航空貨物運(yùn)輸代辦協(xié)議
CONTRACT FOR AIR TRANSPORTATION
Party A甲方： 航空貨運(yùn)單位Party B乙方： 客戶
甲乙雙方在平等，協(xié)商，自愿的原則下，簽訂以下協(xié)
Based on the justice and willingness, after friendly negotiation both parties reached the agreement as below:
1）甲方為乙方代辦航空運(yùn)輸，乙方為甲方提供運(yùn)輸設(shè)計(jì)、電話查詢、代辦保險(xiǎn)、打包，航空運(yùn)輸、航空提貨、送貨等一攬子航空服務(wù)。
Party A provides party B the air cargo service as following: delivery design, cargo query, insurance commission, packing, air transportation, picking up and delivering the cargo .etc
2）甲方自收到乙方貨物后至交航空公司交付客戶止負(fù)責(zé)貨物的安全保管。如發(fā)生遺失或損壞，乙方應(yīng)向甲方作出賠償，賠償額按民航局規(guī)定。 (如外包裝完好無(wú)損，內(nèi)物缺少或損壞不在賠償之列)
Party A has the responsibility for the safety of cargo from the consignation by party B till the airways deliver it to the receiver specified by party B. If the cargo was lost or damaged (not including the case that exterior packing is in good condition), party A should make a compensation to B according to the related regulations of CAAC.
3）甲方當(dāng)天收到乙方貨物后，按次日航班進(jìn)行托運(yùn)，如出現(xiàn)航班變動(dòng)或調(diào)整等意外事件，則須及時(shí)通知乙方，雙方相互協(xié)商另行調(diào)整航班。
Normally party A will consign the cargo to airline companies next day after receiving it from party B. If the flight schedule changed or unexpected accidents happened, party A should inform B in time to renew the delivery plan.
4）乙方必須向甲方提供正確的收件人姓名、地址、電話。如因收件人姓名、地址錯(cuò)誤而造成的時(shí)間延誤或經(jīng)濟(jì)損失甲方將不承擔(dān)任何責(zé)任。
Party B must provide A the correct and detail address, name and contact phone number of the receiver. Any delay or lost caused by the error information of the receiver provided by party B, Party A will not take any responsibility in this case.
5）貴重物品如需投保，投保金額按保險(xiǎn)總價(jià)值的 %收取保險(xiǎn)費(fèi)，一旦出險(xiǎn),甲方則按保險(xiǎn)公司的有關(guān)條例對(duì)乙方作出賠償，如乙方未對(duì)其托運(yùn)貨物進(jìn)行投保，一旦出險(xiǎn)，甲方則按民航條例及程序向甲方作出賠償（即物品遺失，缺損，按普通貨物賠償，每公斤最高賠償人民幣貳拾元正）
If party B want to buy insurance for the valuables, the commission is ____% of the total insured value. Once need compensation, party A will pay for it to B according to the insurance items; however party A will only pay part of total value according to the regulations ( RMB 20 per KG ) of CAAC if no insurance.
6）乙方必須把加蓋公章的托運(yùn)單交于甲方確定委托關(guān)系，甲方開具貨運(yùn)分單為結(jié)算憑證。如乙方對(duì)甲方運(yùn)單金額有異議請(qǐng)?jiān)诜謫蝹髡婧?4小時(shí)內(nèi)提出，否則視為確認(rèn)。
To nail down the clientage, Party B must submit the consignation ticket with cachet on it to party A. and then party A will issue a corresponding freight sub-ticket to party B. If party B does not agree to the price of freight, party B must put it forward to party A within 24 hours, otherwise the price of freight will be regarded as confirmed by both parties.
7) 結(jié)算方式： 。到貨后甲方將結(jié)算清單及憑證交乙方，乙方在5個(gè)工作日內(nèi)付清。欠款額度為人民幣 。超過額度，甲方將立即將帳單交給乙方，乙方在收到帳單5個(gè)工作日內(nèi)付清。所有欠款逾期支付，乙方必須向甲方每日支付欠款金額千分之五的滯納金。乙方不得以任何理由拒付甲方運(yùn)費(fèi)。雙方如有爭(zhēng)執(zhí)，應(yīng)按協(xié)商原則處理，協(xié)商不成，可由甲方所在地市法院裁決,仲裁費(fèi)用由敗訴一方承擔(dān)，除非另有規(guī)定。
The method of Payment: ___________. After the whole delivery process is over, party A will submit related bills to party B who is suggested to pay for it within 5 days. Max arrearage volume is RMB________. Once exceeding it, Party A will immediately submit all the bills to B, and party B must pay it off within 5 days. If party B still does not pay it off within 5 days for the overdue account, party B should pay the extra money by 0.5 % of the total arrearage per day. Party B is not allowed to refuse to pay for the freight with any excuse. Any disputes arising from the execution of this contract shall be settled through friendly consultations. In case no settlement can be reached, the case in dispute shall then be submitted to local court on the side of party A for the arbitration. Arbitration fees shall be borne by the losing party ,unless otherwise awarded
8) 協(xié)議一式四份，雙方各執(zhí)二份，協(xié)議自簽定之日起生效，有效期為一年
This contract is in four originals, each Party holds two. And This contract, after its being signed by the parties concerned, shall remain in force for one year.
9）本協(xié)議包含以下附件：
This contract includes the following attachments:
i）公司營(yíng)業(yè)執(zhí)照復(fù)印件兩份 ii）簽字代表身份證復(fù)印件兩份
i） to copies of the business license ii) two copies of the ID card of the signee
