不得超過三次。
 
165. Waiver of Limitation    限制的棄權(quán)
Any party may waive this right to raise as a defense a period of limitation after its expiry, provided, however, that, a waiver of such right made before the date of expiry of the period of limitation shall have no effect.
任何一方在到期以后可棄權(quán),以提出一段限制期作為辯護(hù)。然而,在限制期限到期之日前的棄權(quán)將是無效的。
 
166. Discretion of the Competent Authority    主管機(jī)關(guān)的判斷
1) The authority responsible for the determination of labor disputes may accept an action after the expiry of a period of limitation if it ascertains that the delay is due to force majeure provided, however, that unless the action is brought within ten days from the date the force majeure cease to exist, and it shall not be accepted.
對勞務(wù)糾紛的決定負(fù)責(zé)的機(jī)關(guān),若查明這種延誤是由于不可抗力,可以在限期到期之后接受訴訟。然而,除非該訴訟在此不可抗力存在之日起十天之內(nèi)提出,否則該訴訟可不予接受。
 
2) Without affecting the generality of the provisions of Sub-Article (1) of this Article, the following shall be good cause of disregarding a period of limitation.
        在不影響本條附款1)之一般規(guī)定時,下列將是不考慮限制期的正當(dāng)理由:
 
       (a) illness of the concerned worker;    有關(guān)的工人生病;
       (b) transfer of the worker upon order to a place other than his residence;
        根據(jù)命令工人調(diào)動到其住地以外的地方;
 
       (c) call of the concerned worker for national service.    有關(guān)工人應(yīng)招為國家服務(wù)。
 
CHAPTER TWO Priority of Claims第二章 要求優(yōu)先權(quán)
167. Priority over Other Debts     優(yōu)于其他債務(wù)的權(quán)利
Any claim of payment of a worker arising from employment relationship shall have priority over other payments or debts.
由雇傭關(guān)系引起的工人的報(bào)酬的任何要求必須有優(yōu)于其他報(bào)酬或責(zé)任的權(quán)利。
 
168. Procedure of Payment of Claims     要求付款的程序
1) In the event that the undertaking is liquidated, execution officers or other persons authorized by law or the court to execute such liquidation shall have the duty to pay the claims referred to in Article 167 within thirty days following the decision of the competent authority.
如果企業(yè)破產(chǎn)(被清算),由法律或法院授權(quán)的執(zhí)行官或其他人執(zhí)行這樣的清算,將有義務(wù)在主管機(jī)關(guān)決議之后,給予第167條中談到的工人30天時間的請求權(quán)。
 
2) Where the said claims are not met within the time limit set forth in Sub-Article (1) of this Article due to lack of funds, they shall be paid as soon as the necessary funds are available.
如果由于缺乏資金,本條附款1)中提出的有限時間內(nèi)不能滿足上述要求,一旦得到必要的資金,這些要求就將兌現(xiàn)。
 
169. Lien of Home Workers    家庭工人的留置權(quán)
Where the undertaking is liquidated or cease to operate Home workers may exercise a lien on goods in their possession that they have produced for a employer and such lien shall be of equal rank to their claims. Such measure shall be deemed an action taken to enforce the right provided for in Article 167.
若企業(yè)破產(chǎn)結(jié)算或停止運(yùn)作,家庭工人可對為雇主生產(chǎn)的其自身占有的部分貨物行使留置權(quán),此留置權(quán)必須與其要求相符。這樣的措施必須視為實(shí)施第167條中規(guī)定的權(quán)利所采取的行動。
 
PART ELEVEN Enforcement of Labor Law第十一部分 勞動法的實(shí)施
CHAPTER ONE Labor Administration第一章 勞動管理
170. Power of the Minister     部長的權(quán)利
  1) The Minister may issue directives necessary for the implementation of this Proclamation. He may in particular, issue directives on the following:
為實(shí)施本公告部長可頒發(fā)必要的指令,特別是可就下列情況發(fā)布指令:
 
(a) occupational safety, health and the protection of working environment;
        職業(yè)安全,職業(yè)衛(wèi)生及工作環(huán)境的保護(hù);
 
(b) standards of working conditions;     工作條件的標(biāo)準(zhǔn);
 (c) classification of hazardous jobs;    有害工作分類;
(d) in consultation with the concerned organs, type of works which are particularly arduous or dangerous to the health and to the reproductive systems of women workers;
        會同有關(guān)部門,特別艱苦或?qū)】涤泻Φ囊约皩εど形kU(xiǎn)的工種;
 
(e) types of works which requires work permits for foreigners and in general, the manner of giving work permits;
要求外國人具有工作許可證的工種及頒發(fā)工作許可證的一般方式;
 
(f) employment of Ethiopian nationals outside of Ethiopia;     埃塞境外的埃塞人的雇傭;
(g) in consultation with the concerned organs, types of occupations and works in which apprenticeship need to be given;
會同有關(guān)部門,需要規(guī)定學(xué)徒年限的職業(yè)與工種;
 
(h) duration of apprenticeship;      學(xué)徒培訓(xùn)期;
 (i) theoretical and practical aspects of apprenticeships as well as the manner of giving tests;
         學(xué)徒培訓(xùn)的理論和實(shí)踐以及測試方式;
 
u) procedure for the registration of job-seekers and vacancies;   求職者及空額的登記程序;
(k) procedure for the reduction of work force;    勞動力裁減程序;
  (i) undertakings required to have insurance coverage for the payment of employment injury benefit.
要求具有工傷收益報(bào)酬保險(xiǎn)范圍的企業(yè)。
 
2) The Minister shall organize, coordinate, follow up and execute the labor administration system by establishing an Employment Service, a Labor Inspection Service and also a permanent Advisory Board which consists members from the Government, employers associations and trade unions.
部長必須通過建立雇傭服務(wù)、勞務(wù)析查服務(wù)及由部、雇主協(xié)會和工會成員組成的永久性顧問委員會,對勞務(wù)管理制度進(jìn)行組織、協(xié)調(diào)、跟蹤及實(shí)施。
 
171. Advisory Board     顧問委員會
The Advisory Board, is an organ established in accordance with Sub-Article (2) of Article 170 which shall study and examine matters concerning employment service, working conditions, the safety and health of workers, the labor laws in general and give advisory opinion to the Minister. Its duties and responsibilities shall be determined in the directives to be issued by the Minister.
顧問委員會是根據(jù)第170條附款2)建立的機(jī)構(gòu),它必須研究并析查有關(guān)雇傭服務(wù)、工作條件、工人的安全及健康以及勞動法,并向部長提出咨詢意見,其義務(wù)和責(zé)任將在部長發(fā)布的指令中決定。
 
SECTION ONE Employment Service 第一節(jié) 雇傭服務(wù)
172. Employment Service     雇傭服務(wù)
 
 Employment services shall include the following;        雇傭服務(wù)應(yīng)包括下列情形:
1) assist persons who are able and willing to work to obtain employment;
         協(xié)助有能力并愿意工作的人獲得雇傭;
 
  2) assist employer in the recruitment of suitable workers for their works;
         協(xié)助雇主招收適合其工作的工人;
 
3) determine the manner in which foreign national are employed in Ethiopia;
         決定在埃塞雇傭外國人的方式;
 
4) determine the. manner in which Ethiopian nationals are employed outside of Ethiopia;
         決定埃塞境外的埃塞人受雇的方式;
 
5) Co-operate with the concerned offices and organizations in the preparation of training programs;
         協(xié)助有關(guān)機(jī)關(guān)和組織籌備培訓(xùn)計(jì)劃;
 
6) undertake studies concerning the employed and unemployed manpower of the country;
        承擔(dān)國家已受雇的和未受雇的人力資源研究;
 
7) in collaboration with the concerned offices conduct studies relating to the manner of improving vocational training at the national level and distribute same to beneficiary and implement the employment policy properly.
與有關(guān)機(jī)關(guān)合作,指導(dǎo)與改進(jìn)國家級職業(yè)培訓(xùn)方式有關(guān)的研究,并向感興趣者頒布,恰如其分的落實(shí)雇傭政策。
 
173. Employment Exchange     雇傭交換
        Employment Labor exchange shall include the following:
        雇傭勞務(wù)交換將包括下列情形:
1) registration of job-seekers and vacancies;      求職者與空額的登記;
2) selection from among the registered job-seekers and sending those who fulfill the requirements to compete for the positions notified by employers;
         從已登記的求職者中送派符合要求者,以競爭雇主通知的職位;
 
3) registration by the person assigned for this purpose by the Minister, of job seekers who have attained the age of 14 years and above upon presenting the necessary documents.
由部長為此目的指派的,年滿14周歲及14歲以上,提交了必要資料的求職者登記。
 
174. Employment of Foreign Nationals    外國人的雇傭
1) Any foreigner may only be employed in any type of work in Ethiopia where he possesses a work permit given to him by the Ministry.
任何外國人,若具有部頒發(fā)的工作許可證,方可在埃塞受聘任何工種。
 
2) A work permit shall be given for an employment in a specific type of work for three years and shall be renewed every year. However, the Ministry may vary the three years limit as required.
在特殊工種中,可發(fā)雇傭工作許可證,有效期為三年,并每年更新,然而,部可根據(jù)需要改變此三年限度。
 
3) Where the Ministry ascertains that the foreigner is not required for the work, the work permit may be cancelled,
若部確認(rèn)該外國人并非此項(xiàng)工作所要求的,工作許可證將被取消。
 
  4) The Minister in accordance with the law may charge service charge for the issuance, renewal or replacement of work permit.
         根據(jù)法律,部可以支付工作證的簽發(fā)、更新或替代服務(wù)費(fèi)。
 
175. Employment of Ethiopian Nationals Abroad     境外埃塞人的雇傭
An Ethiopian national may be employed outside of Ethiopia where the Ministry has obtained adequate assurances that his rights and dignity shall be respected in the country of employment.
若部已獲得其權(quán)利及尊嚴(yán)在雇傭國家受到尊重的適當(dāng)保證,埃塞境外的埃塞人可以受雇。
 
176. Prohibition.     禁止
No person or entity shall perform employment exchange activities for consideration.
        任何個人或?qū)嶓w不得為了酬金而進(jìn)行職業(yè)介紹活動。
 
SECTION TWO Labor Inspection Service第二節(jié) 勞務(wù)檢查服務(wù)
177. Labor Inspection Service     勞務(wù)檢查服務(wù):
Labor Inspection service shall include the following:     勞務(wù)檢查服務(wù)包括:
1) ensure the implementation of the provisions of this Proclamation, regulations and directives issued in accordance with the Proclamation, other laws relating to labor relations, registered collective agreement, and the decisions and orders given by the authorities responsible to determine labor disputes;
確保本公告之規(guī)定,根據(jù)本公告所頒發(fā)的指令和規(guī)章,與勞務(wù)關(guān)系、已注冊的集體協(xié)議有關(guān)的其他法律的實(shí)施,以及確保負(fù)責(zé)解決勞資爭議的當(dāng)局作出的決議和命令的實(shí)施。
 
2) supervise, executive, educate, study, make research and prepare a standard of work to ensure the implementation of the provisions issued in accordance with this Proclamation and other laws regarding working conditions, occupational safety, health and working environment;
根據(jù)本公告及其他法律中有關(guān)工作條件,職業(yè)安全,健康及工作環(huán)境的規(guī)定,監(jiān)督、貫徹、教育、調(diào)整、研究、籌備工作標(biāo)準(zhǔn)以保證本公告的實(shí)施。
 
3) prepare the list of occupational diseases and schedules of degrees of disablement;
         準(zhǔn)備職業(yè)病目錄及殘疾等級時間表;
 
4) classify dangerous trades or undertakings;    將危險(xiǎn)職業(yè)和企業(yè)分類;
5) conduct studies, and compile statistical data relating to working conditions;
        指導(dǎo)、研究并編譯與工作條件有關(guān)的統(tǒng)計(jì)資料;
 
6) prepare training programs concerning the prevention of employment injuries;
        準(zhǔn)備有關(guān)預(yù)防工傷的培訓(xùn)計(jì)劃;
 
7) supervise and ensure that where undertakings are constructed, expanded, renovated or       their appliances installed, they are not dangerous to the safety and health of workers;
監(jiān)督并確保企業(yè)的修建、擴(kuò)大再生產(chǎn)、革新或其設(shè)備的安裝不會危及工人的安全及健康。
 
8) take administrative measures in order to implement this Proclamation and regulations and directives issued in accordance with this Proclamation;
為實(shí)施本公告以及根據(jù)本公告頒布的規(guī)章和指令而采取行政措施;
 
9) to seek in the courts or in the authorities responsible for determining labor disputes appropriate measures for the enforcement of the provisions of this Proclamation and of such sanctions as may be required by its decision rendered in the course of its lawful activities.
在法院或負(fù)責(zé)解決勞務(wù)糾紛的機(jī)關(guān)中,尋求實(shí)施本公告之規(guī)定及在其合法的活動過程中產(chǎn)生的決定要求的法令的適當(dāng)措施。
 
178. Powers and Duties of Labor Inspectors    勞動析查員的權(quán)利及義務(wù):
1) The Minister shall assign Labor Inspectors who are authorized to carry out the responsibilities of follow-up and supervision of the inspection service.
        部將指派經(jīng)授權(quán)的勞務(wù)析查員,以執(zhí)行析查服務(wù)的跟蹤與監(jiān)督責(zé)任。
 
2) The Labor Inspectors shall have an identity card issued by the Minister bearing the official seal.
        勞務(wù)析查員將持有蓋有公章并由部長簽發(fā)的身份證。
 
3) The Labor Inspectors shall have the power to enter, during any working hours without prior notice, any work place which they may think necessary to inspect in order to examine, test or enquire to ascertain observation of the provisions of Article 177. In particular:
勞資檢查員有權(quán)在工作時間不預(yù)先通知的情況下,進(jìn)入其認(rèn)為有必要檢查的任何工作地,檢查、測試或詢問以查明第177條之規(guī)定的遵守情況,特別是:
 
       (a) to question any person alone or in the presence of witnesses;
        在有證人時或單獨(dú)詢問任何人;
 
       (b) to check, copy or extract any paper, file or other documents;

       (c) to ensure that the relevant notices are affixed at the appropriate place of work.
        保證在適當(dāng)?shù)墓ぷ鞯睾炇鹣嚓P(guān)的通知;
 
(d) to take any sample of any matter in a work place and to test it to ensure that it does not cause injury to workers;
        獲取工作地的任何典型資料,并驗(yàn)證該供調(diào)查的資料,以確保未引起對工人的傷害。
 
 (e) to take photograph of any worker, and measure draw or test buildings, rooms, factories, car tools, goods and copy and registered document in order to ensure the safety and health of workers;
給每個工人拍照,并丈量、繪制或測試建筑物、房間、工廠、汽車工具、貨物及抄錄任何注冊文件,以確保工人的安全和健康。
 
4) Where a sample is taken in accordance with Sub-Article (3)(d) of this Article, the employer shall be informed in advance, the manager or his representative and shall have the right to be present.
根據(jù)本條附款3)b)的規(guī)定,若獲取典型調(diào)查的資料,必須提前通知雇主,經(jīng)理或其代表將有權(quán)到訪。
 
179. Measures to be taken by Labor Inspection    勞務(wù)檢查擬采取的措施
1) Where the Labor Inspector observes that there is on or in the premises, plant, installations, machinery, equipment or material of any undertaking or in the working methods being followed therein any conditions which constitute a threat to the health, safety or welfare of the workers of such undertaking, shall instruct the employer to correct such condition within a given period of time.
若勞務(wù)檢查員發(fā)現(xiàn)在任何企業(yè)的房屋、廠房、裝置、機(jī)械設(shè)備內(nèi)外或材料上,或工作方法中出現(xiàn)了構(gòu)成對該企業(yè)工人健康、安全或福利的威脅的任何情況,他必須責(zé)成雇主在給定的時間內(nèi)予以糾正。
 
2) Upon failure of the employer to take such steps within the given time after receiving instructions in accordance with Sub-Article (1) of this Article, the Labor Inspector shall issue to the employer an order requiring;
根據(jù)本條款1)的規(guī)定,若雇主在接到指示后的給定的時間內(nèi)未能采取有效步驟,勞務(wù)檢查員必須向雇主發(fā)布命令要求:
 
(a) that alteration in existing conditions which may be necessary to remove the threat to the health, safety or well-being of the workers be completed within a stated period of time;
必須在規(guī)定的時間內(nèi),完成對排除威脅工人的健康安全或福利的現(xiàn)有方面的必要的改變;
 
(b) that any measures which may be necessary to prevent imminent danger to the safety or health of the workers to be taken immediately.
有待立即采取防止對工人的安全或健康有迫切危險(xiǎn)的任何措施;
 
3) Where the Labor Inspector is in doubt about the technical or legal danger of any particular case, he shall report thereon to the minister requesting that appropriate decision be given and orders issued accordingly.
若檢查員對任何特殊案子的技術(shù)和法律方面有懷疑,他必須就此向部長報(bào)告,請求作出決定并發(fā)布命令。
 
180. Appeal   上訴
1) Where the employer is dissatisfied with the order given in accordance with Sub-Articles (1) and (2) of Article 179, he may appeal to the authority responsible to determine labor disputes court within five working days, provided, however that there shall not be a stay of execution where the order is given to avert an imminent danger pursuant to Article 179 (2) (b).
若雇主對根據(jù)179條付款1)和2)發(fā)出的命令不滿意,可以在五個工作日內(nèi)向負(fù)責(zé)人解決勞務(wù)糾紛的機(jī)關(guān)申訴。然而,按照第179條2)b)發(fā)出的防止緊急危險(xiǎn)的命令,不得延期執(zhí)行。
 
2) The decision given on the appeal filed in accordance with Sub-Article (1) of this Article shall be final. Where the employer does not appeal within the time limit, the decision shall be executed by the appellate court.
根據(jù)本條付款1)就提出的申訴所作出的裁決將是最終裁決。若雇主在有限的時間內(nèi)不上訴,該決定須由受理上訴的法院執(zhí)行。
 
181. Restriction on the Functions of Labor Inspectors    檢查員的職責(zé)的限制
  1) The Labor Inspectors shall perform their functions diligently and impartially. They shall take into account any reasonable suggestions given to them by employers and workers.
檢查員必須勤勉地,大公無私地履行其職責(zé)。他們必須考慮到雇主和工人向其提出的任何合理化建議。
 
2) No Labor Inspector shall at any time, whether during or after he left his employment, reveal to any other person any secrets of manufacturing, commercial or other working processes which may come to his attention in the course of performing his duties under this Proclamation.
無論在受雇期間還是在離職后的任何時候,任何檢查員不得向任何人泄露在其履行本公告中規(guī)定的義務(wù)過程中可能注意到的有關(guān)生產(chǎn)、商業(yè)和其他工藝的任何秘密。
 
3) No Labor Inspector shall reveal to any person other than the concerned authority in the Ministry the sources of any complaint brought to his attention concerning a defect or breach of legal provision and, in particular, he shall not make any intimations to any employer or his representative that his inspection visit was made in response to a complaint filed with the Labor Inspection Service.
任何檢查員不得向除部的相關(guān)以外的任何人泄露其所注意到的關(guān)于合法條款的不足或違反的任何抱怨的來源,尤其不得暗示任何雇主或其代表其所作的檢查是響應(yīng)勞務(wù)檢查服務(wù)提出的控訴而為。
 
4) A Labor Inspector shall in all cases notify the employer of his presence on the premises of the undertaking unless he considers that such notification may be prejudicial to the efficient performance of his duties.
勞務(wù)檢查員必須在所有案件中,就企業(yè)的上述各點(diǎn)通知雇主到場,除非他認(rèn)為這樣的通知可能有損于其義務(wù)的有效履行。
 
5) No Inspector shall supervise any undertaking of which he is an owner or in which he has an interest.
任何檢查員不得監(jiān)督其是擁有者,或者其中享有股權(quán)的任何企業(yè)。
 
  6) A Labor Inspector shall refrain from interference or involvement in labor disputes and collective bargaining as a conciliator or an arbitrator.
作為一個調(diào)停人或仲裁人,檢查員必須避免干涉或卷入勞資糾紛和集體磋商中。
 
182. Prohibition    禁止
The following acts shall be deemed to constitute obstruction of the Labor Inspector in the performance of his duties:
下列行為將被視為對勞務(wù)檢查員履行公務(wù)的妨礙:
 
1) preventing the Labor Inspector from entering a work place or from staying in the premises;
         阻止勞務(wù)檢查員進(jìn)入工作場所或呆在廠房內(nèi);
 
2) refusing to let the inspector examine records or documents necessary for his functions;

3) concealing data relating to employment accidents and the circumstance in which they occur.
          隱瞞與雇傭事故及事故發(fā)生的情況有關(guān)的資料;
 
4) any other act or omission that delays or interferes with the exercise of the Labor Inspector's function.
           耽誤或干涉勞務(wù)檢查員行使其職責(zé)的其他任何行為。
 
PART TWELVE Penalty and Transitory Provisions 第十二部分 處罰及暫時條款
CHAPTER ONE Penalty Provisions第一章 處罰條款
183. General   總則
Unless the provisions of the Penal Code provide more severe penalties, the penalties laid down in this Chapter shall be applicable.
除非刑事法典的條款規(guī)定更為嚴(yán)厲的處罰,本章中規(guī)定的處罰將是適用的。
 
184. Offences by an Employer    雇主的違法行為
       1) An Employer who:     雇主:
 (a) causes workers to work beyond the maximum working hours set forth in this Proclamation or contravenes in any manner the provision relating to working hours;
使工人工作時間超過本公告中的規(guī)定的最大時限,或以任何方式違反與工作時間有關(guān)的規(guī)定;
 
 (b) infringes the provisions of this Proclamation regulating weekly rest days, public holidays, or leaves; or
違反本公告之規(guī)定調(diào)整周休日,公休或休假;
(c) contravenes the provisions of Article 19 of this Proclamation; shall be liable to a fine not exceeding Birr 500 (Birr five hundred).
違反本公告之第19條之規(guī)定,將處以不超過500比爾的罰款。
 
2) An employer who:     雇主:
(a) fails to fulfill the obligations laid down in Article 12(4) of this Proclamation;
          未能完成本公告第12條附款4)規(guī)定的職責(zé);
 
 (b) Fails to keep records required by this Proclamation, and provide type of information at a reasonable time to the Ministry in accordance with this Proclamation.
         未能保留本公告要求的記錄,并未能根據(jù)本公告向部提供合理的信息。
 
(c) violates the provisions of Article 14 (1) of this Proclamation; or
 違反本公告第14條附款1)的規(guī)定;或
 
(d) terminates a contract of employment contrary to Article 26(2) of this Proclamation; shall be liable to a fine not exceeding Birr 1200 (Birr one thousand and two hundreds).
違背本公告第26條附款2)的規(guī)定終止雇傭合同,將處以不超過1200比爾的罰款。
 
185. Common Offences     共同觸犯
        an employer or a trade union which:     雇主或工會:
        1) violates regulations and directives issued in accordance with this Proclamation relating to the safety of workers and commit and act which expose the life and health of a worker to a serious danger or does not give special protection to women workers and young workers' as provided for in Labor Proclamation.
違反根據(jù)本公告頒發(fā)的與工人安全健康有關(guān)的規(guī)章及指令,使工人的安全及健康面臨嚴(yán)重危險(xiǎn),或未根據(jù)本公告規(guī)定,給予女工及青工以特殊保護(hù)的;
 
2) fails to bargain in accordance with Article 130(4) of this Proclamation;
         未能根據(jù)本公告之第130條附款4) 進(jìn)行磋商的;
 
3) contravenes the provisions of Article 160 of this Proclamation;
          違反本公告之第160條規(guī)定的;
 
4) does not comply with the order given by the Labor Inspectors in accordance with this  Proclamation or of the provision other laws; or
         不遵守勞務(wù)檢查員根據(jù)本公告或其他法律所發(fā)出的指令的;
 
5) gives intentionally false information and explanations to the competent authorities; shall be liable to fine not exceeding Birr 1200 (one thousand and two hundred) or where the offence is committed by a worker or the representative of the employer, a fine not exceeding Birr 300 (three hundred).
有意向主管當(dāng)局提供假情報(bào)和說明的;雇主或工會應(yīng)處以不超過1200比爾的罰款,工人或雇主的代表應(yīng)處以不超過300比爾罰款。
 
186. Violations of the Provisions of this Proclamation    對本公告之規(guī)定的違反
The Labor Inspector may submit cases involving offences committed in violation of the provisions of this Proclamation or regulations and directives issued hereunder to the authorities competent to determine labor disputes under Part Nine of this Proclamation.
勞務(wù)檢查員可呈報(bào)涉及違背本公告之規(guī)定或規(guī)章以及在下面問主管當(dāng)局發(fā)布指令,以解決本公告第九部分中的勞務(wù)糾紛的案子。
 
187. Period of Limitation     時限
No criminal proceedings of any kind referred to in this Proclamation shall be instituted where one year has elapsed from the date on which the offence was committed.
本公告任何種類的犯罪活動,從犯罪之日若一年已經(jīng)過去則不予追究。
 
CHAPTER TWO Transitory Provisions第二章 暫時借款
188. Notwithstanding the provisions of Article 190 of this Proclamation, and before entering into force of this Proclamation;   盡管有本公告第190條的規(guī)定,在本公告生效之前:
 
1) directives issued in accordance with proclamation No. 42/1993 shall remain enforce, in so far as they are not inconsistent with this Proclamation.
        根據(jù)第42/1993號文件頒布的指示,只要不與本公告相矛盾,將仍然有效。
 
2) collective agreements concluded in accordance with Proclamation No. 42/1993 shall be deemed concluded in accordance with this Proclamation hence this Proclamation shall be applicable.
根據(jù)第42/1993號公告締結(jié)的集體協(xié)議將被視為根據(jù)本公告而締結(jié)的。因此,本公告將是適用的。
 
3) Trade unions and Employers Association established in accordance with proclamation 42/1993 shall be deemed established in accordance with this proclamation.
根據(jù)第42/1993號公告成立的工會和雇主協(xié)會將被視為根據(jù)本公告而成立的。
 
4) Labor disputes pending before any authority competent to settle labor dispute prior to the coming into force of this proclamation shall be settled in accordance with the law and procedure which were enforce before this proclamation came into force.
本公告生效前,主管部門解決勞資爭議時未解決的勞資爭議將根據(jù)本公告生效前的法律和程序解決。
 
189. Determination of Degree of Disablement    殘廢等級的確定
Until the schedule determining the degree of disablement is issued pursuant to Article 102 (1) of this Proclamation the medical board shall continue its functions as usual.
依照本公告第102條附款1)決定的殘廢等級目錄頒布時,醫(yī)療部門必須一如既往地繼續(xù)其職能。
 
190. Repealed Laws    廢止
1) The Labor Proclamation No. 42/1993 (as amended) is here by repealed.
        第42/1993號勞資公告(已作修改的)作廢。
 
2) No laws, regulations, directives and decisions shall, in so far as it is inconsistent with this Proclamation, have force and effect in respect of matters provided for in this Proclamation.
凡與本公告不一致的任何法律、規(guī)章、指令或決議,就本公告規(guī)定的有關(guān)事宜而論沒有任何約束力和效力。
 
191. Effective Date     生效日期
This Proclamation shall enter into force on the date of its publication in Federal Negarit Cazete.
          本公告自發(fā)行之日起生效。
